Juu ya OIC na Mahakama ya Kadhi

Leo najitumbukiza kwenye mjadala wa mahakama ya Kadhi kwa lengo la kuwawekea wazi nini Mahakama ya Kadhi na Hoja ya kuwepokwake nchini Tanzania.

Sijambo la kushangaza kwa watu kupinga Mahakama hiyo iwapo mtazamo tulionao ni kuwa hii itakuwa ni mahakama ya kuhukumu kesi Kiislamu na hivyo kukatana mikono na vichwa. La hasha, maana ya mahakama ya kazi hapa ni kufatilia maamuzi yahusuyo Ndowa na Urithi.

Si kweli kuwa kinachotakiwa hapa kuweko mahakama kama mahakama nyengine zinazoongozwa na sheria zilizotungwa na Bunge.
Hoja ya kuwepo mahakama hiyo inakuja kutokana na kuwajibika kwa Waislamu kufuata walioamrishwa kufanya kuhusiana na Ndoa na Urathi. Waislamu hawana choice kwa hili kwani msingi wa dini yao unasema hivyo. Kuwanyima kile ambacho kitawapa nafuu kwa safari ya baadae ambayo sote mbali na tofauti zetu tunakiamini haitokuwa sahihi.
Ndani ya mahakama zetu tunaamini baadhi ya sheria za Kiislamu lakini mahakimu huwa hawaelewi sheria hizo na misingi yake. Kuondowa tatizo hilo ni kuundwa mahakama za kadhi zitakazoendeshwa na wajuzi wa sheria hizo.
Msururu wa hoja uliotolew kama ni hoja dhaifu za kuundwa kwa Mahakama hiyo sio hoja halisi za kuwepo kwa mahakama hiyo bali nionavyo mimi hoja hizo zinaletwa na Waislamu ili kuonyesha kuwa kuwepo kwa mahakama hiyo hakuna madhara kama Watanzania wengi wanavyofikiri.
Watanzania ni watu wanaoamini Mungu na ni watekelezaji wa maamrisho ya dini zao, hivyo tuwape Waislamu nafasi ya kutekeleza maamrisho ya dini yao.

Unapoandaa kitu kabla hakijapitishwa na organi husika lazima uwe na proposal iliyokwisha andaliwa yani haswa ni nini na kitafanya,kwanini kiwe ndani ya katiba vitu kama hivyo ili organi inapojadili inaangalia contents za ndani.

Mtu huwezi mfano enda sajiri kampuni yako na hiyo kampuni hujasema itafanya nini .Eti wewe inasema nasajiri kampuni ,kampuni gani basi?wewe aaa kampuni tu.Hii haikubaliki.

Hayo uliyoyaandika ni kweli tupu lakini binafsi nasema kwa nini hizo sheria za kiislaam ambazo zinahusiana na ndoa na Mirathi zisiwe sheria kwa watu wote nikiwa na maana kwamba hata mkristu au Pagani ambaye ameoa wake zaidi ya mmoja huyu pia anatakiwa sheria..Sheria za urithi za kiislaam ndizo zinatumika sehemu nyingi sana isipokuwa tofauti kubwa ni fungu la mgao wenyewe baina ya mke na watoto. lakini hata ktk sheria za kawaida hawa Wajomba na mashangazi hawana ruksa kudai mirathi kama inavyotokea sana nchini.

