2. Kuchukua hela za walala hoi USD 9million kutoka NSSF kujenga jengo na kuwauzia hao hao waliompa pesa kwa USD 47million.
3. Kuwasainisha na kuwarubuni PSSF USD 36 million ambapo hata ile hati anaishikilia mtu hewa.

Quality Group launches Salamander demolition PR blitz

BATTLING expert opinion and an increasingly spirited government opposition to the demolition of the Salamander building, businessman Yusuf Manji has now launched a broad public relations offensive to try and justify destruction of a national historical heritage.
The CEO of Quality Group Limited yesterday splashed sponsored newspaper advertisements backed with biased news reports, to try and sway government and public opinion over the matter in his favour.
And, as usual, the controversial businessman used the same newspapers gaining a reputation as his mouthpiece as a vehicle to launch the media campaign for the demolition of the protected building.
In the newspaper advertisements published with a model of a glass structure to be supposedly built on the plot where the Salamander building now sits, Manji paints himself as the aggrieved party who just wants to add a new architectural 'masterpiece' to the Dar es Salaam skyline.
Manji concluded the media statement thus: ''By this notice QGL (Quality Group Limited) would like the public to take note that it would not be liable for any injury or death that may occur to anyone visiting the Salamander property....''
The PR blitz comes as government experts maintain that the Salamander building was not condemned and on the verge of collapse as claimed by Quality Group.
Government lawyers say the previous foiled attempt by Quality Group Limited to pull down the ancient building was not only illegal, but it also ignored due process followed in the demolition of buildings.
The Municipal Engineer and legal officer must first issue a signed demolition notice and give tenants of the building 90 days to vacate the targeted building.
Such a notice must be stuck on the wall of the targeted building to ensure it is read by the tenants.
After expiry of the notice, a demolition order is then prepared by the engineer and counter-signed by the lawyer. Such an order must be endorsed by the Regional Commissioner to become enforceable.
And, before the actual demolition takes place after following the entire procedure, the police must be informed to provide security during the exercise.
In complete disregard of the due process, Quality Group Limited posted a charge sheet and ruling on Friday evening before ordering demolition squads to move in the following day, without proper notice to the tenants.
Lawyers representing the government in the fiasco have informed the High Court that there was a serious violation of procedures in the attempted demolition of the Salamander building.
State Attorney John Mapinduzi, clearly stated in his affidavit that the criminal case filed by the Ilala Municipal Council and its ruling purportedly fining Quality Group Limited for its failure to demolish the building was illegal and incorrect.
Quality Group attempted to demolish the Salamander historical building based on a questionable Charge Sheet and Judgement of Criminal Case no.587 of 2006 of the Resident Magistrate's Court of Dar es Salaam at Sokoine Drive that was stuck on the walls of the building without any court order.
The State Attorney described the ruling of the lower court as ''irregular, illegal and incorrect.''
''There is illegality in the decision in the above cited case (CC no. 587/2006) basing on the fact that the trial Magistrate relied on the repealed law to decide this matter, that's Rule 22 of the Township Building Rules, Cap.101 which was repealed by Act no. 8 of 1994, and Government Notice No 123 of 6th May, 2005,'' he stated.
The government has maintained that the building located at the junction of Samora Avenue and Mkwepu Street should not be demolished because it is protected under section 23 of the Antiquities Act no. 10 of 1964.
The Minister of Natural Resources and Tourism, Mr Anthony Diallo, has spearheaded government efforts to protect the building from demolition.
''That building is not a condemned building ... even if it were condemned, the response would be to rehabilitate and restore the structure, certainly not to demolish it,'' he told THISDAY in an earlier interview.
The Minister explained that if the building was indeed inhabitable, it should be vacated to pave way for restoration work, insisting that demolition was totally out of the question.
