26 Tanzanians among group arrested for illegal fishing in Malindi

Thirty-nine Tanzanian and Kenyan fishermen were on Tuesday charged with illegally fishing in a restricted area of the Indian Ocean and using the wrong type of fishing nets.

The accused - 26 Tanzanians and 13 Kenyans - denied the charges before Malindi chief magistrate Julie Oseko. Some of the Tanzanians faced a third count of fishing without work permits.

The fishermen were nabbed at Mayungu with 344kg of fish which they allegedly caught using illegal fishing nets.

The court heard that the accused used illegal fishing methods.

Alfred Wanga, the defence lawyer, asked the court to release the accused on bond.

He requested that the Tanzanians deposit their passports and travel documents with the court. Wanga said the fishermen were under the Mayungu Beach Management Unit.

Prosecutor Alice Mathangani objected to the application and asked the court to deny the accused bond.

She said the offence was serious because it deals with conservation.

Mathangani said 15 of the 26 Tanzanians had temporary passports and could abscond court if released on bail.

The prosecutor also told the court that some of the Tanzanians did not have passports.

“A temporary passport is not a guarantee they will not abscond court since one can process another passport at the border,” she said.

The court ordered the accused be remanded at Malindi prison as the Kenya Wildlife Service does a report. A decision on bond application will be made thereafter.

The case will be mentioned on December 7.

Three Tanzanians have been handed a 15-year jail term each after being charged with terrorism in Kenya.

The trio from Zanzibar, a semi-autonomous archipelago, were arrested last year in the border Wajir County, in northeastern Kenya attempting to cross into Somalia. They were found in possession of items used in terrorism acts.

Mbarouk Ali Adibu (34), Idarous Abdirahman (32) and Islahi Juma (22) appeared before Wajir Senior Resident Magistrate Amos Makoros for sentencing on Wednesday following convictions on Tuesday.

They will now serve their sentences at Wajir Prison.

The judgement comes as the Kenyan government intensifies its fight against terrorism following the attack on a Nairobi hotel-office complex that left 21 people dead.

Wajir County has borne the brunt of terror attacks and is often used as a transit route for recruits joining the Somali-based Al Shabaab militants.

Its proximity to Somalia also makes it a favourite staging and recruitment ground by the terror group.

According to a source who spoke to Nation, more than 50 terror suspects have been detained at the Wajir Prison raising fears that petty offenders at the facility may be radicalised.

“In the past two years, the government has been carrying out massive crackdowns on terror suspects and most of them have at one time passed through the Wajir Prison. We are worried that such a group of suspects could even recruit more prisoners,” he said.

More arrests

Meanwhile, Kenya's Inspector General of Police Joseph Boinnet said Tuesday that 12 terror suspects, among nationals from New Zealand and Ethiopia, were arrested in border northeastern Garissa County.

The foreigners, Mr Boinnet said, were arrested near the Kenya-Somalia border.

“The two were heading to Garissa from Dajabula in a white Toyota Hilux Double Cabin,” Mr Boinnet said.

The New Zealander was identified as Sulub Warfaa, 36. He had two passports bearing different names, the other being Ramadhan Yusuf, the police said.

The other suspect had an Ethiopian passport identified as Sakawawedin Abdullahi Mohammed, 33.

The other ten suspects were arrested during a security crackdown at the Dadaab Refugee Camp in Garissa.

Over 100 fishermen from Tanzania are being held in Kilifi after drifting into the Kenyan waters.

The Kenya Coast Guard Service (KCGS) seized the Tanzanians and their 23 fishing vessels on Friday while operating in Kenya’s territorial waters after their boats landed in Kilifi, Wesa, Watamu, Ngomeni, Malindi, Uyombo, Mayungu and Kipini.

DOCUMENTS

KCGS said some of the fishermen lacked proper personal identification documents.

“On Friday, KCGS received information that 23 boats from Pemba with 108 people on board had drifted into Kenyan shores within Kilifi due to prevailing rough conditions at sea,” KCGS Lieutenant Commander Glen Majanga in Kilifi.

