Kiwira power to feed into National Grid

MBEYA's Kiwira Coal Mines and Power Company will in the next three months start feeding 200 megawatts of electricity into the National Grid.

The Kiwira Coal Mines and Power Company Managing Director, Mr. Evans Mapundi told the Local Investment forum here on Tuesday that Chinese experts were working hard to rehabilitate and expand the power plant to supply 200 megawatts from the current six watts.

He said installation of the power transmission line from the plant situated at the border of Kyela, Ileje and Rungwe districts to the national grid along the Uyole Ibanda highway will be completed towards the end of next month.

Mr, Mapundi said Tanzania could do away with unreliable hydro electric power by improving the infrastructure of the Chunya and Mchuchuma which together with Kiwira have abundant deposits of coal.

Mr. Mapundi appealed to Mbeya business community to immediately start planning for investment projects saying, local investors were more beneficial to the national economy compared to foreign investors who expatriated profits.

Tanzania Electric Supply Company (TANESCO) power distribution manager, Mr. Method Byabato assured the investors of steady electric supply saying of the 623 megawatts required countrywide, Mbeya needed only 26 Megawatts.

He said the current power supply in the country stood at 1.006m megawatts from various sources such as Kihansi, Mtera and Kidatu hydro power plants, the Independent Power Tanzania Limited (IPTL) and other private suppliers like the SONGAS and Kiwira Coal Mines and Power company.

He said since TANESCO's transformation from a service oriented institution to a business entity, all power applications were dealt with within a month.

The forum was chaired by the Mbeya Regional Commissioner, John Mwakipesile who challenged the local business community to utilise available resources to change Mbeya's economic status.

-PCCB boss fails to make himself clear Says he’s ’not prepared to defy his boss’

THE government’s anti-corruption watchdog has said it cannot investigate any allegations of wrongdoing against former president Benjamin Mkapa because that would be going against public statements made by incumbent President Jakaya Kikwete.

According to Prevention and Combating of Corruption Bureau (PCCB) Director-General Edward Hosea, the president has already made a declaration on the matter and he (Hosea) is not prepared to defy his boss.

’’The president (Kikwete) has authority over me. Therefore, whatever statements he makes constitute an order to me,’’ Hosea said on Thursday evening during a live talk show programme aired by the state-run television network TvT and radio stations, Radio Tanzania (RTD) and Sauti ya Zanzibar (Voice of Zanzibar).

The PCCB chief was responding to a question from a caller who asked him to explain if the bureau was contemplating any investigation into reports of alleged transgressions in the privatisation and takeover of the Kiwira Coal Mine in Mbeya Region, in which former president Mkapa and his energy and minerals minister Daniel Yona were both involved.

It has been established that by virtue of their positions in government at the time, Mr Mkapa and Yona jointly supervised the Kiwira ’fast-track’ privatisation process and oversaw the sale of majority shares in the mine to a recently-formed private company in which both of them had extensive, shareholding interests.

The company, Tanpower Resources Limited, was registered in December 2004 and by mid-2005 (hardly six months later) had already succeeded in acquiring 70 per cent shares in the Kiwira Coal Mine. This was later increased to 85 per cent shares, with the remaining, token 15 per cent retained by the government of the day.

In Thursday’s episode of the weekly ?Tuambie’ programme, aired live by all three state electronic media organs, Hosea endeavoured to explain how the new Prevention and Combating of Corruption Act of 2007 is supposed to give PCCB more powers to tackle grand corruption in the country.

He cited abuse of position by public leaders as one of the many offences being targeted under the new anti-graft legislation.

Section 33 of the legislation states that: ’’Any person who intentionally abuses his position in the performance or failure to perform an act, in violation of law in the discharge of his functions or use of position for the purpose of obtaining an undue advantage for himself or for another person or entity, commits an offence...’’

According to this law, convicted offenders shall be liable to ’’a fine of not less than 1m/- but not more than 2m/-, or to imprisonment for a term of not less than three years but not more than five years, or to both the fine and the jail sentence.’’

Questions from callers started flowing in after Hosea’s introductory remarks.

Apparently not satisfied with Hosea’s initial response to the Mkapa question, another caller asked the PCCB boss to be a little more specific and state clearly whether or not the anti-graft body would initiate formal investigations into the ex-president’s actions with regard to Kiwira.

Hosea reiterated that he simply could not ’’go against what I consider to be instructions from the president (Kikwete)’’, but at the same time used the occasion to ’advise’ anybody with evidence against the ex-president to present it to PCCB.