Kinachotokea Tanzania Wajomba na Shangazi kingilia mirathi (baada ya kifo cha mzazi hasa BABA) ni jambo la jadi zaidi ya dini ama sheria. Binafsi nachokitazama hapa ni sheria ambayo itatumika ktk korti zetu hizi hizi bila kuanzisha korti za kadhi kwa sababu hata huyo hakimu wa kadhi hana CV ama elimu fulani ambayo inatambulika na kukubalika ktk sheria za dini..Na hakuna mahala popote ktk hadithi inayosema hakimu Mkristu hawezi kutoa maamuzi ya mirathi kwa ajili ya waislaam hata kama atatumia sheria za kiislaam. Kwa hiyo sioni sababu ya kuwa namahakama nyingine kwa waislaam ambo ndoa zao na hata upatikanai wa watoto wao haukufuata misngi ya dini toka mwanzo..Itakuwa tunahumu wa tu kwa kufuata majina yao badala ya kufuata imani zao. Unajua vizuri kuwa kuoa mke wa pili na hata wa wtatu ni vigumu sana kama sheria itafuatwa...Matatizo mengi yanayotukuta yanatokana na ndoa hizi kufungwa kiholela (kiasili) kwa hiyo kwanza simanisheni ibada ya ndoa kabla hamjahukumu mtu.

Mimi nilichokiona hapa na hasa mada nyingi zinazokuja sasa hivi zzinatokana na watu kukosa tumaini na serikali iliyopo ama Kikwete amekuwa kama ndio beki aliyepwaya hivyo kila mipira inapitia upande wake...
Tanzania ya leo maisha yetu sisi ktk miji yetu hasa baada ya kifo cha baba yetu mlezi (UJAMAA) basi kila mahala unapopatazama watu wanadai mirathi ya mali iliyoachwa.. Kwa bahati mbaya aliyeshika mali hizo ni mjomba na Shangazi yetu (CCM) ambaye anazitumia mali hizo kwa kuedesha falimia yake akiwatupia watoto chenji zilizobakia. Hivyo ktk mahesabu yetu kuna wale walioridhika na chenji hizi na wengine kati yetu ndio hao wanaotaka kujikata wapewe chao ieleweke kwamba hawapo tena ktk urithi... Wanachasahau tu ni kwamba tutagawana umaskini hivyo kuzidi kudidimia zaidi ktk umaskini.
Kinachotakiwa ni sisi watoto yaani Watanzania wa kila rangi iwe dini kabila ama jinsia tuwe pamoja na kuweka matakwa yetu pamoja...UMOJA wetu sisi sote ndio pekee unaoweza kuondoa hawa Wajomba ktk mirathi laa sivyo haya yote ni marudio ya mifarakano ambayo ipo ktk familia za Kiafrika hasa sisi Wadanganyika. Siku mzazi anapokufa ndio utaona kila mtoto akijitokeza kudai haki fulani wakati haikuwa haki yake siku zote za nyuma..
Tanzania imekosa dira hatuna tena mwelekeo..

Duh! mkuu mimi nilidhani umesha zipitia hizo sheria na ndio maana hukubaliani na mahakama ya kadhi kumbe unachotumia hapa ni ushabiki mtupu! Doooooh mkuu wangu noma.. Yaani hadi hapa ume judge kitabu kutokaa na cover lake badala ya kusoma yaliyomo..
Na hii ni hulka ya wengi hasa inapofikia swala la Waislaam.. watu wengi wakisha sikia tu Waislaam basi kitu kinachokuja akilini ni mambo ya Iran na Afghanstan..Wanapinga na watapinga hata kutembelewa na Ahmadinajad ambaye ni rais tu kama marais wengine hatungi wala hana nafasi ktk Uongozi wa dini huko Iran, yet kwa sababu ni muislaam na Marekani wamesha sema ni shetani basi hukumu hiyo inachukuliwa kama ilivyo..Binafsi na imani yangu dhaifu sina hakika nani shetani kati ya huyo na Bush...
 
Jamani mimi sipingi kuanzishwa kwa hii mahakama ya kadhi bali nina maswali mawili matatu kuhusu uanzishwaji wake...!

Kwanza kama mahakama hii itaanzishwa je itakua ni public institution au private institution, hapa namaanisha kwamba watatoa wapi hela za kuiendesha mahakama hii? Je ni kodi za wakristo na waisilamu zitatumika kwenda kulipia uendeshaji wa mahakama hii...? manake sipati picha leo hii eti mkristu asikie kodi yake inatumika kusikilizia talaka za kiislamu....! Hio mimi hainingii akilini....! Swali, je bajeti ua mahakama hii itatoka wapi?

