Kulingana na hali harisi nisingetegemea kusainiwa mkataba wowote ule bila kuwa na sheria mpya. Mapendekezo ya kamati ingelipendekeza uandikaji upya wa sheria ya madini na kuachana na sheria zote za miaka iliyopita.

Hili litasaidia kwa sababu karibia kila nyanja tayari watu wameisha kuwa na experience na kuona mianya ya kuchuma utajiri wetu iko wapi.

Pili nafikiri kuna haja ya kuangalia vizuri, jinsi nchi ya Botswana ilivyoweza kuweka sheria zake.

Kama tunaweza kupeleka timu ya mpira ulaya kwa nini katika hili suala tusipeleka wazalendo Botswana wakastudy implimentation nzima ya mikataba ya madini. Nimekaa Botswana sidhani kama kweli tumeisha study vya kutosha jinsi hawa watu wanavyofaidika/walivyo na mikataba mizuri.

Hatuna Budi kuiga na kusoma mazingira yao na sisi tukaweza kunufaika katika mikataba ijayo.

Very good point kaka, muanze kwa kukupendekeza wasitishe uingaji wa mikataba mipya hadi sheria mpya itungwe na mechanisms zimewekwa kusimamia sekta ya madini; nna kuingiwa upya kwa mikataba iliyokwisha pita, hata ikibidi makampuni kufunga virago! Asante sana kwa majibu yako mazuri katika hoja zangu na baadhi yananifungua macho na kunipa moyo zaidi.

Kitu kimoja ambacho napenda tujifunze ni kwamba, tuondokane kabisa na tabia ya kusubiri eti Rais afanye kwa hiari yake. Au eti Serikali ifanye. Ni lazima serikali ishinikizwe kufanya mambo ambayo haitaki kufanya. Hapa wananchi ndio watakaofanya kwa njia zozote. Lakini ili wafanye ni lazima wawe na taarifa 'authoritative' ambazo kama ni za serikali inakuwa ni bora zaidi! Hivyo, kama kamati itatoa taarifa na serikali ikashindwa kutekeleza, wananchi watashinikiza. Subiri utaona katika hili.

Ni kweli kuwa kamati ya sasa imeundwa ndani ya mwaka mmoja toka kamati iliyopita itoe taarifa yake. Kumbuka kamati iliyopita haikuwa na public scrutiny. Haikuwa na nguvu yeyote ya kisiasa. Ndio maana taarifa yake ikawa inatolewa kidogo kidogo na serikali pale inapofanikiwa kujadiliana na makampuni ya madini. Kamati hii ni tofauti.

Kamati ya sasa, kwa mwono wangu, ni zaidi ya kile nilichoomba Bungeni katika hoja yangu ya Kamati Teule. Kamati ile ya Bunge ingeleta taarifa kuwa, kwa mfano Karamagi alikosea, alisaini Mkataba wa Buzwagi bila kuzingatia mapendekezo ya kamati ya Masha. Karamagi angefukuzwa Uwaziri. Hata hivyo sera ya Madini ingebaki pale pale. Sheria ya Madini ingebaki pale pale!

Kamati ya sasa licha ya kutoa taarifa zaidi, kwa kupenda au kutokupenda, itasafisha uvundo wa nyuma na kuweka misingi ya sera mpya na sheria mpya. Kwa vyovyote vile,kamati haitakuwa imefanya la maana kama haitakuja na draft bill ya sheria ya madini. Sasa kama serikali ikishindwa kuleta muswada huu Bungeni, wajumbe wa Kamati walio wabunge itawabidi ku co-sponsor hiyo bill ili sheria mpya ya madini itungwe. Hali ya kisiasa nchini imebadilika sana, haya ninayoyasema yanawezekana. Serikali ikikataa kutekeleya mapendekezo it will be doing so at its own peril.

Wajumbe wote wa Kamati, mpaka sasa, wapo so serious. Mwenyekiti yupo so serious. Kumbukeni mtu kama Bomani na Simba ni watu ambao hawataki kitu in public isipokuwa historia kuwajudge positively. Hawa wazee ni serious huwezi amini.

Ninachoweza kusema ni kuwa, Kamati hii itatoa mambo mazuri zaidi ya ile kamati niliyotaka Bungeni na inawezekana Kamati hii ikarudisha suala lile Bungeni tena.
 
Foreign diplomats, mainly from countries whose nationals have invested in the local mining industry, played a crucial role to ensure that mining firms continue to operate under the Income Tax Act of 1973, instead of the amended Act of 2004, the Sunday Citizen can reveal.

According to highly placed sources, three years ago, experts from within and outside Tanzania advised the government that The Income Tax Act 1973 was outdated and required amendments.

One of these experts was from Oxford University in the United Kingdom.

The government accepted the advice and, through Parliament, repealed the Income Tax Act of 1973. Since then, the Income Tax Act of 2004 has been governing calculations and payments of various income taxes to government by investors, but excluding those in the mining sector.

While the new Act was being prepared, say sources, some ambassadors joined forces and formed a committee to scrutinise the new Act, which according to experts, is something out of the ordinary.

The committee then met with the then Minister for Finance, Basil Mrambaunder severe pressure, raising their objections over the new Act, especially with regards to the mining sector.

