Wenye uzoefu wa magari wanajua inafika mahali linaharibika sehemu nyingi kiasi kwamba halifai kutengeneza tena, ni la kubadilisha. Hii serikali imefika mahali kama hapo. Kila unaposhika unakuta pameoza. Si ya kukarabati, ni ya kubadilisha.

Tuige Ghana. Chama kinachoingia madarakani huko Ghana sasa kilikuwa chama tawala siku za nyuma, kikawekwa benji, na sasa kimeahidi hakitafanya makosa makubwa kwani kilijifunza mengi wakati kikiwa benji.

Kama Watanzania hawataiweka CCM upinzani mwaka kesho, basi wakubali kuendalea na hivi viini macho vya kila siku.

Wamiliki wa mgodi huo akina Mkapa na Yona walijiuzia mgodi huo katika mazingira ya kutatanisha na ya kifisadi na si ajabu hakuna mkataba wowote, kama upo basi serikali iuweke hadharani ili tuyafahamu yaliyomo katika mkataba huo na pia kujua ni akina nani waliosaini kwa niaba ya serikali. Maana walichofanya Mkapa na Yona ni wizi mtupu tena wa mchana kweupeee!

Pia itakuwa vizuri mkataba kati ya TANESCO na akina Mkapa, Yona na Kampuni yao wenye gharama za shilingi 340 billioni ukawekwa hadharani ili pia tujue yaliyomo katika mkataba huo na wale waliosaini kwa niaba ya TANESCO.

THE controversial privatization of the formerly state-owned Kiwira coal mine in Mbeya Region is back in the spotlight, with the government now scheduled to issue its much-awaited statement in Parliament on the circumstances behind it next week.

Former president Benjamin Mkapa and ex-energy and minerals minister Daniel Yona have both been heavily implicated in allegations of abuse of public office and conflict of interest in their dubious involvement in the 2005 Kiwira mine privatization.

According to the official programme of the latest National Assembly session that began yesterday, the current Minister for Energy and Minerals, William Ngeleja, is expected to read his parliamentary statement outlining the government’s official position on the mine’s privatization process on Friday, February 6.

And according to parliamentary sources, there is every likelihood that the contents of Ngeleja’s statement on how the lucrative mine was actually privatized could trigger a strong debate within the House, mainly surrounding the ethical implications of Mkapa and Yona’s well-documented involvement in the process in their capacities as then president and then minerals minister respectively.

All this comes against the backdrop of a series of paid newspaper adverts and carefully-worded opinion-editorial (op-ed) articles that have recently appeared in some sections of the local media, apparently trying to justify the ’Mkapa-Yona-families’ connection to the deal.

One well-placed parliamentary source told THISDAY: ’’It should be quite interesting to hear what Ngeleja has to say about the matter, especially in the light of the recent spate of public statements by various politicians, public figures, and even members of the clergy in outright defence of Mkapa’s record ahead of this particular parliamentary session.’’

The government’s anti-graft watchdog, the Prevention and Combating of Corruption Bureau (PCCB), has already stated categorically that it cannot and will not investigate the ex-president, apparently basing its position on his perceived immunity from such investigation and possible prosecution as outlined in the current national Constitution.

Again, this has also raised much public debate on whether or not Parliament should vote to strip Mkapa of this perceived immunity, to pave the way for the official investigations into the serious allegations against him to go ahead.

And again according to our parliamentary sources, legislators appear to be somewhat divided over the prospect of voting ’Yes’ or ’No’ in such a situation.

’’Most of the MPs support the war on corruption, and believe that each and every individual involved in the vice should face criminal charges regardless of previous or current position in government, provided there is ample evidence against that individual,’’ said another parliamentary source.

’’But there are a few legislators who seem to think that former heads of state should be allowed to retire in peace, regardless of whatever crimes they may have committed while in office,’’ the source added.

As already established by previous THISDAY findings, the origins of the Kiwira mine deal date back to 1999, when then president Mkapa and first lady Anna Mkapa registered a private business company, ANBEM Limited, with themselves as sole directors.