Pili, vipi kuhusu mahakama za kikristo na za kimila? Manake kama ni mambo ya mirathi na ndoa, mambo haya pia huratibiwa na sheria za kimila, vipi tutawafikiriaje pia na watu watakaodai mahakama za kimila, Wamasai wawe na mahakama yao ya kimila, wahehe nao na mahakama yao ya kimila, wanyakyusa na mahakama yao ya kimila, wachaga pia na mahakama yao ya kimila, na wahaya pia wawe na mahakama yao ya kimila kwa ajili ya kusikiliza migogoro yao ya ndoa na mirathi...!

Vipi na wakristu ambao wanafuata Canon law? manake ukisoma Canon law kwa undani kuna makosa ambayo yanapaswa yasikilizwe na mahakama za kikanisa...! Vipi itabidi tuanzishe na mahakama yao sio?

Pili, vipi endapo mtu hataridhika na uamuzi wa mahakama ya kadhi, je ataweza kuruhusiwa kupeleka suala lake mahakama za kawaida? au je vyombo vingine vya serikali vitakua na muingiliano gani na mahakama hii ya Kadhi, kwa mfano polisi, wizara ya sheria, mahakama...?

Mimi sijasoma hizo proposal yani na katiba namna ya kadhi itakavyofanya kazi na kama unayo nirushie hapa. Mimi sipingi KADHI ila ninachopinga hadi mwisho ni KADHI kua ktk katiba ya nchi yetu.

Mkandara tunapopinga hapa usidhani tuna uiadui na waislamu ,nitakupa mfano wangu mimi BABU yangu kama unavyoona maana ya jina alikua chief huko alikokua anaishi na alikua na wake wengi tu wa kutosha na watoto wengi tu zaidi ya 40.Na ktk hao watoto wote wakristu walitokea kua wawili tu.Hivyo mimi ndugu zangu wengi ni waislamu na nimekulia huko na wakati wa Mfungo wa Ramadhani enzi hizo nilikua ni mnyemereaji mzuri sana wa futari na daku yani nilikua nahamia huko.

Ukiona tunapingana hapa usidhani ni chuki wala nini ila ni maslahi ya Taifa letu,Mimi ninapinga mpaka mwisho kua KADHI iwe ndani ya katiba.

Hivi leo mfano wakatoliki wakitaka PENGO atambuliwe na katiba na alipwe fedha na serikali na makao makuu pale ya katolik dsm yaendeshwe na serikali.MTAKUBALI??

Naam, hilo ndilo la kujiuliza! Lakini tukumbuke kuwa lile ni dhehebu la dini ya kikristu. Hivi kuna dhehebu la kiislamu ambalo limepigwa marufuku? Tulikuwa na miaka kumi ya Rais muislamu, kweli nae alishindwa kuhakikisha waislamu wanapewa haki yao? Na sasa tunae mwingine. Bado tu serikali yake inawabana waislamu? Na jee, hivyo vyama vilivyopigwa marufuku bado vipo hai?

Hakuna tatizo kuanzisha mahakama ya Kadhi, tatizo ni isihusihwe na katiba yetu ya Jamhuri kama zilivyo mhakama za dini nyingine, ninaamini kuwa Wahindi wanazo mahakama zao kule Jamatini, lakini hazina makelele ya katiba na wengine tuige huo mfano.

Hatuna haja ya kurushiana maneno ya kidini na the rest of the story, ninaamini kuwa msimamo safi ni wa kuanzishwa kwa hizo makama bila kuihusisha serikali.
 
Siku ambayo wakristu au watu wa dini nyingine yeyote watakapodai Mahakama zao zitakazoingizwa katika mfumo wa serikali, nao nitawapinga kwa nguvu zangu zote! Siku ambayo wakristu watakapodai kuwa katiba ibadilishwe ili ipige marufuku mwanaume yeyote kuoa zaidi ya mke mmoja kwa vile ndivyo imani yao inavyosema, nao nitawapinga kwa nguvu zangu zote.

