Hatimaye ANBEM imewekwa wazi kwamba imo ndani ya Kiwira Coal power Project na wala siyo kupitia kwa mtoto Nico bali ni kupitia kampuni na Mr and Mrs BWM, almaarufu kama ANBEM. Mwaka huu ThisDay wameamua kula sambamba na BWM mpaka kieleweke. Lakini kwa utaratibu wa wanasiasa wa Bongo hakiwezi kueleweka maana tangu makombora yameanza kuelekezwa kwake, jamaa ameamua kubaki kimya huku tuhuma lukuki zikiendelea kumuandama na hana ubavu wa kuzijibu maana hana jukwaa la kujibia wala kinga ya kuzuia mashambulizi.

Kiwira coal power project shares: ANBEM Ltd name crops up once again

THE private company ANBEM Limited that former president Benjamin Mkapa and first lady Anna Mkapa registered in 1999 while still at State House, is a listed shareholder in the still-pending but already-controversial $271.8m (approx. 340bn/-) Kiwira coal-fired power project, THISDAY can reveal today.

It has been undeniably verified that ANBEM Ltd holds shares in the Kiwira Coal and Power Limited company under the umbrella of Tanpower Resources Company Limited, the majority shareholder in the firm overseeing the project in Mbeya Region.

Tanpower is now understood to own up to 85 per cent of the shares in Kiwira Coal and Power Limited, with the remaining 15 per cent shares being formally held by the Tanzanian government.

According to THISDAY findings, the shares owned by ANBEM Limited in the Kiwira project company are separate from those held by Mr and Mrs Mkapa’s son, Nicholas Mkapa, whose own shares in the same company are under the name of Fosnik Enterprises Limited.

This means that the former president and at least two members of his immediate family each own shares in the power company that is reported to have entered into an increasingly-questionable contract with the Tanzania Electric Supply Company Limited (TANESCO) for the supply of 200 megawatts of electricity into the national power grid.

The junior Mkapa also serves on the Kiwira Coal and Power Limited board of directors.

Well-placed sources privy to the contract details have already disclosed that at least one ’big hand’ in the third phase government was responsible for exerting more pressure than was necessary for TANESCO officials to enter into the contract with the Kiwira investors.

It has been strongly hinted that the pressure on the state-run power utility firm TANESCO was applied via the ministry of energy and minerals.

And according to our sources, signs of supposedly serious discrepancies in the contract signed in March last year have begun to emerge as delays continue to hamper the start of actual implementation of the project.

It has lately been made apparent that the content details of the official 20-year power purchase agreement (PPA) signed by the three parties to the contract � the government, TANESCO, and Kiwira Coal and Power Limited � give the owners of the private company enough discretion to calculate future power tariffs at will - based on their own computations of final construction and production costs.

This, say our sources, could very well lead to a fall-out even worse than the infamous Independent Power Tanzania Limited (IPTL) affair of 1995, for which TANESCO is still forced to pay through its nose. They state that according to the terms of the PPA, Kiwira Coal Power Ltd would be allowed to periodically adjust upwards some of its key charges based on its operational costs and the future price of coal. According to the sources, TANESCO could well end up having to pay Kiwira Coal Power Limited � being owners of both the coal mine and power plant - a staggering $6m (approx. 8bn/-) each month once the firm starts delivering.

This would bring TANESCO�s monthly obligations to three independent power producers (IPTL, Songas and Kiwira) to a figure exceeding $20m (approx. 26bn/-) - which is well beyond the estimated $19.35m (around 25bn/-) per month that TANESCO currently earns from its revenues.

Regarding ANBEM Limited, THISDAY has already established through its inquiries that apart from being set up by Mr and Mrs Mkapa while still at State House, the company also operated from a registered office within the official Ikulu walls in Dar es Salaam from 1999 to 2005, when Mr Mkapa retired from the presidency.

Documents setting up ANBEM Limited in 1999 listed its physical address as Plot Number 15, Luthuli Road � which is a government building forming part of the Ikulu estate, allocated for use as the official office of all sitting first ladies.

It was from these offices that ANBEM Limited is understood to have conducted its private business activities, including, among other things, the purchase of shares in the Kiwira company.

ANBEM Limited, with Mr and Mrs Mkapa as sole shareholders, was also the beneficiary in 2002 of hefty loans amounting to $500,000 (approx. 620m/-) from the National Bank of Commerce Limited and 250m/- from CRDB Bank respectively. Both loans have since been cleared.

THISDAY has sent written questions to Mr Mkapa’s office in Dar es Salaam regarding the nature of the business transactions conducted by ANBEM Limited. No response has been forthcoming so far.

Nigeria blocks huge clinic deal

Nigerian President Umaru Yar'Adua has ordered the suspension of a multi-million dollar contract awarded by his predecessor Olusegun Obasanjo.
The 18bn naira ($145m) contract to build health clinics across the country was awarded to a company believed to be owned by a former aide to Mr Obasanjo.

"It was an illegal contract," Mr Yar'Adua's spokesman told the BBC.

Last month, Mr Yar'Adua reversed the controversial sale of two refineries to a business group linked to Mr Obasanjo.

Nigeria is seen as one of the world's most corrupt countries - an image both Mr Obasanjo and Mr Yar'Adua have pledged to end.

The contract, awarded last year, was to build a primary healthcare centre in each of Nigeria's 774 local council areas.

The contract was funded by compulsory deductions from each of the local councils' share of monthly oil revenue.

"There's no law backing it. It was being funded with illegal local government funds," President Yar'Adua's spokesman Olusegun Adeniyi told the BBC News website

This is the second time in less than three weeks that President Yar'Adua would be reversing a major decision taken by his predecessor and political benefactor.

Mr Adeniyi denied that President Yar'Adua was trying to prove his independence from his predecessor, who had been instrumental in his landslide win in last April's presidential polls.

"For President Yar'Adua, everything is about the rule of law and this contract was found to be illegal," Mr Adeniyi said.