ANBEM Ltd listed State House as its official address, and operated from within the official Ikulu walls; factors that have led many observers to conclude that this clearly constituted an abuse of the presidency as a public service position.

In 2004, Mkapa as president teamed up with Yona, then minister responsible for amongst other things minerals, along with various members of their respective immediate families, to form a joint venture private company, TANPOWER Resources Limited.

Among other things, TANPOWER Resources was licensed to ’’deal with coal mining in order to generate electricity for consumption and sale; to generate power generators, transmitters and general distributors; and to provide power and general projects management, project appraisers and consultants.’’

A few months later, the Kiwira coal mine privatization process commenced in earnest, under the direct supervision of the then minister in charge of minerals in the Mkapa administration (Yona).

And following a remarkable ’fast-track’ procedure, the mine was eventually sold to TANPOWER Resources for a mere 700m/-; far less than the 4bn/- incurred by the government to build the mine in the 1980s.

It has also come to light that throughout this particular privatization process, neither Mkapa (as president) nor Yona (as supervising minister) ever publicly declared their interests in TANPOWER Resources.

Well-placed government officials have since confirmed to THISDAY that, since the Kiwira coal mine privatization process was openly hijacked from the now-defunct Presidential Parastatal Sector Reform Commission (PSRC), no public tender or auction was ever held. This leaves it unclear how TANPOWER Resources was eventually picked as the choice private company to buy majority shares in such a well-established government entity.

’’The Kiwira coal mine was simply handed on a silver platter to TANPOWER Resources,’’ concluded one government official familiar with the matter. It is now up to Ngeleja to shed more light on the matter for the sake of public record.

ALLEGATIONS of corruption and abuse of public office related to the Kiwira Coal Mine privatization process in which ex-president Benjamin Mkapa and ex-energy and minerals minister Daniel Yona were heavily involved are now under official investigation, a new government report has confirmed.

The report compiled by the Prime Minister’s Office (PMO), detailing progress made in the implementation of various government pledges made in Parliament during 2007/08, makes it clear that the highly-dubious 2005 Kiwira mine deal is indeed being formally probed.

This appears to contradict a recent public statement by the state-run Prevention and Combating of Corruption Bureau (PCCB), which in effect said the Government’s anti-graft watchdog was not investigating the ex-president.

According to the new 402-page Government report released to members of the National Assembly currently sitting in Dodoma, various allegations surrounding major contract and procurement deals and misappropriated public funds are being ’’worked on.’’

On the allegations of abuse of office in the Kiwira contract, the report states that ’’investigations into the running of the Kiwira Coal Mine in Mbeya are ongoing.’’

Officials familiar with the issue say Government investigators have already accessed some crucial documents linking both Mkapa and Yona to the Kiwira deal.

And according to THISDAY’s own latest findings, anti-corruption investigators have also inspected company records of ANBEM Limited, the private company formed by Mkapa and former first lady Anna Mkapa in 1999 when both were at State House.

The presidential mining review committee chaired by Judge Mark Bomani also scrutinized the Kiwira deal and recommended in its final report that a formal investigation ought to be launched.

Incumbent Energy and Minerals Minister William Ngeleja is this week due to issue the Government’s much-awaited formal parliamentary statement on the circumstances behind the Kiwira mine privatization issue.

Ngeleja’s highly-anticipated statement is a follow-up of instructions first given by the Prime Minister, Mizengo Pinda, in Parliament last year in the wake of a growing chorus of calls from both ruling CCM and opposition MPs for the Government to end its silence over the burning issue.

According to our own parliamentary sources, the contents of the minister’s expected statement on how the lucrative mine was actually privatized is likely to trigger a strong debate within the House on, amongst other things, the ethical implications of Mkapa and Yona’s well-documented involvement in the process in their capacities as then president and then minerals minister respectively.

Some senior Government officials have already gone on record as seeking to pour cold water on the public curiosity surrounding the issue at hand through claims that the Kiwira coal mine was at the time of its sale a ’dead animal’ already in a state of bankruptcy.