Mkuu unazidi kujichanganya.. Kilichopigwa marufuku ni chombo cha kuendesha maswala ya dini ya waislaam sio sawa kabisa na kupigwa marufuku imai fulani...Nyerere alikuwa Mkatoliki hivyo yeye alikuwa na sababu zake kuwaondoa Jehova. Kisha mwenyewe umesema Jehova ni dhehebu yaani kwa uchahce wake hali Waislaam kilichondolewa ni chombo cha juu ambacho kinawaunganisha Waislaam wote wakati ukitzama ktk Ukristu ni dhehebu tu ndilo liliondolewa lakini vyombo vya kikristu viliendelea kufanya kazi..

Hivyo sio swala la dhehebu ikiwa kichwa kimeisha katwa kwa maana kama China ama Ueusi walivyofanya kupiga marufuku dini zote!..

Unaposema kwamba wakristu wakomba nao mahakama zao utapinga sana lakini ukweli ni kwamba sheria za mahakama zetu zimetokana na Muingereza ambaye alitumia sheria za Kikristu kusimamisha mahakama tulizokuwa nazo...na ajabu hujapata kujiuliza kwa nini hawa wanasheria wetu hadi leo huvaa majoho na wigi zenye nywele nyeupu (blonde)...

Mkuu kama alivyosema Field Marshall Es, hakuna haja ya kwenda huko maanake haiwezi kutusaidia kitu isipokuwa kutuvuruga zaidi, tuwatazame wahusika nao ni waislaam na jinsi mahakama hizi zitakavyoweza kuwasaidia ama kuwaumbua pasipo kuwapatia haki kulingana na mila na tamaduni zetu.

Na sikubali maneno ya FMES anapodai katiba isihusishwe wakati anajua fika kwamba ni katiba hivyo hivyo kutokana na vifungu vya sheria (kama alivyoorodhesha Mkuu Sanda) ndiyo iliyoifunga mahakama ya kadhi.
 
Hii sasa naona ni dini mtindo moja.

Bila shaka umenisoma vizuri maanake ndicho nilichokiona toka mwanzo na kuna watu walikuja juu niliposema mawazo mengi yanapinga/Kuunga kwa kutazama rangi zao.. sikuwa mbali na ukweli huo..

Sasa kwa sababu hawakutaka kunielewa nimejaribu kwenda na sauti zao wenyewe, yaani kutazama vizuri kilitokea nini jambo ambalo binafsi sikuona umuhimu wake..

lakini kama kweli tutachukua mkondo huo basi mahakama ya kadhi wanaweza kushinda kwa sababu ni sheria iliyovunja chombo kilichokuwa kikiendesha mahakama hiyo..Kama vile ukivunja CCM basi bila shaka Azimio la Zanzibar nalo linaweza kupigwa marufuku kabisa!...

Kwa mtazamo wa viongozi wataona wameonewa lakini mimi nikitazama umuhimu wa Azimio hilo kwa wananchi wake naona kama ni shinikizo la nguvu kuwapa hawa Wajomba kuchukua mirathi yetu.

Hivyo hivyo nikitazama mahakama ya kadhi ktk ndoa na mirathi ni mahakama inayotaka kutuvuruga zaidi...

Vitu vinavyopiganiwa vipo wazi kabisa, kinachotakiwa ni kutungiwa sheria kwa kuzingatia right za victims. Hakuna kitu tofauti mahakama ya kadhi inaweza kufanya zaidi ya kuwapa haki victims wa ndoa zetu ama watoto ktk mirathi...lakini ili mahakama yoyote iweze kufanya kazi kwa ufasaha ni lazima ziwepo sheria tangulizi ambazo kama zikivunjwa ndipo mahakama inaweza kutoa hukumu ya haki.. hadi sasa hivi tunavyozungumza kila mtu anapuyanga tu ktk ndoa na mirathi hakuna sheria sii Masheikh wenyewe wala waumini wa dini hii tena kwa ufasaha wa lugha niseme dini zote nchini Tanzania hatufanyi ibada hizo...

