Kuhusu mahakama ya kadhi

Angalia na huyu pimbi! Unataka wabunge waislam waongelee habari ya kanisa. Mahakama ya kadhi ni ya wa Islam na si ya Kafiri kama wewe. Na wewe omba mahakama ya kikristo.

Sasa ukinitukana ndio utanishawishi? jifunze kujenga hoja acha jazba za masjid. Mimi siwezi omba mahakama ya kikiristo kwa kuwa hipo na inaendeshwa na kanisa,wala atulilii kodi za wa I slam zitusaidie kuiendesha.
 
As long as mnataka iingizwe kwenye katiba ya wote basi lazima ituhusu. Mngelimaliza ili janga misikitini hakuna. asiye muislamu angeuliza. Muwe mnatumia akili sio kumeza kila sheikh anachosema.

Mambo ya wavuvi au walemavu kuwekwa kwenye katiba ya wote ina maana wa Tanzania wote ni wavuvi au walemavu? Na wewe uache kumeza shekel ya padri kwa mdomo wa chini. Mahakama ya kadhi ni ya wa Islam na si ya makafiri.
 
Nashangaa wabunge wa kislam kuangaika na mahakama ya kadhi ilihali kuna mambo muhimu ya waislamu hawayaongelei wanakomaa na kisicho na manufaa..kwanza iyo mahakama ata kwenye quran haijatajwa wala mtume hakuiliagiza sijui awa wanaosema ovyo wanaitoa wapi reference yao mbona Kenya mbona Uganda.....mahakama inayohukumu mwanamke akizini apondwe mawe ila mwanaume alozini nae apongezwe kuitwa shababi hatuitaki,itatuondolea amani yetu.

Wewe ulitaka itajwe vipi???. Uislamu ni dini iliotawaliwa na Sheria katika kila kipengele cha Maisha ya Mwanadamu. matumbo hili tumeshajibu sana humu. Ila Sheria na Katika dini ya kiislamu ni Msingi wa dini hii. Kila kinachofanyika ni kwa mujibu wa Maagizo yalio ndani ya Qur-an. Msingi wa hoja ya haki katika dini umeelezwa katika aya nyingi sana ndani ya Qur-an. Hakuna muda wa Kutosha kueleza kilakitu humu.




O you who believe! Stand out firmly for justice, as witnesses to Allah, even though it be against yourselves, or your parents, or your kin, be he rich or poor, Allah is a Better Protector to both (than you). So follow not the lusts (of your hearts), lest you avoid justice; and if you distort your witness or refuse to give it, verily, Allah is Ever Well-Acquainted with what you do. [Surah An-Nisa (4:135)]

Islam is a religion that helps its followers not only to prepare for the life in the Hereafter, but also to establish peace and security on earth.

  • The verse highlights a very important constituent of Islamic character – the need to practice justice in matters pertaining to our interactions and dealings with others. Allah the Most Wise and Just, expects Muslims to be firm in implementing justice.
  • Islam strictly forbids oppression and misuse of power over the weak in any form.
  • Justice should be given such importance in our lives and all its affairs that self seeking considerations should not be allowed to influence it, weaken it or twist it.
  • The practice of justice requires that we do not give undue importance to our ego or to false ‘worldly' concepts like our ‘image' in the eyes of others.
  • We generally avoid justice when its implementation goes against us or our near ones as we are concerned about protecting our (and their) interests. But Allah The All Knower assures us that He is a Better Protector of all.
  • We must realize that none other than Allah, The Disposer of All-Affairs, has the power to take care of the world and its people (which include even ourselves). For a short-term benefit, we should not therefore deviate from justice thinking that we can safe-guard our interests by ignoring it, avoiding it or going against it.
  • Allah The Most Wise is concerned about our long term gains which can be achieved when we adopt the right and just course in all our dealings.
  • We are also aware of the fact that when we adhere to justice and fairness, most of our conflicts would be dissolved and Allah's injunction for us to stay away from mischief, would be easy to follow.
  • Allah Most Merciful gives us reminders at the end of many verses in the Quran thatHe (SWT) ‘is Ever Well-Acquainted with what you do'. This should enable us to be constantly aware of the Day of Accountability when we would be standing in front of Allah The Exalted in Power and Might, unable to hide any wrong act we might have indulged in during our life.

