Procedures for the establishment and registration of unit titles (hatua za kuanzisha na kupata hati pacha)

Unit titles (hati pacha) ni nini? 🤷‍♂️ Ni mfumo ambao mtu ‘ANAMILIKI’ sehemu au chumba (apartment au portion) kwenye jengo lenye vyumba vingi. 🏬 Jengo ni moja ila mnashare wengi, 🌆 kila mtu anamiliki portion (unit) yake kwenye hilo jengo na unapewa hati ya portion (sehemu) yako. (SIJASEMA AMEPANGA, hapa mtu anamiliki kabisa kama unavyomiliki nyumba yako mwenyewe). Tofautisha na nyumba ya kupanga 😀 vinataka kufanana ila havifanani.

Kwenye unit title unakuwa na exclusive possession / ownership kwenye unit yako kasoro zile common areas ndo mnakuwa mnachangia (I mean, hakuna mwenye exclusive possession ya common area kama ngazi, parking, bustani, n.k. hizi mnazigawana).

PROCEDURE/HATUA ZA KUANZISHA HATI PACHA

1: Apply for certificate of occupancy.

Kama unamiliki jengo lako kubwa (sio lazima iwe ghorofa 🏯 hata nyumba ya kawaida), 🏘️ na unataka kulibadilisha liwe unit titles cha kwanza lazima upewe hatimiliki ya jengo/eneo husika ✍️ (granted right of occupancy), unafata utaratibu ule ule wa kawaida wa kupata hati 📔 na zingatia masharti ya hati (mfano kabla ya kujenga utaomba building permit n.k.) conditions zingine zitakua kwenye GRO.

Lakini pia, jengo lako linatakiwa kuwa na vyumba kuanzia vitano. You cannot creat unit property below 5 units, only from five units and above - you can create unit title, hamuwezi kuwa nyumba wamegawana wawili, lazima jengo liwe na units kuanzia tano.

2: Prepare Unit Title Plan.

Ukishapata hati ya kawaida (granted right of occupancy) ndo unakuja kwenye unit title unaandaa unit plan. Unit plan ni Michoro inayoonesha mgawanyiko wa vyumba ndani ya hilo jengo.

Unit plan is a representation of whole project, divisions, number of units, common areas. Engage registered architect to prepare unit plan. Tafuta Architect akuandalie michoro.

3: Apply for registration of Unit plan.

Baada ya kuandaa unit plan (michoro) unaipeleka kwa Msajili (Registrar of titles) for registration (kusajiliwa).

Developer has to register a unit plan Developer unatakiwa sasa kwenda kusajili unit plan kupitia form UTF no. 3. Rejea section 4 ya unit Titles Act.

Kwenye kuomba kusajili michoro ambatanisha na vitu vifuatavyo:

-Original certificate of title.

-Copies of unit plan.

-Certificate from local gvt UTF no. 9D kama uthibitisho kutoka serikali za mitaa kuwa ulipewa kibali cha ujenzi. (The rationale is to confirm from local gvt that building permit was issued and to confirm that developer has complied with conditions in the building permit).

-Certificate from registered land surveyor, UTF no. 10A, so as to confirm boundaries, that a building is build/built wthin a surveyed land, surveyor aje apime kwamba jengo hili liko within surveyed land and not outside.
- Certificate from registered architect, UTF no. 10C. Tulisema plan inayo kuwa submitted for registration inaandaliwa na architect. Architect must also confirm that the plan (drawings drawn) and presented for Registration is/was prepared by professional.

4: Apply for registration of each unit (issuance of each unit title certificate).

Baada ya kusajili unit plan (michoro), developer utaenda tena kwa Msajili (Registrar of titles) kuomba hati (certificate of title) ya kila unit (chumba). Specify unit husika unazoombea hati kwa kuzipatia majina/namba husika, na kwenye application yako (ni UTF 4) ambatanisha na ramani/michoro (unit plan) yake.

Kama unit plan yako ina vyumba 100, na unataka hati za vyumba vyote 100, utaandaa michoro 100, alafu msajili atakupa hati za vyumba 100. (Kila unit/chumba kinakuwa na hati yake (separate certificate of title) ndani ya jengo moja). Na hii hati ya kila unit ina hadhi sawa na hati zingine za kawaida.

Kwa hiyo kuna hati ya jengo zima na hati za unit moja moja.

Je ukipewa hati ya unit yako unaweza kuiuza? Ndio, kwa sababu kila unit (apartment) ya jengo unayomiliki ni mali yako inayojitegemea (inasimama kama separate property) kwa hiyo unaweza kuiuza, kupangisha, kuchukulia mkopo n.k.