Ibada ni kufunga ndoa na kuzaa watoto ktk kanuni za dini toka tunapohalalisha vitendo vya ndoa na kuzaa, ikiwa nje ya hapo hakuna sheria ya kuwahukumu kwani hakuna haramu na wala sii kweli kuwa mahakama ya kadhi ni ibada ya kiislaam.
 
Kuna muungwana aliuliza nani atafinance hii mahakama, nadhani hilo ni swali muhimu

linalostahili majibu.

Mkuu swala la ku finance halina uzito kabisa yaani ndio tutajiweka mtegoni zaidi.. Wakisema wata finance wenyewe mtakubali?..je mtakubali kwa sababu wanaohusika ni waislaam sio nyie au ndio mahakama hii itakuwa na umuhimu..Mkuu nazidi kusisitiza watazame wananchi hao waislaam wanaishi ktk mazingira gani na kama kweli mahakama hii inawafaa badala ya kutazama maswala ya fedha..

Mkuu hata Zanzibar kujiunga na nchi nyingine za Kiislaam ilikuwa ni swala zito zaidi ya kutazama ama kuitisha nani ata finance maanake hawa jamaa fedha sio tatizo kabisa, fe4dha wanayo.. na kama tungejitia kidole cha macho kuuliza nani ange finance kujiunga na OIC mkuu ungeona mikono kibao...Tena basi wangeweza ku finance nchi nzima kuwa mwanachama lakini je hilo ndilo tunalihitaji?.. narudi pale pale tazama WATU na MAZINGIRA yao kabla hujatoa maamuzi.

Kinachogomba hapa ni kuingiza kila mtu katika mambo yasiyowahusu.
 
Mainly on account of the leading role of the Catholic president Julius Nyerere several Western researchers have underestimated the importance of the Moslems in shaping the Tanzanian socialism in the 1960's. Because of the Christians having better access to higher education they became overrepresented in the administration. But Moslems constituted a majority in TANU, called CCM (Chama cha Mapinduzi = The Revolutionary Party) after the 1977 merger with its sister party ASP (Afro-Shirazi Party) on Zanzibar. After the introduction of the one-party system, CCM was the major political factor in societal change. The socialism of Tanzania has many similarities with Islamic Socialism, and especially Nasserism influenced many Moslems in Tanzania.

The few Moslems who turned against the socialist politics were mostly of Asian origin. Some of the Moslem resistance was in the beginning channeled through the East African Muslim Welfare Society (EAMWS). It was founded in Mombasa in 1945 by the then Aga Khan with the aim of promoting Islam and raising the standard of living for the East African Moslems. Asian Shiites, especially Ismaili, dominated and financed the organisation, but Aga Khan recommended that all Moslems regard EAMWS as an organization with pan-Islamic ambitions. When its headquarters were moved from Mombasa to Daressalaam in 1961, the Nyamwezi chief and TANU opponent Abdallah Fundikira, regarded as Nyerere's principal political rival in the 60's, became the president of the organization. EAMWS concentrated on building schools and mosques, providing scholarships and spreading literature. There were also plans for founding an Islamic university in Zanzibar or Mombasa, but they were never realized. However, the Muslim Academy founded in Zanzibar in early 50s continued to exist as a training college for teachers of Arabic and Islamic education until it was closed down by the autonomous Revolutionary Government of Zanzibar in 1966. In regard to this it is interesting to note that Zanzibar has several times since January 1993 announced plans for a separate Islamic university and high schools connected to the University of Daressalaam; and since the middle of the 70s the Muslim Academy has been reopened, a new Muslim Secondary School has been built and Arabic has been adopted as the third official language of Zanzibar.