He was apparently referring to statements made by President Kikwete at a State House news conference in June this year, in which he said his government had no intention of investigating his predecessor because retired presidents deserved to be left in peace, but added that his government would not hesitate to investigate any ’’serious allegations of wrongdoing.’’

Asked by yet another caller why PCCB has so far failed to record any major achievements in the fight against grand corruption in the country, Hosea responded that previously the hands of the anti-graft watchdog were tied by legal loopholes.

But he added that the new anti-corruption legislation was designed to give PCCB more clout to go after the culprits of such grand corruption, which he compared to ’sharks’ as opposed to petty corruption offenders whom he described as mere ’sardines.’

’’Sardines are easy to catch because you can easily see them anywhere...it’s the sharks that are most difficult to catch,’’ Hosea said.

President Kikwete’s statement last June was in response to revelations that Mr Mkapa and former first lady Anna Mkapa had formed a private company in 1999 while still at State House, and conducted private business dealings from within the Ikulu walls until retirement in 2005.

Just a couple of months after Mr Mkapa’s remarks, new evidence has surfaced suggesting that Mr Mkapa and ex-minister Yona may have broken several laws, including the Public Leadership Code of Ethics Act of 1995, in their conduct over the Kiwira Coal Mine privatisation saga.

According to the ethics legislation, a public leader shall be considered to have breached the Act if he or she acquires any significant financial advantage, or assists another person to acquire such gain, by ’’improperly using or benefiting from information which is obtained in the course of his/her official duties and which is not generally available to the public.’’