The men claimed they were fishing in Tanzanian waters when the weather conditions worsened.

“They (fishermen) claimed that due to poor visibility, they could not navigate their way,” added the KCGS boss.

Two of the fishermen were rushed to a local hospital where they were treated and discharged.

Mr Majanga urged seafarers to conduct their businesses within the United Nations Convection of the Law of the sea.

He said that KCGS will ensure that Kenyan territorial waters are safe for legal economic activities.

“The weather was bad, we found ourselves in Kenya. We want to go home but the weather is still bad,” said Mr Mbaku M’mbaku, a Pemba-based fisherman.

HEAVY RAINS

Early this week, the weatherman warned of heavy rains and strong winds that may result in storm surges along the coast. Mombasa County Director of Meteorology Edward Ngure warned fishermen to be cautious.

The heavy rains have affected many businesses at the Coast including operations at the Port of Mombasa.

In Kwale, the rains have caused flooding, cutting off Mombasa-Lunga Lunga road near Mwangei.

The Kenya National Highways Authority on Thursday advised motorists in the coastal region to use Kombani-Kwale-Kinango-Lunga Lunga route after floods.

“There must be someone organising the entry of these beggars into the town centre.

“It appears that they are being dropped at specific [points] very early in the morning and picked up late in the evening,” said the official.

FROM MUSOMA

Those arrested are said to be from Musoma in Tanzania.

Police have launched investigations with the aim of arresting those behind the human trafficking syndicate, Nakuru police chief Joshua Omukata said.

“The beggars have been staying in the country illegally,” said Mr Omukata.

Those arrested were taken to court where Senior Resident Magistrate Joe Mkutu Omido ordered their deportation.

Residents and members of the civil society have in the past complained about the increasing number of street children and beggars in Nakuru Town.

They argued that their presence was an eyesore and compromised the security of visitors coming to the town.

The suspects reportedly defrauded local banks and then had the money withdrawn outside Kenya, according to the police.

Police said the three will be arraigned in court on Monday to face electronic fraud charges.

During the arrest police recovered ATM cards, cheque books, laptops among other items.

They added that the operation to weed out more electronic fraudsters continues.

Last month police arrested nineteen Nigerian nationals in Umoja, Kasarani and Roysambu estates in Nairobi over suspected internet scam targeting Kenyan Facebook users.

The police and detectives involved in the swoop did not reveal how much money Kenyans have lost in the scam.

According to the Director of Criminal Investigations (DCI) the scam starts with a simple Facebook friend request.

Twenty seven Tanzanians will be deported following their arrest in Mombasa as part of the nationwide crackdown on illegal immigrants.

Security agents in the county handed them over to the Immigration Department on Thursday for facilitation of repatriation. Some were taken to Likoni police station.

NO IDs

Mombasa Police Commander Johnston Ipara said the Tanzanians were among other immigrants from Congo, Somalia, Eritrea and Ethiopia who were arrested for lacking travel documents.

A Cameroonian was among those taken to the Likoni station, police sources said.

East Africans can use their national IDs to get in and out of Kenya, Burundi, Rwanda, Tanzania and Uganda but Mr Ipara said those apprehended lacked these as well.

"Some were released after producing the required documents,” he said.

CONFUSION

Meanwhile, it has emerged that the lack of clear guidelines on the crackdown has resulted in confusion among police and the administration.

On Wednesday, some of the foreigners were taken to court but they did not take plea as the prosecution applied to have the charges withdrawn.

State counsel Eugene Wangila told the court that the charge in question - of being in the country illegally - will be reviewed.

Senior Principal Magistrate Henry Nyakweba withdrew the case, upon which the immigrants were handcuffed by police and taken back to Likoni.

The crackdown on illegal immigrants started in May, with the government targeting those who were working in the country illegally.

The operation is by a multi-agency team of security agents including police and immigration officers.

Three Tanzanians charged with trafficking Sh30 million heroin

Three Tanzanian businessmen have been charged in Mombasa with trafficking heroin worth Sh30 million.