Because of the pan-Islamic tendencies and the capitalist oriented leadership of EAMWS, pro-TANU Moslems opposed it. The organization, it was claimed, constituted a threat to the ruling party. The antagonism culminated in 1968, when the organization was declared illegal in Tanzania. Other Moslem organizations were dissolved as well. Instead the pro-TANU Moslems, with several leading Qadiriyya sheikhs playing important roles, formed with the support of TANU the new national organization Baraza Kuu la Waislam wa Tanzania (Tanzania Muslim Council), BAKWATA, whose constitution was in large parts a copy of the TANU constitution. Because of the close connection to the ruling party and many leading Moslem politicians' interference in BAKWATA's activities, the role of the organization has been controversial. Its achievements have been limited due to poor finances. Criticism against BAKWATA increased during the 1980's, when the opposition to the socialist politics of Tanzania grew and liberalization started.

Under internal Moslem pressure and international Islamic tendencies BAKWATA has lately become somewhat more profiled. The organization has arranged lectures on Islam in different parts of the country and in 1987 it called on the government to reinstall the system of Moslem courts that existed in colonial and post-colonial times. With the increased profile international Islamic contacts are on the rise. Some Arab countries have financed new mosques, schools, scholarships, dispensaries and provided teachers to the newly established schools.

The question of schools and Islamic education has for a long time been Tanzanian Moslems' main issue. They had few equivalents to the mission schools whose activities not only spread Christianity but also led to a higher educational level among Christians. The decision by the TANU government to nationalize the schools in 1969 was therefore warmly welcomed by the Moslems. The Islamic schools which have been founded lately in a political climate more favorable to private initiatives, for example Kunduchi Islamic High School, seem to have an uneven standard but constitute an interesting development for the Moslems of Tanzania.

The proposal to reinstate separate Moslem courts is very controversial. Under the slogan "Don't mix religion with politics!" the governments of Tanzania have endeavored to "privatize" Islam or marginalize the effects of Islamic law. An example of religious conflicts involving legal matters is the discussions about a government proposal to a new marriage law which was presented in 1967. The implementation of the law in 1971 was preceded by two years of intense discussions particularly regarding the position of sharia in the judicial system of the country were debated.

Before 1971 Moslems, as well as Christians and Hindus, followed their own marriage and divorce laws. Traditional judiciary systems of the different ethnic groups practising customary law were also in force. In addition, one could marry monogamously in a civil marriage. To counteract religious and ethnic exclusivism in favour of increased national consciousness, the government presented its aim in its 1969 White Book to create more uniformity in the sphere of family laws. The other important aim was to improve the position of the woman. One of the tangible proposals was that the minimum marital age for boys was to be eighteen and for girls fifteen. The fifteen-year limit for girls was presented with reference to UN recommendations. According to sharia puberty decides when a girl is marriageable.

The proposal that caused the most serious debate was the idea that a man who wanted to marry a second wife had to get permission from his first wife. The proposal that would forbid men to punish their wives corporally was also met with some resistance as well as the installation of an obligatory reconciliation agency for couples on the verge of divorce. If the agency failed to reconcile the parties concerned the husband in a Moslem marriage would legally be able to pronounce the divorce formula talaka (Ar. talaq).

Many Moslems who were taking part in the discussions opposed the idea of creating a more unified marriage law, especially where the proposed marriage law was in conflict with sharia. Since family laws are a central part of the Islamic law, any change which does not conform to them is particularly sensitive and controversial. Despite the criticism from the Moslems the government's proposed law was passed in 1971 with only minor changes.

The proposals of BAKWATA in 1987 to reinstate separate Islamic courts is only one example which demonstrates that the question of the position of sharia in Tanzania is still a burning issue. In 1988 Sofia Kawawa, leader of the Tanzania Women's Union, UWT, (Umoja wa Wanawake wa Tanzania, closely affiliated to CCM), came under fire after having publicly criticized Islamic rules that she felt were oppressive to women. According to Sofia Kawawa polygyny should be forbidden and women should have the same right of inheritance as men. Her statements caused protest and some riots. A group of young Moslems wrote an open letter which demanded that the secular regime refrain from interfering with religious matters. In Zanzibar two men died in the riots against the leader of the UWT. The Moslem president Ali Hassan Mwinyi, who a few years earlier had succeeded the Catholic Nyerere, hurried to explain that Kawawa had expressed her personal views and not the views of CCM or the government. Mwinyi saw no need to change the law, while Kawawa and other Moslem women continued to argue against certain Islamic laws. In some of her statements in 1990 Kawawa provocatively claimed that polygyny helped to spread AIDS.