But according to mainstream observers from the general public domain, this line of argument amounts to literally miss the point on why the deal is considered so controversial.

It has also come to light that throughout this particular privatization process, neither Mkapa (as president) nor Yona (as supervising minister) ever publicly declared their interests in TANPOWER Resources Limited, the private company that ended up securing a majority stake in the hitherto state-run mine.

Well-placed Government sources have since confirmed to THISDAY that, since the Kiwira coal mine privatization process was openly hijacked from the now-defunct Presidential Parastatal Sector Reform Commission (PSRC), no public tender or auction was ever held.

The privatized Kiwira Coal and Power Company later went on to sign a dubious $271m power purchase agreement with the state-run Tanzania Electric Supply Company Limited (TANESCO), but has yet to start providing the promised 200 megawatts of electricity to the national power grid.

Sijui ni nani watakaokuwa katika timu hiyo ya uchunguzi wa Deal ya Kiwira na watapewa muda gani kukamilisha huo uchunguzi wao. Nasema hivi kwa sababu kama mtakumbuka timu iliyoongozwa na Hosea kutoka PCCB ambayo ilipewa kazi ya kuchunguza mkataba wa Richmond walitoa ripoti ambayo ilidai mkataba huo haukuwa na ufisadi wowote kinyume na ripoti ya timu ya Mwakyembe ambayo ilisababisha Lowassa na Msabaha wajiuzulu.
 
Yote ya kurekebisha makosa na kurejesha mali iliyobiwa kwa hila na watu tuliowaamini na kuwapa madaraka inawezekana. Kinachokosekana ni utashi wa kufanya hivyo!

Ndio maana huwezi amini hata mwanasheria mkongwe anakuambia kuwa "Mkapa" hana kosa kisheria! sijui hata alishindanishwa na nani katika kukwapua hayo machimbo.

EDITORIAL: The investigation of Kiwira boosts transparency and good governance

TANZANIANS should be sighing their relief now that the divestiture of Kiwira Coal Mine, and its latest investor TanPower (T) Limited, are officially under the spotlight.

The sell-off of the multi-billion state enterprise from the National Development Corporation (NDC) to a private company left Tanzanians sceptical albeit unanswered questions over the way the process was fast tracked.

We should commend the Parliamentary Committee on Energy and Minerals and the Government for the quest for truth about this issue. The move indeed, assures the public that nobody is above the law.

It is now an open secret that the acquirers of Kiwira were a company comprising family members and friends of former president Benjamin Mkapa.

At this point, one should appreciate the courtesy of the JK Government, and especially the agility with which it has manoeuvred between politics, national interests and the electorate in the course of the investigation.

While the public find the Kiwira probe reassuring, the investigation by itself repudiates President Kikwete's statement: ’’Let Mzee Mkapa rest in peace.’’

How can the old man relax when the legislators want to leave no stone unturned at a place where his stakes are? JK had done his best to shield his predecessor but, under the Constitution, nobody is above the law!

We regard the probe as extension of the war on sleaze and misuse of power in this country. We dare say that this war has won the hearts of many Tanzanians. The fact that a number of fraudsters and those who abused their official trust are being lined up to answer charges in court, amply exhibits that the Kikwete Government has long crossed the Rubicon.

The Government has availed a 420-page report to Members of Parliament in Dodoma on the allegations of abuse of office with regard to the Kiwira mine contract. Only a daydreamer would see the Fourth Phase Government as weak and that it could not embark on a deep-rooted cultural revolution to stamp out corruption within the party and the Government.

Compatriots who have followed the development, and steady approach of the JK Government in the execution of its set-out strategies, should relax with satisfaction. JK is on the right track, and certainly, the war on sleaze is progressing well.

As a nation we should fully back up the Government’s bold move to allow investigators to access some crucial documents, linking both Mkapa and his energy minister Daniel Yona to the Kiwira deal. And also for scanning through company records of ANBEM Limited, a private company set up by Mkapa and former first lady Anna Mkapa in 1999 when both were tenants of State House.