Hussein Massoud, Othmani Hamisi and Mwenda Hamisi pleaded not guilty before Senior Principal magistrate Janet Kassam.

The three were found with 10.22 kgs of the substance, hidden in false bottoms of the suitcases, at the Lunga Lunga border in Kwale county on Friday.

Police said they were taking the heroin to Mombasa.

Kassam will rule on their bond application on Tuesday.

The value of the drugs had initially been placed at Sh90 million but it lowered to Sh30 million.

On Saturday, Coast Regional Coordinator Benard Leparmarai said 200,000 people would have consumed and that their lives would have been adversely affected.

Leparmarai said sniffer dogs will be introduced at the Kenya-Tanzania border to tame drug trafficking.

Dar es Salaam. Two Tanzanians are among several suspects arrested in Kenya in a crackdown on a syndicate of fake gold dealers who have conned victims of billions of shillings.

The Tanzanians were arrested last month in Nairobi alongside four Kenyans, a Congolese and a Nigerian as authorities intensified the hunt for fake gold swindlers.

The latest burst on the syndicate, on Monday, netted suspects who caused a near diplomatic tiff between Kenya and the United Arab Emirates, after swindling Sh5.5 billion from a man close to the UAE’s royal family.

The Media in Kenya reported yesterday that President Uhuru Kenyatta ordered an operation on the gold scammers after the ruler of UAE, Sheikh Mohammed bin Rashid Al Maktoum, complained to him that his gold had been seized at the main airport in Nairobi (JKIA).

Sheikh Maktoum’s business associate Ali Zandi who runs a gold trading company in Dubai reported that their gold consignment from DR Congo had been detained at JKIA.

“Each time he spoke to President Kenyatta he raised the gold issue and when the President checked there was nothing like that. He was very pissed off and ordered security agencies to find those involved in conning Sheikh,” the Star newspaper quoted a State House source familiar with the events as saying.

The conning of the Sheikh’s associate is said to involve high ranking individuals, including a senior politician and senator in the Kenyan Parliament. Some suspects in this case have been arrested and charged in court.

However, the Tanzanians – Manson Chogga Mtassi and Konie Kalist were implicated in a different case involving 100 kilogrammes of fake gold nuggets. The Tanzanians were also accused alongside the other six suspects of being in possession of millions of fake US Dollars and Zambian Kwachas when they were arrested.

Inspector General of Police Simon Sirro yesterday told Mwananchi on phone that he had not received any news on the arrest of the said Tanzanians.

Kenya’s Director of Criminal Investigations George Kinoti yesterday urged Embassies to advise their nationals coming in for business to be warry of the syndicate.

“The Gold Scam has now reached alarming levels as unsuspecting foreign nationals are being swindled large amounts of money by fraudsters,” he said in a twitter post.

Six Tanzanian beggars arrested in Kenya as more flock Makueni, Migori

Nairobi. Six Tanzanian beggars were arrested on Friday in Makueni, Some of the suspects were on wheelchairs but when police got to them, they rose to their feet and tried to flee, Reports Citizen TV.

”When we went to arrest them, one of them took off on a motorcycle,” Makueni Police Commander Joseph Ole Napeiyan said.

”On further interrogation, we were able to determine that the six were from a neighboring Tanzania,” he added.

It is alleged that the six are part of a group that was brought to Wote every morning and left in the streets to pose as beggars.

They include one man and five women, all of whom were carrying children.

The police boss said they will remain in custody to assist with investigations.

The incident comes days after Migori MCA Esther Onana urged the government to take action against beggars who she said are a menace in the county.

According to Ms. Onana, the beggars are tainting the reputation of people living with disability in Migori who do not begging on a street.

“We want the government of Kenya to repatriate the beggars from Tanzania urgently,” she said last week.

On her part, Mrs. Julie Minyoso who is the Migori county coordinator for the National council for People Living With Disability, urged locals to report such cases .