Allah says: "O you who believe! Stand out firmly for Allah, as witnesses to fair dealing, and let not the hatred of others to you make you swerve to wrong and depart from justice. Be just: that is next to piety: and fear Allah. For Allah is well-acquainted with all that you do." [Sûrah al-Mâ'idah: 8]

He says: "O you who believe! Stand out firmly for justice, as witnesses to Allah, even as against yourselves, or your parents, or your kin, and whether it be (against) rich or poor: for Allah can best protect both. Follow not the lusts (of your hearts), lest you swerve, and if you distort justice or decline to do justice, verily Allah is well-acquainted with all that you do." [Sûrah al-Nisâ': 135]

This verse shows us that we should not be unjust to anyone, rich or poor. We often think of this in the context of the poor, since they often suffer injustice at the hands of those who have wealth and power. However, the verse is also telling us that we should not allow our sympathies for a poor person cause us to be unjust to others for the poor person's sake. This is why Allah says: "…for Allah can best protect both."

Justice is not necessitated by love. We do not treat people justly because we like them or are partial to them. If that were the case, there would be no need to command justice, since people are naturally just to those they favor. We need to be commanded with justice when dealing with those we have no favorable feelings towards.

Justice is necessitated by nothing other than our shared humanity. We must be just towards all human beings, regardless of religion, race, ethnicity, or gender. Justice is the greatest means of ensuring human dignity and human rights. Justice is what people ask for and expect from each other, regardless of their affiliations, loyalties, affections, and prejudices.

Kwa iyo waislamu nao ni kundi maalum kama wavuvi,walemavu na wafugaji ? afadhali umenifungua akili.
 
Hivi wewe mtu na akili zako timamu huoni kuwa itakuwa ni moral contradiction kuwa na mahakama ya kadhi, mfano leo unaona dhahir kuwa tumekuwa ndugu moja mpaka hata kuzaliana ktk dini tofautitofauti wakati mwingine hata pasipo kuoana sasa ikija hiyo mahakama yako na kudai watoto wa muislamu aliyezaa na mtu wa dini nyingine huoni kuwa hiyo kwanza italeta zogo maana muislamu atapeleka kesi kwenye mahakama ya kadhi na yule wa dini nyingine atalazimishwa kuingia ktk sheria isiyoendana na imani yake. Huh hiyo tosha inaleta mkaraganyiko?? kuna mifano mingi sana ambayo italeta tafrani ktk jamii yetu ambayo huenda hata ikahatarisha maisha ya watu. You need to be serious man!

Kwa kifupi,mahakama ya kadhi ni ya wa islam na inahusu mambo ya wa Islam tuh. Haimuhusu Ahmed(islam) na katarina (kristo). Ahmed na katarina kesi yao itapelekwa mahakama ya serekali.
 
Tatizo kubwa hapo elimu ndio tatizo. mahakama ya kadhi sawa haiwahusu wakristo inawahusu waislamu na ndiomaana wanaidai. Na halazimishwi kila muislamu kupeleka kesi yake hapo kama hutaki kupeleka hapo unaenda kwenye ya serikali.Na mkristo kuzaa na muislamu au muislamu kuzaa na mkristo hiyo ni zinaa umefanya omba mungu akusamehe maana nidhambi kubwa kuzini kabla hujaoa. na mambo ambayo yanatakiwa kwenye hiyo mahakama ya kadhi yameainishwa nashangaa kupinga tu bila kujua. Na hiyo mahakama kuingizwa kwenye katiba ni kutambulika tu na kupewa meno sio lazima itumike pesa ya serikali. lkn mnasahau pesa wanazopewa makanisa waislamu wamenyamaza. sio kila kilichopo kwenye katiba ni cha watanzania wote na ndiomaana wameenda wawakilishi.