Being true believers of the rule of law, we regard Mr Mkapa to be innocent in the Kiwira deal, until the court of law proves otherwise. At the same time, we urge all Tanzanians to fall behind JK in waging the war on corruption in order to restore the good image of our nation.

SERIKALI imesema imejiandaa kuanika ukweli na hatima ya mgodi wa mawe wa Kiwira, wakati wowote kuanzia sasa kwa maslahi ya taifa.

Akitoa taarifa ya serikali kwa waandishi wa habari ofisini kwake Dar es Salaam jana kuhusu kuuzwa kwa asilimia 75 za kampuni ya Williamson Diamond, Waziri wa Nishati na Madini, William Ngeleja, alisema serikali imekamilisha kukusanya taarifa za mgodi huo ambao majibu yake yanasubiriwa na Watanzania wengi.

"Napenda kuwaambia kwamba kila kitu juu ya mgodi huu kimekamilika, ni matumaini yangu kwamba wakati wowote kuanzia sasa tutaanika ukweli na hatima ya mgodi huu ambao umezua mambo mengi katika siku hivi karibuni," alisema Waziri Ngeleja.

"Hatuna sababu ya kuchelewesha suala hili, tuko tayari kufafanua mambo yote yaliyofanyika na yale ambayo tunaona yana faida kwa taifa katika siku zijazo," alisema Waziri Ngeleja.

Serikali haitakaa kimya kwani katika mkutano wa 14 wa Bunge uliomalizika wiki iliyopita mjini Dodoma, suala hili lilikuwa limewekwa kwenye orodha ya kujadiliwa lakini ilishindikana kutokana na muda.

"Baada ya suala hili kutojadiliwa bungeni, watu wanaweza kusema tumeingia ‘mitini'…nasema ndugu zangu hapana…tupo pamoja kwa nia ya kujenga taifa letu," alisema Ngeleja.

Katika hatua nyingine, Ngeleja alisema serikali imeridhia uuzaji wa asilimia 75 za kampuni ya Williamson Daimonds Limited zilizokuwa zinamilikiwa na kampuni ya Willcroft Limited.

Alisema baada ya uchunguzi wa kina kufanyika, serikali imeridhia kuuza kiasi hicho kwa kampuni ya Petra Diamond ambayo iliingia mkataba wa kununua kampuni ya Willcoft Limited.

"Baada ya kupokea ushauri wa kamati ya wataalamu wa kisekta ya serikali na ule wa kamati ya ushauri ya Jaji Mark Bomani na kujiridhisha kuwa mbia, Petra Diamond ina uwezo wa kuendesha mgodi wa almasi, serikali imeona kampuni hiyo haina kikwazo, hivyo kukabidhiwa mgodi," alisema Ngeleja.

Masharti yaliyowekwa na serikali ni pamoja na Petra Diamond itambue mikataba iliyopo kati ya serikali na Willcroft na kuendeleza majadiliano ya kurekebisha hali ya mgodi huo ili uweze kuleta manufaa zaidi kwa taifa.

Alisema serikali itaendelea na majadiliano na mbia wake huyo kupitia upya mkataba wa wanahisa ili uendane na wakati uliopo kwa manufaa ya pande zote.

"Majadiliano yatahusu pia mradi wa upanuzi wa shughuli za uzalishaji wa almasi ili mgodi uweze kuzalisha kati ya karati 500,000 na 1,000,000 kwa mwaka badala ya 200,000 zinazozalishwa hivi sasa," alisema Ngeleja.

Serikali itahakikisha maslahi ya wafanyakazi wa mgodi huo yanalindwa na Petra itaendeleza miradi na huduma za kijamii zilizokuwa zinatolewa na kampuni ya De Beers na mradi wa Mwadui Community Diamonds Partenership (MCDP), unaohusu kuwaendeleza wachimbaji wadogo wa eneo la Mwadui.
