Muslim law regards women as less than men in matters of both marriage and divorce, as well as devolution of property: Holy Quran Surah 2:228-232, and Surah 65:1-7 (only a man may divorce his wife even if he is required to provide for her); a man may beat his wife, even if lightly, the evidence of two women, is equal to evidence of one man (Surah 2:282). The application of such beliefs of faith are contrary to the Constitution of Tanzania

2: 228. Divorced women remain in waiting for three periods, and it is not lawful for them to conceal what Allah has created in their wombs if they believe in Allah and the Last Day. And their husbands have more right to take them back in this [period] if they want reconciliation. And due to the wives is similar to what is expected of them, according to what is reasonable. But the men have a degree over them [in responsibility and authority]. And Allah is Exalted in Might and Wise.

And it is not lawful for you (men) to take back (from your wives) any of your Mahr (bridal money given by the husband to his wife at the time of marriage) which you have given them, except when both parties fear that they would be unable to keep the limits ordained by Allah (e.g. to deal with each other on a fair basis). Then if you fear that they would not be able to keep the limits ordained by Allah, then there is no sin on either of them if she gives back (the Mahr or a part of it) for her Al-Khul' (divorce). These are the limits ordained by Allah, so do not transgress them. And whoever transgresses the limits ordained by Allah, then such are the Zalimun (wrong-doers, etc.).

And when you have divorced women and they have fulfilled the term of their prescribed period, either take them back on reasonable basis or set them free on reasonable basis. And treat not the Verses (Laws) of Allah as a jest, but remember Allah's Favours on you (i.e. Islam), and that which He has sent down to you of the Book (i.e. the Qur'an) and Al-Hikmah (the Prophet's Sunnah - legal ways - Islamic jurisprudence, etc.) whereby He instructs you. And fear Allah, and know that Allah is All-Aware of everything.[/SIZE][/SIZE][/SIZE][/SIZE]

And when you have divorced women and they have fulfilled the term of their prescribed period, do not prevent them from marrying their (former) husbands, if they mutually agree on reasonable basis. This (instruction) is an admonition for him among you who believes in Allah and the Last Day. That is more virtuous and purer for you. Allah knows and you know not.[/SIZE][/SIZE][/SIZE][/SIZE]

65: 1 O Prophet, when you [Muslims] divorce women, divorce them for [the commencement of] their waiting period and keep count of the waiting period, and fear Allah , your Lord. Do not turn them out of their [husbands'] houses, nor should they [themselves] leave [during that period] unless they are committing a clear immorality. And those are the limits [set by] Allah . And whoever transgresses the limits of Allah has certainly wronged himself. You know not; perhaps Allah will bring about after that a [different] matter.

65:2And when they have [nearly] fulfilled their term, either retain them according to acceptable terms or part with them according to acceptable terms. And bring to witness two just men from among you and establish the testimony for [the acceptance of] Allah . That is instructed to whoever should believe in Allah and the Last day. And whoever fears Allah - He will make for him a way out

65:3 And will provide for him from where he does not expect. And whoever relies upon Allah - then He is sufficient for him. Indeed, Allah will accomplish His purpose. Allah has already set for everything a [decreed] extent.

65:4 And those who no longer expect menstruation among your women - if you doubt, then their period is three months, and [also for] those who have not menstruated. And for those who are pregnant, their term is until they give birth. And whoever fears Allah - He will make for him of his matter ease.

65:5 That is the command of Allah , which He has sent down to you; and whoever fears Allah - He will remove for him his misdeeds and make great for him his reward.

65:6 Lodge them [in a section] of where you dwell out of your means and do not harm them in order to oppress them. And if they should be pregnant, then spend on them until they give birth. And if they breastfeed for you, then give them their payment and confer among yourselves in the acceptable way; but if you are in discord, then there may breastfeed for the father another woman.

65:7 Let a man of wealth spend from his wealth, and he whose provision is restricted - let him spend from what Allah has given him. Allah does not charge a soul except [according to] what He has given it. Allah will bring about, after hardship, ease.

Kama mambo ya kadhi ni IBADA, kuna sababu gani ya kuhitaji polisi amlazimishe muumini kufanya mambo ya ibada?
Mbona polisi hawalazimishi watu kwenda kuswali? mbona polisi hawalazimishi watoto kwenda madrasa? Mbona ndoa zinafungwa kiislam lakini kwa hiari? Iweje sasa maamuzi ya kadhi (Ibada) yalazimishwe na polisi? Na hao polisi na taasisi zingine zitakazotumika ku-enforce maamuzi ya kadhi watakuwa waislam au wagalatia?

Mahakama itakapo amua kutengua ambayo watu waliokuwa mke na mume wameshtakiana na mali kuamua igaiwe sawa kwa sawa, mwanaume akakataa au kuficha mali, hatua gani itachukuliwa kuhakikisha haki inatendeka !?
Au Mahakama ina amua nyumba iuzwe, mmoja wapo hataki, Je, hatua gani zichukuliwa ikiwa hukumu tayari imetoka !?

Anzisheni kama wakristo,wahindu,mabudha,wapagani,machifu,wapagani nk walivyoanzisha mahakama yao na wanaiendesha wenyewe bila kugombana na yeyote. Hata wakristo hawapingi ninyi kuwa na mahakama ya kadhi. Bali muianzishe wenyewe,muiendeshe na muigharamie wenyewe. Hatuitaji kodi za wakristo,wapagani,wahindu,mabohora,mabudha,masingasinga nk ambao hata hawamjui kadhi,eti zilipie mahakama ya kadhi.Musiifanye ni jambo la watanzania wote mpaka eti liwekwe kwenye katiba.Mfano: Kwa wakatoliki na madhehebu mengi ya kikristo mwanamme akimuacha mkewe wa ndoa na kuchukua mwanamke mwingine,mwanamke akishtaki kanisani na mwanamme akionekana ana makosa,huwa anafungiwa kushiriki huduma zote za kanisa. Mwanaume huyu hata aende mahakama za serikali hatosikilizwa kwa hiyo hukumu. Sasa ninyi mnashindwa nini kuanzisha hiyo kitu mradi tu msikinzane na sheria za nchi? Au mnataka kuja kuwa juu ya sheria za nchi?.Kipi haujaelewa hapo?
