Hitaji la katiba mpya linazidi kujitokeza katika hukumu hii kuwa amri ya rais haiwezi kuhojiwa mahakamani

Serikali sikivu itekeleze hukumu hii yenye utata kuhusu ukuu na umungu-mtu wa rais wa Jamhuri ya Muungano wa Tanzania katika katiba iliyopo.

Based on the authorities herein above, the remedy is to return the matter to the authority, (the Minister) so that can comply with the law by conducting the consultation.

Now that the land has already been upgraded by a person higher than the Minister, and the order of the Minister has been impliedly repealed by the order of the President, and the order of the President is not the subject of these proceedings at the moment, then I find the order for certiorari against non-existing Government Notice No. 421 of 2022 to be just an academic exercise for we cannot return it to the Minister to follow the procedure while the land has already been declared the Game Reserve.

As it is common knowledge that the Minister cannot invalidate the decisions of the President. If still interested, the applicants may challenge the existing order which is Pololeti Game Reserve, GN. 604 of 2022which repealed the Wildlife Conservation (Pololeti Game Controlled Area) (Declaration) Order GN. No. 604 of 2022.

It is accordingly ordered.

WananchiI wa vijiji Sita wilayani Shinyanga ambao wamevamia eneo la Hifadhi ya Msitu wa Nindo wilayani humo, wamemuomba Rais Samia, awaache waendelee kuishi kwenye hifadhi hiyo, kutokana na eneo ambalo wamemegewa kuishi ndani ya hifadhi wamedai ni finyu sababu kuna watu tayari wanaishi.

Hifadhi ya Msitu wa Nindo wilayani Shinyanga, ilitambuliwa kisheria na kutangazwa na gazeti la Serikali Namba 10 mwaka 1958, ikiwa na ukubwa wa Hekta 27,446, lakini baada ya wananchi kuvamia na kuishi kwenye eneo hilo la hifadhi limesalia hekta 10,969, ambapo Serikali ikaona Hekta 3,726 iwamegee wananchi ili waishi, na Hekta 7,243 zibaki kwa ajili ya hifadhi.

Wamebainisha hayo kwenye Mkutano wa hadhara wenye ajenda ya kumuomba Rais Samia awaache waendelee kuishi ndani ya hifadhi hiyo na kuahidi kulinda vyanzo ya maji na kuulinda msitu huo.

Peter Buhemba ni mkazi wa kijiji cha Ng’homango, amesema wanamshukuru Rais Samia kwa kuwatengea eneo la Makazi ndani ya hifadhi hiyo, lakini eneo hilo bado haliwatoshi sababu kuna watu tayari wanaishi na wanamiliki mashamba, hivyo hofu yao ni kutokea Migogoro ya ardhi na hata kukosa maeneo ya kufanya shughuli za kilimo na ufugaji.