In 2017, Citizen TV aired an expose on beggars from Tanzania flooding Kenyan streets.

The report revealed that many of the beggars are lured to Kenya by able-bodied men who are the main beneficiaries.

The Tanzanian beggars however, remain destitute despite years of donations from well-wishers.

3 Tanzanians arrested with drugs in Kenya

Kenyan police on Friday arrested three Tanzanian nationals and seized heroin worth over 900,000 U.S. dollars at the common border in Lunga Lunga in the coastal town of Kwale.

The drugs weighing 30 kilograms were seized by a team of security officers on a public bus on transit to Mombasa.

Head of Anti-Narcotics Unit Hamisi Massa said the suspects are among wanted drug traffickers nabbed during the covert operation.

“Acting on intelligence information we arrested the three and seized the drugs concealed in three suitcases. This is major breakthrough in the war on narcotic,” said Massa.

He said the three are being interrogated before they are arraigned in court to face drug trafficking charges on Monday.

Massa said reports indicate that the three were hired by a wanted Tanzania drug baron Swale Ahmed to smuggle the drugs in the country for distribution targeting mainly foreigners.

Ahmed was arrested last year where drugs worth 100,000 dollars were seized by security team in Mombasa.

Intelligence reports indicate that Ahmed runs an empire that smuggle hard drugs, mainly heroin, and has evaded several police dragnets by bribing security agents.

The Friday crackdown was carried out by detectives who were behind the arrest and extradition of four suspected drug traffickers to the United States.

Two Tanzanians have been arrested for allegedly smuggling marijuana worth Sh500, 000 into Kenya.

Annah Mwisawa, 34, and Jackson Josephat, 20, were found in possession of the narcotic on Remba island in Suba North sub-county on Tuesday evening.

Administration Police officers patrolling Lake Victoria found the bhang hidden in three sacks.

According to Suba North Deputy AP Commander Elias Wasonga, the officers acted on a tip-off from the public that the suspects were ferrying the drugs using a fishing boat from Tanzania.

Mr Wasonga said the suspects were followed after they tried to evade police officers on the lake.

“The suspects used a fishing boat to mislead the public that they were on a legal trip yet they were not,” said Wasonga.

The Tanzanians managed to travel to Remba island, offloaded the drugs from the boat and hid it in a deserted house to avoid detection.

But police officers, who were hot on their trail, stormed the house, confiscated the narcotics and arrested the two suspects.

Suba North OCPD Charles Mwangi said the suspects and the drugs were transported to Mbita Police Station.

Mr Mwangi said officers were conducting investigations to aid in the arrest of Kenyans who were suspected to be colluding with foreigners to smuggle drugs into the area.

“Any Kenyans colluding with foreigners to undertake illegal business will not be spared.

A 29 year old man has been jailed for two years after pleading guilty to trafficking disabled persons.

Paul Rungi was arrested after he was found with a 12-year-old disabled minor on April 8 in Nairobi’s Mutindwa area. The court heard that members of public had complained about Rungi’s activities which involved taking the minor round the streets in a wheelbarrow begging from well-wishers.

Sometimes the accused would go into hiding then watch from distance as people contributed before showing up to collect the money and vanish.

Rungi was arrested after he left the minor to roast in the sun as he went about his business. In his defence Rungi claimed he was a victim of ‘trafficking’ himself having been lured into the country by a Tanzanian tycoon. He claimed the tycoon promised him a job only to employ him as a wheelbarrow pusher- taking around disabled people to beg for money.

“I urge court to save other disabled children from Tanzania who are within Dandora, undergoing the same problem.”

The prosecution asked court to give him custodial sentence to serve as a lesson and warning to other perpetrators and to be repatriated back to Tanzania.

The trail court ruled: “To serve as a classic example to people who mint money from disabled victims, the accused does not deserve mercy for turning the child who cannot defend himself into slave; I jail him to two years and thereafter be deported.

“Meanwhile, we can have Tanzanian authorities, with the help of accused, locate other victims and arrest perpetrators and the minor to be taken to a rescue center.”