In questions concerning for example polygyny, Moslem critics like Kawawa have gained some support from the Christian quarter. Christian criticism is, to some degree however, part of a wider propaganda campaign against Islam. It may be noted that many Christian men, especially outside the circles of leadership, actually have defended polygyny, albeit with reference to traditional African culture rather than to Christian belief. This was especially obvious during the parliamentary debates preceding the law changes in 1971. Many Christian men and women also support female circumcision which is practised rather widely, even by fourth or fifth generation Christians, and which is forbidden in law; but nobody talks about it. Female circumcision does not exist among Tanzanian Moslems other than those of Somali origin, and a mild form of it is secretly practised among the few Asian Shia Bohra.

Mmoja wa waanzilishi na financiers wake wakuu alikuwa Aga Khan, kiongozi wa wa Ismailia ( ambao wengi wenu hata hamuwakubali kuwa ni waislamu). Hiki chama kilionekana na baadhi yenu kuwa kinalinda maslahi ya wahindi na waarabu badala ya waswahili. Ukizingatia wakati ule wa mapambano ya kugombea uhuru wa Afrika , hii ilikuwa sababu tosha ya kukipiga marufuku. Hiki chama hakikupigwa marufuku kwa vile kilikuwa kinatetea maslahi ya waislamu bali kutokana na hofu ya kujiingiza katika Siasa. Kwa vile kilikuwa ni chama na mmoja wa viongzi wake wa mwanzo alikuwa Abdallah Fundikira, kwa nini basi hakukirudisha wakati wa Mwinyi? Ukweli ni kwamba nia yake ilikuwa political na sio social kama ambavyo mngetaka kutudanganya. Muasisi wake Aga khan mbona ameachiwa kuendesha mashule, mahospitali hadi sasa bila kubughudhiwa? Kwa nini nae asifufue EAMWS? Hivi kama mtu akitaka kuanzisha wing ya Al Qaeda nchini na serikali ikaipinga, mtasema wanafanya hivyo kutokana na kutokupenda uislamu? Au mtu akitaka kuanzisha Ku Klux Klan (kuna wakina the Truth humu) Tanzania akubaliwe tu ati kwa sababu ya uhuru wa kuabudu?

Mashahidi wa Jehova vile vile walipigwa marufuku kutokana na hisia kuwa wanafuata maagizo kutoka nje (wengi wao walitokea malawi ambayo ilikuwa katika malumbano na Tanzania) ambayo yanapingana na kile kilichoonekana uzalendo (k.m. walikuwa wakikataa kupiga saluti kwa bendera na kueleza wazi kuwa utii wao ulikuwa zaidi kwa Mungu na si kwa serikali). Hawa wameweza kurudi kwa vile ni dhehebu na tofauti zao ingawa zilionekana ni za kisiasa wakati ule zilikuja kuonekana ni za imani tu. Hawakuwa na agenda ya kuwa politicised.

Mimi ninapinga kuanzishwa kwa hayo mahakama kikatiba kwa vile itaondolea uhuru serikali kuzidhibiti kama zitaonekana zinapingana na katiba yetu wote. Itakuwa ni kuwafungulia mlango extremists kutoka dini zote kuweza kupenyeza agenda zao ambazo zitatuletea matatizo kibao.

Tatizo ni kuwa hata hao Waislamu ni binaadamu hutokea wakatofautiana. Iwapo hili litakuwa na nguvu za Serikali maamuzi yake yatatambulika na kuheshimiwa na migogoro itafuata taratibu zinazotambulika.
