Mbona wasiharakishe kujenga mabarabara na viwanda vya kusindika mazao, maana wanaweza kutoza kodi na kufarijika kupitia 'win win situation' kama kweli wana nia njema wakati Taifa letu bado mhimili wake ni kilimo na ufugaji... kwa nini wasiwekeze huku kwanza maana ndiyo kwenye haraka la sivyo 'tutakufa na njaa', instead wanakimbilia madini, kwani wanajua kabisa kuwa wakichimba leo na kuweka hazina hiyo ya dhahabu kwenye mabenki yao huko Ulaya, basi watakuwa wamepata kitu madhubuti cha kuendelea kutugandamiza sisi katika mfumo wa pesa duniani. Fikiria Tanzania ingeweza kuweka dhahabu kama hazina yake katika mabenki ya pesa duniani, shilingi yetu ingekuwa inateleleka namna hii?!... hata dhahabu tu zinazochimbwa kienyeji zinaweza kutuokoa tusiwe na fedha inayoyumba kila siku, badala yake, tuna i blackmail shilingi yetu sisi wenyewe through these bunch of crack heads.

The constitution of Tanzania inadvertently plays a major role in unnerving potential investors in crucial sectors of the economy especially mining. Consequently, prospective investors in long-term projects are deterred from coming to the country.
Admittedly, mining has in recent years seen an influx of investors especially those interested in the extraction of gold and other precious metals. But the same cannot be said of agriculture, long regarded as the backbone of the economy. The main is that in mining, the time-period between confirmation of commercial deposits and profitable exploitation can be telescoped into a matter of a few years.
FURTHERMORE, successful mining is not hostage to the vagaries of the weather or the vicissitudes of the marketplace as is the case with agriculture. In such a situation, a prospective investor with rudimentary investment acumen and to whom the only concern is the bottomline would rather go into precious metal extraction.
This makes more business sense than going into, say, agriculture in todays unpredictable climate changes.
Indeed, there is little probability of surviving a farming season involving such perennial crops as coffee, tea, sisal, cashewnuts, cotton and tobacco.
In any case, it was shown by the Mkapa regime (1995-2005) that it is possible for investors in mining to embed self-serving escape clauses into mining contracts. Hence the extant contracts which are lopsided, in favour of the miners and against Tanzania.
Such clauses are found in crucial areas such as repatriation of mineral sale proceeds and profits (virtually unlimited) and delayed-action taxation till after the miners have fully recouped their investments.
With most gold mines projected to have 10-20 years of commercially productive life, it is possible for the investors to recoup their costs plus profits within the first few years of production. And, by design on the part of the investors, both are practically undeterminable by the host government.
INVESTORS are highly sensitive to all manner of risks be it natural or man-made. As we have already seen, they will not go into weather-sensitive investment areas such as agriculture. By the same reasoning, they will not go into socio-politically sensitive investments such as mining unless and until they are assured in no uncertain terms of reasonably quick returns.
That is basically why the mining contracts were deliberately designed with the help of the World Bank, I am sure to provide iron-clad assurances that the investors would recoup their costs, and hightail it out of the country before the government began thinking about nationalising the projects.
This is where the constitution of Tanzania (1977, as amended from time to time) rears its ugly head. In its preamble, the constitution talks of being enacted for the purpose of ensuring that Tanzania is ruled by a government that adheres to the principles of democracy and Socialism (my emphasis).
This is cemented in Article 3(1) thereof, which unequivocally declares Tanzania a democratic and Socialist state? As far as I am concerned, socialism still implies ownership and control of the means of production, distribution and exchange by the community as a whole, not by a sprinkling of capitalists here and there.
In such a situation, can you see capitalist investors trusting a host government that professes socialism with what they have, hold and own? If they cannot shoehorn iron-clad clauses into investment contracts assuring them of quick returns, they will not move in, period!

Sehemu nyingine wameweka kodi zao kwa kuangalia raslimali zao, iweje mahali ambapo pana thamani kubwa isitozwe kodi kubwa kidogo, kwanini ilingane na kodi ya miji ambayo haina raslimali kubwa na zenye thamani?
Kama hujaweka kigezo cha kodi na badala yake unaamua kuwa jumla ya "kodi hiyo" haitazidi dola laki mbili. Ina maana wanaweza kulipa dola laki moja au dola mia tano!!
Artical 10 no compulsory acquisition.
The government shall not nationalize or compulsorily acquire the whole or any part of the company's interest in the Special Mining Licence nor compulsorily acquire or nationalize any right, title or interest of the company or its contractors or sub contractors in any property used for the purpose of mining operations on or in relation to the special Mining Licence, provided that, if it does take any such action to acquire those assets, it will pay compensation in US dollars to an account outside Tanzania specified by the company in an amount and manner that is prompt, adequate and effective.