Mimi kama mwananchi wa kawaida kabisa, ninawatahadharisha kwamba iwapo mtajaribu kuweka jambo lolote linalohusu mahakama ya kadhi sisi WAKRISTO (CHRISTIANS) tutapiga kura ya hapana kwa katiba itakayopendekezwa. Nawahakikishia ndugu wajumbe wa bunge maalumu, hakuna mkristo atakaye iunga mkono katiba hiyo na haitopita..
Na sisi Waislamu tutapiga kura ya hapana kwenye katiba ambayo haitapendekeza Mahakama ya Kadhi.

Katiba yenu?? Unamaanisha katiba ni yako na ya mama yako? Kama unamaanisha hivyo hata sisi hatutaki mahakam ya kadhi iwekwe huko.
 
Nafurahi mahakama hiyo ipitishwe tu ili akina mama wasioelewa wanachokifanya yawakute. Kura zenu musipige lakini katiba itapita tu, kwani ----- anaweza kuzui nini katika dunia ya wajanja?
 
JJB mie nishasema kuwa Katiba ikija bila ya mahakama ya kadhi naipigia kura ya hapana na sio msimamo wangu na waislamu wengi tushasema bila ya hilo hakuna katiba mpya. Bora mkubali ibakie hiyo hiyo katiba ya 1977 lakini mkileta katiba mpya bila ya mahakama ya kadhi hakuna mwislamu ataipigia kura tuone nani mshindi!!!

Hii nchi si yako ni yetu kwahiyo koma kama ulivyokoma na kuwa mtu mzima. Kama hautaki mahakama ya kadhi kalie huko au hamia kusiko na mahakama ya kadhi. Huwezi kututisha kwa kudai tuamue moja tushaamua mbona hujui hilo?
 
Kwa kifupi,mahakama ya kadhi ni ya wa islam na inahusu mambo ya wa Islam tuh. Haimuhusu Ahmed(islam) na katarina (kristo). Ahmed na katarina kesi yao itapelekwa mahakama ya serekali.
Huh! sidhani kama unfuatilia sana mambo ya habari kuhusu tafrani za sharia law mkuu (courtesy of kadhi courts) angalia mfano wa Meriam Ibrahim pale Sudan na maamuzi yake ya kufuata dini ya kikristo and what happened to her!?? naona kama sasa tunaanza kuchoshwa na amani hizi na tunatamani kuona damu zinamwagika sasa. Mkumbuke huyo Meriam Ibrahim aliyejiamulia binafsi kwa matakwa yake kufuata dini nyingine sababu mzazi wake mmoja alikuwa na imani hiyo kwanza kabla hatujaenda mbali

Ndugu zangu mambo yanayoendelea huko bungeni kuhusu mahakama ya kadhi yanasikitisha sana. Inavyooelekea mahakama hiyo inaenda kukubalika kutokana na hoja zinazotolewa na ndugu zetu waislamu. Jambo hili linanitisha sana kwa sababu hakuna mtu anayepinga hoja hii, na kila mwakilishi wa kikristo akisimama anakwepa kabisa kuongelea jambo hili.

Mimi kama mwananchi wa kawaida kabisa, ninawatahadharisha kwamba iwapo mtajaribu kuweka jambo lolote linalohusu mahakama ya kadhi sisi WAKRISTO (CHRISTIANS) tutapiga kura ya hapana kwa katiba itakayopendekezwa. Nawahakikishia ndugu wajumbe wa bunge maalumu, hakuna mkristo atakaye iunga mkono katiba hiyo na haitopita.

Jambo hili tumelipigia kelele kwa muda mrefu kwamba mambo ya dini binafsi yaamuliwe na dini husika. Sasa wajumbe wanavyojitoa ufahamu na kusahu kwamba hii sio nchi ya kiislamu, waendelee kujadili dini yao na waipitishe, ila nina apa iwapo jambo la kadhi litakuwepo, basi ni kura ya hapana kwa wakristo wote.

Mwisho, naomba wajumbe wa BMK wajadili mambo ambayo hayaamshi hisia za kidini na wajikite kwenye hoja zinazogusa watu wote, wasipofanya hivyo na wakajisahau, basi wasije wakamlaumu mtu.
