Privacy Law: Mwanaasha J. Kikwete kuwashitaki NECTA?

It is sad to concede that in NECTA there is no comprehensive privacy legislation. To disclose the names and results of students NECTA go against the constitution of URT . It brings bad picture to see results of other students and a daughter of President of URT being disclosed without approval from a person concern.

Of course this does not mean that right to privacy is not recognized in Tanzania. The United Republic of Tanzania (URT) Constitution of 1977 as amended form time to times defines privacy as follows:

‘…Every person is entitled to respect and protection of his person, the privacy of his own person, his family and of his matrimonial life, and respect and protection of his residence and private communications…’

Article 16(2) goes further stipulating that:
‘…For the purpose of preserving the person’s right in accordance with this Article, the state authority shall lay down legal procedures regarding the circumstances, manner and extent to which the right to privacy, security of his person, his property and residence may be encroached upon without prejudice to the provisions of this Article…’

Article 16(1) and (2) of United Republic of Tanzania Constitution of 1977 as amended from time to time provides for right to privacy. Article 16(2) of URT constitution provides for possibility of other laws to encroach the right to privacy. The said article stipulates clearly that the law maker will enact law to stipulate how privacy right may be protected, pursued or encroached by government agents.

Mtu usome shule yenye kila kitu Feza tena bila kujua kitu kwenda shule bila kunywa hata uji na kupigwa umande ndio ndoto kabisaaaa miguuni halafu bado mtoto wa bado unafeli sawa hawa wetu wa shule za chini-ya-mti vijijini!!!!!!
 
I am not a lawyer by profession but just by using commonsence I beg to dis agree with you, Firstly, why should that rise after the JK's daughter name appeared in the newspapers with poor results? how if she had got div 1?

secondly, let that be the challenge for other secondary school students. Knowing that results will be displayed in papers will push them strive hard to get good results.

Pengine mtoa mada alimaanisha kuwa badala ya kuanika majina, wangeweka namba tu za mitihani ya watahiniwa! S/he might have a point here tusimpuuze. Unless tuseme sheria hiyo aloiweka hapo haiwahusu wanafunzi wa shule (ambao kama watoto, consent yao ingepaswa kutolewa na wazazi/walezi wao)
 
Sidhani kama hapa kuna kuvunjika kwa privacy ya mtu
Kama ingelikuwa ni yeye mwenyewe tuu jina lake limetolewa na wengine yakafichwa na watu wakaenda kulitafuta may be huko shuleni kwao na akaja kuliweka hapa ingekuwa kweli kuna kuingilia privacy ya mtu
hapa ni majina ya wanafunzi wote wa tanzania waliofanya mtihani huo wamewekwa majina yao kwenye mtandao
Ingelikuwa ni kuingilia uhuru wa mtu wanafunzi wote wangeishtaki NECTA kwa kuwaanika majina yao na matokeo yao
So hicho kifungu ulichotoa hapo juu sidhani kama kinaaply hapa kuwa huyo mtoto NECTA imeingilia uhuru wake
 
Wrong definition of Law!

One of the key subject functions of the NECTA is to disclose the names and results of students!

Haven't you found in this thread, a place to squeeeze your religious segregation mr MS?