SITAKI mtu yeyote aamini kuwa Taasisi ya Kuchunguza na Kupambana na Rushwa Tanzania (TAKUKURU), kama ilivyo sasa, inaweza kudhibiti rushwa kubwa nchini.
Anayebisha amuulize Edward Hosea, Mkurugenzi Mkuu wa taasisi hiyo. Yeye, angalau kwenye hili, amekuwa mkweli.
Twende taratibu. Hosea anasema: "Mimi, mamlaka yangu ni rais. Mambo yote ambayo rais ameyatolea matamko, ni amri kwangu."
Je, hii haitoshi kueleza kuwa Hosea na taasisi yake hawana meno? Haitoshi kueleza kuwa sheria mpya iliyozaa TAKUKURU bado ni chui wa karatasi?
Vema viongozi wa taasisi za aina hii wangekuwa wakweli kama alivyokuwa Hosea wakati wa kujibu swali katika kipindi cha "Tuambie" cha Televisheni ya Taifa (TvT), Alhamisi iliyopita.
Hosea aliulizwa iwapo taasisi yake ingechunguza kile kinachoitwa utovu wa maadili ya uongozi wa rais mstaafu Benjamin Mkapa; naye akajibu kwamba hilo tayari lilishatolewa tamko na Rais Jakaya Kikwete.
Ni kweli. Rais Kikwete alishasema Juni mwaka huu kuwa, hana nia wala sababu ya kumchunguza rais mstaafu. Na hili ndilo Hosea anasema na amekariri kuwa, ni amri kutoka kwa "bosi" wake.
Kauli ya sasa ya Hosea inaonyesha kuwa, ingawa rais ni bosi wake, wakati mwingine hawawasiliani. Kwani mwezi Juni, wakati Kikwete anasema hataki kumchunguza Mkapa, Hosea alisema mwenye taarifa ampelekee ili azifanyie kazi.
Bila shaka Hosea atakuwa alionywa au kufundwa kimyakimya, ili aweze kujua nafasi yake katika mahusiano na ofisi kuu ya nchi. Tunaona matokeo yake.
Hata hivyo, mkanganyiko haukumkumba Hosea peke yake. Naye Kikwete aliposema, "si utaratibu mzuri kuchunguzachunguza viongozi wa kitaifa wastaafu," aliongeza pia, kuwa labda pawe na jambo kubwa lenye "ushahidi wa kutosha."
Hapa, Hosea na Kikwete wanapatana katika suala la ushahidi. Lakini ushahidi hupatikana wapi na hupatikanaje? Nani anatafuta ushahidi na nani anahitaji ushahidi na kwa sababu zipi?
Wote wawili – mwajiri na mwajiriwa – Kikwete na Hosea – wanayo majibu kwa maswali haya. Wanajua vema kwamba inawezekana wananchi wanaolalamika hawana ushahidi sisisi.
Wanajua kwamba kile kinachosemwa; kinacholalamikiwa, ndicho chanzo cha taarifa ambazo TAKUKURU inapaswa kutumia kufanya uchunguzi. Kuwaambia wananchi wapeleke ushahidi wowote kwa rais au Hosea, ni kujikanganya. Hasa ni kukataa kuwasikiliza. Ni kupuuza kilio chao. Ni kudharau taarifa zao.
Kudai wananchi watoe ushahidi nje ya mahakama, ambacho ni chombo kinachostahili kusikiliza madai, utetezi na ushahidi, ni kutaka kuzima hoja na malalamiko kwa kutumia ushahidi huohuo.
Kudai ushahidi kutoka kwa chanzo cha taarifa, ni kutaka kukataa kufanya kazi, kwani kazi za TAKUKURU na hata ofisi yoyote ya serikali, si kukusanya ushahidi, bali kuchunguza jambo kutokana na taarifa zilizotolewa.
Na kama Hosea na Kikwete wangekuwa wakusanya ushahidi, basi kusingekuwa na sababu yoyote ya kuwa na TAKUKURU. Waendesha mashitaka wangekabidhiwa ushahidi na kwenda mahakamani moja kwa moja.
Lakini TAKUKURU imeundwa kwa shabaha ya kuchunguza na kuzuia rushwa. Sasa rais anasema, "huyu sitaki achunguzwe." Naye mkuu wa taasisi anasema anaitika kauli za mwajiri wake.
Yote haya yana maana moja kuu: Watawala hawataki kuchunguza watawala wastaafu, na wao wenyewe (watawala wa sasa) hawataki kuchunguzwa.
Ukweli huo ndio unasisitizwa na Hosea pale alipojibu swali katika televisheni kwa kusema; "Mimi, mamlaka yangu ni rais. Mambo yote ambayo rais ameyatolea matamko, ni amri kwangu." Na huo ndiyo mwisho wa TAKUKURU kama chombo cha kuchunguza na kuzuia rushwa.
Funzo linalopatikana hapa ni kwamba, utovu wa maadili na rushwa kubwa zinazohusishwa na "mamlaka" ya Hosea, hazina uwezekano wa kuchunguzwa.
Hii ni kutokana na ukweli kwamba, "mamlaka" ya rais yamo mikononi mwa watu wengi; kwa kuwa urais ni taasisi; si Jakaya Mrisho Kikwete peke yake.
Na taasisi inaongozwa na wateule wengi. Kila mteule wa rais ni "rais" kwa mujibu wa kazi anazofanya, isipokuwa pale ambako mamlaka ya rais yamewekwa bayana, kwamba ni yule tu aliyeapishwa kwa ofisi hiyo.
Kwa msingi huo, wenye uwezo wa kukemea, kununia, kuzima, kutishia, kulaumu na hata kupendekeza kwamba Hosea (mkurugenzi yeyote wa taasisi hii) hafai, ni wengi – kuanzia wateule wa rais hadi maswahiba wake.
Hali hii ndiyo inaangamiza TAKUKURU na Hosea. Pale ambako rais ataona maslahi au matakwa ya watawala wastaafu yanaguswa, atamwambia Hosea anyamaze.
Na Hosea atanyamaza, kwani kwake kuwa katika taasisi hiyo ni suala la ajira; si harakati za kupambana na rushwa. Harakati hazipokonyeki; lakini ajira huweza kupokonywa na aliyekuajiri.
Bali ukweli unabaki palepale: Ili mapambano dhidi ya rushwa yaweze kufanikiwa, sharti yahusishe serikali. Sharti serikali ichukue nafasi ya mbele katika vita hiyo.
Lakini kama serikali haitaki au inaogopa au yenyewe inatuhumiwa; na asasi ambayo ingeichunguza iko chini ya serikali hiyohiyo; basi huo ndiyo mwisho wa majigambo ya watawala ya kutokomeza rushwa.
Jambo moja linanipa faraja. Waandishi wa habari wanaendelea kuibua taarifa za ulaji rushwa katika taarifa zao za uchokonozi. Wananchi wanaendelea kulalamika waziwazi na malalamiko yao yamejaa hoja zisizokwepeka.
Kama TAKUKURU na watawala watanyamaza na kuendelea kudai "ushahidi," hatimaye wananchi wenyewe watajifunza polepole jinsi ya kuchukua hatua dhidi ya watawala na taasisi yao.
Sitaki awepo wa kuamini kwamba kwa kuwa wananchi hawana uwezo leo, basi wataendelea kuwa hivyo milele na milele.