Mramba is said to have met with the ambassadors? committee twice and in response to their objections, the Cabinet gave in and agreed that investors in the mining sector be exempted from paying taxes according to the Income Tax Act 2004.

To date, investors in the mining industry pay income tax according to the Income Tax Act 1973.

Mramba told the Sunday Citizen yesterday that what the ambassadors did was not interfering; they just gave their views on the new Act.

When asked whether their views were incorporated or not, Mramba said 'No'. When further asked to explain why the mining sector was still governed by the Income Tax Act 1973, or to clarify, if this were not the case, the minister said he was driving and hence could not hear our reporter?s question clearly. His phone got went off air thereafter.

According to sources, Canadian and Dutch ambassadors were amongst the ambassadors exerting the pressure.

Major companies, especially those in gold mining, are from Canada, while Holland is known to have connections with a major gold mining company in Tanzania.

The sources further reveal that if the Income Tax Act of 2004 was governing them, mining companies would have been paying much higher taxes than they do today.

There has been an unprecedented outcry in the country in the past one year over how mining companies have been cheating the government and the people of Tanzania through paying minimal taxes.

None of the gold mining companies, for example, has paid the much-needed 30 per cent corporate tax.

One reason for this is that the Income Tax 1973, even after the 2002 amendment, contains a controversial ?15 percent additional capital allowance on unredeemed capital expenditure? Clause.

The 15 per cent additional capital allowance on unredeemed capital basically means the government is each year gifting the miners 15 per cent of the capital yet to be recovered by them.

This means the companies take much longer to recover their initial investment and hence during all this period they do not declare profits, so they do not pay corporate tax. Corporate tax is only paid when companies make profit.

The mining companies have also been denying the country corporate tax because of over declaration of losses.

Because they were not being audited before 2003, such cheating could not be detected. However, the first audit of gold mining companies carried out by Washington DC based the Alex Stewart (Assayers) Government Business Corporation (ASA) revealed how mining firms were cheating the government.
Their 2003 audit of three out of the six big mining companies revealed for the first time discrepancies that have cost Tanzania millions of dollars in tax revenue.

This report, published first by the Sunday Citizen last year, in one instance showed that Geita Gold Mine (GGM)'s "declared accumulated tax losses of US$193 million up to December 2003 is reduced by an estimated US$158 million, making their allowed accumulated tax losses to be US$35 million only."

What this means is that, instead of the company carrying forward a tax loss of US$35m, which would be offset by profit of the following year, the company carried forward a hugely inflated figure of US$193 million. Thus, by offsetting against the profit of the following year, profit declared in the year 2004/2005 was much less than the actual figure. Which means, the tax paid to the government was much less than what should have been due.

Asked why these companies were never audited before, the Energy and Mines minister at that time, Dr Ibrahim Msabaha said the contract with miners didn?t compel that they be audited, so the companies rebuffed any moves to have their books audited.

"These people said they would never be audited. This is the first time but now we are very serious, from now on the auditing will be carried out," he stressed.

Furthermore, Tanzania has been losing from the gold mining sector because of lack of Windfall Tax clause in the Income Tax Act and the Mining Act. Thus, while the price of gold has been continuously souring at the world market enormously, Tanzania is not able to benefit over this advantage.

According to experts, windfall taxes are tax levied by governments against certain industries when economic conditions allow those industries to experience?above-average profits.

However in Tanzania, all mining contracts entered between the government and foreign investors are silent on windfall tax, creating loopholes for smooth maximisation of profits at the expense of Tanzanians.

Because of this lack of windfall tax clause, both in the Mining Act and mining contracts, Tanzania continues to receive tax based on the price of gold when a mining contract was signed.

Hence, while mining companies have been selling at US$800 an ounce lately, the taxes they pay are based on the old US$370 price.
In oil-rich countries, the windfall tax is one of the key factors that boost the government?s tax collection especially when global crude oil prices surges dramatically.

The Canadian Prime Minister, who was in the country late last month said his government supported President Kikwete's initiatives to revamp the mining sector. He said multi-national companies tend to maximise profits where laws are loose.

The mining companies too have maintained that they have always been willing to pay taxes as specified by the government, however it was the government's own weaknesses that they formulated laws that did not get them maximum entitlement.

However, it now emerges that when the government does try to revamp laws for a win-win situation, as when they did by formulating the new Income Tax in 2004, diplomatic missions with close connections to the mining companies frustrate such efforts.

Dua mchango wako umenisaidia maana kwa kuwa wafungwa wa namna hii kiuchumi milele ilikuwa unanitia presha lakini kwa maneno yako kwamba Rais ana mamlaka kuamuru sheria kama hizi zifanyiwe marekebisho yamenitia moyo najisikia ahueni sana. Vinginevyo sisi watu weusi tutatukanwa milele kwamba we are less intelligent than white people, kumbe jeuri yao ni malighafi zetu zinawapa kiburi hicho.

Zitto, ninayachukulia maneno yako at face value na ninawapa benefit of the doubt. Nadhani muda utaamua ni kwa kiasi gani Kamati yenu ni tofauti ya zilizotangulia. Ninawatakia kila la kheri na nisitishe kwa muda huu ukosoaji wa hii kamati na kupiga magoti tu kuombea mfanikiwe ili kilichowashinda wengine nyinyi mkiweze; maana kama na ya kwenu ikishindwa basi sijui tutakimbilia wapi.
