MR Aminiel Chediel Mahimbo, who claims to be the husband of Ms Josephine Mushumbusi, the woman at the centre of a marriage dispute involving Chadema Union presidential candidate, Dr Wilbrod Slaa, is today expected to file a suit at the High Court demanding 1bn/- compensation from the presidential hopeful.
Advocate Abduel Kitururu of Amicus Attorneys, told a news conference in Dar es Salaam yesterday on behalf of his client that Mr Mahimbo has not divorced his wife, but Dr Slaa "snatched Josephine from him."
Mr Kitururu said Dr Slaa and Josephine would jointly be required to pay Mr Mahimbo 1bn/- being compensation for the marriage breakdown.
We are having all relevant documents including marriage and children's birth certificates, as well as wedding photos to prove our case, Mr Kitururu said.
There are also newspapers cuttings quoting Dr Slaa as saying that Josephine is his wife," the advocate said. He further said the court would determine the final amount of compensation. "It may increase or decrease what we are demanding from Dr Slaa and Josephine," he added.
Mr Kitururu dismissed as baseless claims that he was being used by some politicians including CCM officials to frustrate Dr Slaa in his presidential campaign. He said his client had long ago planned to go to court.
"This is just a coincidence," he noted. Dr Slaa, however, told the 'Daily News' that he was not losing his sleep on such baseless negative and mud-smearing campaigns against him.
He said the objective of the suit was to derail him from concentrating on the campaign trail and blamed the ruling CCM for what he claimed to be foul play. Where do proceedings on matrimonial disputes start in accordance to the Law of Marriage Act of 1971.
Ask Mr Mahimbo, where was he when Josephine left him?" Dr Slaa queried. Mr Kitururu, however, said: We are not talking about divorce. This is purely a matter of compensation because at this point there is a breach of contract."
The Chairman of Demokrasia Makini, Mr Jimmy Obedi Mshana, said it was high time for politicians to concentrate on serious national issues instead of matrimonial affairs.
I think we have to change. Let us give more attention to development issues," Mr Mshana said. A marriage is a contract and if one party breaches it, he or she must compensate the aggrieved party," Mr Kitururu insisted.
Mr Mahimbo and his wife were married at Kijitonyamas Evangelical Lutheran Church of Tanzania in 2002. They have two daughters, according to Mr Kitururu