Lawyers blast PCCB position on Mkapa

-’If the Bureau fails to investigate, it will lose its legitimacy, credibility and most importantly public confidence�’

THE head of the government’s anti-corruption watchdog, Edward Hosea, has come under sharp criticism for apparently refusing to investigate allegations of wrongdoing against former president Benjamin Mkapa and senior minister Daniel Yona over the controversial privatisation of the Kiwira Coal Mine in Mbeya Region.

Lawyers and human rights activists have blasted the Prevention and Combating of Corruption Bureau (PCCB) for failing to launch an official probe into allegations of dubious wheeling and dealing by the former president and minister, ostensibly because of their big-name status and previous powerful positions in government.

’’By declaring that they shall not investigate the former president come what may, the PCCB has demonstrated a sheer lack of seriousness and commitment to fight grand corruption in Tanzania,’’ said prominent local lawyer Tundu Lissu in a weekend interview with THISDAY.

Lissu described the controversial stand taken by the PCCB boss, to wit that investigating the former leader would be in defiance of public statements made by incumbent President Jakaya Kikwete, as being a misguided approach.

’’President Kikwete did say that former presidents should be left in peace, but he also stressed that his government would not hesitate to investigate any serious allegations of wrongdoing,’’ noted Lissu.

He further pointed out that since Mr Kikwete’s remarks made about two months ago, there have been new revelations that ’’Mr Mkapa and his cabinet ministers may have actually been involved in much bigger things.’’

Said Lissu: ’’There is evidence that Mkapa may have abused public office for his own personal, financial gain. These are very serious allegations that cannot just be swept under the carpet, under the pretext that President Kikwete has ordered PCCB not to investigate his predecessor.’’

He added: ’’If PCCB is serious about fighting corruption at all levels of government, it could and should investigate Mkapa. And if proven guilty, then all his ill-gotten wealth should be recovered by the government.’’

Lissu said if PCCB failed to investigate clear allegations of corruption, ’’it will lose its legitimacy, credibility and most importantly public confidence.’’

Another seasoned lawyer and politician, Mabere Marando, commented in a separate interview that the country’s laws placed the PCCB boss in an awkward position because in the final analysis, he is answerable to the president.

’’Technically Hosea was right when he said he couldn’t go against the president’s directives. This problem highlights the need to remove the PCCB from the control of State House and make it answerable to either parliament or the judiciary, to make it more independent,’’ said Marando.

Under existing law, the PCCB director general is appointed by the president, to whom he or she is directly answerable.

Himself being a former high-ranking civil servant who is familiar with the workings of the government, Marando said he personally believed incumbent President Kikwete and the PCCB boss had ’’very good knowledge’’ about the allegations against Mr Mkapa.

’’I think the current government is simply afraid of investigating Mkapa because it could set a dangerous precedent that might ultimately come to haunt them at the end of their own term in office,’’ he remarked.

The outgoing US Ambassador to Tanzania, Michael Retzer, recently urged the government to ensure more independence for the PCCB by making it free of control or possible interference by the president of the day.

Retzer also called on the PCCB to ’’intensify its efforts to investigate, prosecute and jail any person regardless of name, title or position’’, adding that ’’we firmly believe that people are innocent until proven guilty, but anyone suspected of corrupt activities should be investigated.’’

’’Allegations of inappropriate behaviour should not be dismissed due to one’s current or previous position,’’ the US envoy said in remarks addressed to PCCB director general Hosea.

Retzer said that while the new Prevention and Combating of Corruption Act of 2007 was a step towards the right direction for Tanzania, it could have gone a little further and given the PCCB ’’complete independence from all government oversight, including that of the president.’’

’’Although there are now more crimes that can be prosecuted, we will only begin to see this agency (PCCB) at its best when it feels that it answers to no one other than the legal system and the Tanzanian people,’’ he said.

At a State House news conference last June, President Kikwete was asked to clarify if his government planned to investigate his predecessor following media reports at the time that Mr Mkapa and former first lady Anna Mkapa formed a private company - ANBEM Limited � in 1999 while still in office, and conducted private business dealings from within the Ikulu walls until retirement in 2005.

And in the past few weeks, new evidence has surfaced suggesting that Mr Mkapa and ex-minister Yona may have broken several laws, including the Public Leadership Code of Ethics Act of 1995 and Prevention and Combating of Corruption Act of 2007, in their conduct over the Kiwira Coal Mine privatisation saga.
