The former Director-General of the Tanzania Harbours Authority, Mr Samson Luhigo, was a lone warrior in all this, and he is on record to have openly � and strongly � criticized TICTS' performance.

Mr Luhigo questioned the efficiency of the private operator publicly before former President Mkapa.

''A year before privatization of the container terminal in 1999/2000, profit after tax was close to 10bn/-, a year after privatization in 2000/01 it went down to 4bn/-. The 2001/02 accounts which have been submitted to auditors point to an all-time low revenue of 0.04bn/-,'' Mr Luhigo had declared before the former president.

LAST week I wrote praising my clan elder brother Andrew John Mwinula Chenge, for standing by his words that he would never resign because of allegations that his clean hands were involved in the radar scandal.

I was very happy when he told reporters that their shouts for his resignation would never bear fruits. I told my fellow Tanzanians that those who were forcing my bro to bow out were envious for his tangible development here and abroad.

That they were envying him for the achievements he had obtained in 30 years he was in the government circles. That at his age he is having a beautiful wife who is flourishing in business. Has kids studying abroad, while the younger ones are schooling at posh schools in the Haven of Peace.

That he drives luxury cars and more; and he has a chain of high class houses here and abroad.
It is only greed of some Tanzanians, especially reporters and hypocrite legislators who were shouting that Chenge should resign and give room to the local PCCB and Serious Fraud Office (SFO) in the UK to smear mud on him.

However, my happiness didn't last long as in the past week, to my shock, I heard that Chenge had finally decided to throw in the towel and resign.

I wondered how a man of action, a Sukuma gentleman can easily bow out and leave the decorated chair so close to the throne of His Highness, our beloved JK.

Why did Chenge do that and why had he to give in just because some greedy fellow Tanzanians were making such allegations?

Chenge should have thought twice before he resigned. He should retract that resignation letter from Kikwete's desk.

You know what, that action of resigning has belittled his status. A man who wears well designed suits, shoes, specs and what not.

With the vijisenti, some 1.2bn/-, Chenge should not have resigned the way he did as he had the financial muscle to keep his position and wall head-high without any fear.

This is Tanzania (TIT) brother Chenge. You can do anything and drive anyone as far as you have the money and position.

What you should have done to those reporters with their pens and some high-ranking legislators was to grease their hands.

Brother Chenge, in Bondoland, giving out huge tips means no one would dare talk negatively about your good name.

Brother Chenge, you must understand that it's only greasing hands that would have rescued yourself. There is no doubt about that; for hand greasing is 'modus operandi' or 'modus vivendi', a way to operate or to life in Bongoland.

Most of those who were forcing Chenge to resign are the ones in love with hand-greasing; which they do behind the curtains, although in public they pretend to hate such strategic living. Shame on such Bongolanders!

When people in Tanzania blame the legacy of hand greasing, most of them take it as a personal attack; forgetting that it is a system that has direction, though it's simply rotten.

I do remember the other day when Mwalimu Julius Nyerere (RIP) was crying for his Tanzania. He said he was not prepared to see the dogs ( opposition) taking over the country. Now after his death, it is not the dogs out there that are dragging the country to the unfathomable abyss.

The legacy of hand greasing is very real as bunches of goons and thugs out there are pretending to work for us, while they are grabbing every single sent for their benefit. Full stop.

Where is that honest and democratic leader? I cry for you, Tanzania, my beloved country! Do something soon to avert an early grave for your people.

EDITORIAL: Ex-president Mkapa has a case to answer

PRESSURE is mounting now within the National Assembly for an official investigation against Benjamin Mkapa who is accused of serious allegations of corruption and abuse of office during his tenure as president of the United Republic of Tanzania.

The ex-president has opted to keep mum even after new demands are being made by legislators for an official corruption inquiry against him and his former energy and minerals minister, Daniel Yona.

The two public officials were allegedly involved in the dubiously-conducted privatization and buy-out of the formerly state-owned Kiwira Coal Mine in Mbeya Region at a ridiculously cheap price of 700m/-.

These allegations on the part of the former president must not be ignored for the sake of the future of the country. Instead, they should be determined through the forthright and rigorous application of the relevant provisions of the laws of the land.

The aim should be to put to an end the corrupt culture of political leaders who use politics as a tool of accumulation of wealth without any regard to the majority Tanzanians who are languishing in abject poverty.

The state-run Prevention and Combating of Corruption Bureau (PCCB) has already suggested that retired presidents are immune from criminal investigation and prosecution.

However, lawyers and constitutional experts are of general shared opinion that former presidents do not have any legal protection against official investigations into illegal activities they may have committed in their personal capacity while holding the presidency.

It is true that retired presidents do enjoy some degree of immunity from prosecution for possible offences committed in the course of executing their official duties, but they must answer for crimes committed in their personal capacities.

It must be understood that retired presidents are not immune from investigation and prosecution when it comes to theft, corruption or other outright criminal charges.

Furthermore, article 46 of the Constitution only prohibits criminal charges being brought against an incumbent head of state, but says nothing about retired presidents, hence leaving the door open for their possible prosecution.

Investigations by this paper have established that by virtue of their positions in government in 2005, Mkapa(as president) and Yona (as minister for energy and minerals) jointly supervised the Kiwira coal mine ’fast track’ privatization process, and oversaw the sale of majority shares in the mine to a newly-formed private company in which both of them had extensive shareholding interest.

New evidence has also surfaced suggesting that Mkapa and Yona may have broken several laws, including the Public Leadership Code of Ethics Act of 1995, in their conduct over the Kiwira Coal mine privatization saga.

According to the ethics legislation, a public leader shall be considered to have breached the Act if he or she acquires any significant financial advantage, or assists another person to acquire such gain, by ’’improperly using or benefiting from information which is obtained in the course of his/her official duties and which is not generally available to the public.’’
