Star TV na ITV kujitoa rasmi Startimes muda si mrefu!

Mamlaka ya Mawasiliano Tanzania (TCRA) itatoa Taarifa na Tamko la Kidhibiti (Regulatory Order) saa saba mchana Kwa saa za Africa Mashariki.

Aidha hakuna ukweli kwamba ITV na Watoa huduma wengine Wa Maudhui wanakusudia kujitoa katika Platform ya Star Media Tanzania Limited.

Hivi sasa kikao kinaendelea Kati ya Mamlaka na Watoa Huduma hao wawil na Maamuzi ya TCRA yatatangazwa saa saba mchana mbele ya vyombo vya Habari Mawasiliano Towers.

Ni vizuri kuuelewa mfumo mpya Wa Utangazaji, Sheria na Kanuni zake badala ya kutoa kauli ambazo sio za ukweli na zenye nia ya kupotosha umma. Free to Air Channel zote ni Must Carry Kwa Multplex Operator Wote, yaani Agape Associates, Basic Transmission na Star Media Tanzania Limited Kwa mujibu Wa Sheria ya EPOCA, 2010 na Kanuni zake za 2011 kama ilivyoainishwa.

Kwa taarifa na Maelezo zaidi soma Sheia hiyo na Kanuni zake katika website ya TCRA www.tcra.go.tz.
TCRA katika orodha yako ya watoa huduma sijaona jina la watoa huduma wa Intercontinental (Star TV)

Ina maana hao watu hamuwatambui kama watoa huduma ndio maana huja orodhesha jina lao?!

Taarifa kwa vyombo vya habari kuhusu Star TV kujiondoa Star Times.
Tarehe 23 Mei 2013 Star TV kupitia mwanasheria wake iliwataka Star-Times kuiondoa kwenye king’amuzi chao ifikapo saa sita usiku wa tarehe 31Mei kutokana na kurusha na kuuza maudhui na vipindi vyake bila idhini na kukiuka sheria za haki miliki (Copyright laws).
Katika barua hiyo Star TV iliwakumbusha Star Times kwamba hawakuwa na mkataba wa kurusha kituo hicho kwa mujibu wa sheria ya Mawasiliano EPOCA pia hawana haki ya kutumia maudhui yake bila idhini chini ya sheria ya haki miliki ya Tanzania na Kimataifa.
Tarehe 31 Mei 2013 Star Times/Star Media walijibu na kudai kwamba hawajakiuka sheria yoyote wakasisitiza wataendelea kuirusha Star TV kutekeleza matakwa ya sheria ya EPOCA na kanuni zake.
Tarehe 6 Juni, 2013 Star TV iliwaandikia tena Star Times ikisisitiza nia yake ya kuchukua hatua zaidi kutokana na wao kuendelea kukaidi ombi hilo na kuainisha mapungufu kadhaa ya kisheria kwa upande wao yanayoifanya Star TV ijiondoe kwenye king’amuzi chao ifikapo saa sita usiku wa tarehe 08 Juni, 20013.
Star TV Ilieleza Star Media (T) Ltd. ambayo inamilikiwa kwa pamoja na Star Times na TBC ina leseni ya miundo mbinu ya kurusha matangazo ya Televisheni kupitia mfumo wa DTT (Multiplex Operator License). Leseni hiyo inawaruhusu kuingia makubaliano (Service Level Agreement-SLA) na vituo mbalimbali kuwarushia matangazo yao lakini Star-Times hawana leseni ya kutoa huduma ya maudhui (Content Service Provider License-CSP).
Star Times ni kampuni ya kimataifa iliyoandikishwa (China) inayotoa huduma ya maudhui katika nchi mbalimbali za Afrika ikiwemo Tanzania. Ili kupata maudhui inalazimika kuingia mikataba na vituo vya televisheni kabla ya kuviingiza kwenye king’amuzi chake na baadaye kuuza maudhui hayo (subscription/Pay TV) kwa walaji katika mataifa hayo.
Star Times inachukua vituo vya TV ikiwemo Star TV bila idhini yao na kuviweka kwenye king’amuzi chake kwa kisingizio kwamba wanaruhusiwa na sheria ya EPOCA na Kanuni zake. Sheria hiyo inasisitiza juu ya kuwepo kwa mkataba wa makubaliano (SLA) kati ya pande mbili husika.

Kwamba maudhui ya TV za Tanzania yanauzwa kwa walaji katika nchi nyingine kama vile Rwanda, Burundi, Kenya, Uganda, Nigeria na nyinginezo bila idhini ya wamiliki wake. TV zinazomiliki maudhui hapa nchini hazina uwezo wa kuidhibiti Star Times isirushe maudhui yao nje ya Tanzania kwa kuwa baadhi ya maudhui wanayoyanunua nje kama vile tamthilia na vipindi vingineyo haviruhusiwi na watunzi au wasambazaji wake yarushwe nje ya Tanzania (Territorial Rights).
Lakini pia uhusiano wa makampuni haya mawili Star Media (T) Ltd na kampuni ya Star Times ambayo ni ya China yenye matawi katika nchi nyingi za Afrika katika uendeshaji wa matangazo ya Dijitali haujabainishwa vizuri ili kujua nani ni nani na nini anachofanya hapa Tanzania katika misingi ya maelewano ya kibiashara.
Ni kutokana na mantiki ya hoja hizo Star Times waliondoa mara moja Star TV kwenye king’amuzi chao tarehe 08 June 13 kama walivyoelekezwa na Star TV.
Star TV haioni sababu ya kulazimishwa na TCRA kurushwa na Star Times pasipo kuondoa hitilafu hizo za kisheria na bila kuangalia sheria nyingine zinazolinda haki za TV huru kama sheria ya haki miliki na sheria ya ushindani katika soko moja. TCRA kwa kutozingatia hili, inajifanya mmiliki wa sharia hata zisizokuwa chini ya mamlaka yao (supra organ!)
Insert: Serikali ya Tanzania ni mwanachama wa WTO na pia WIPO (World Intellectual Property Rights Organization) na hivyo kwa kulazimisha uvunjaji wa sheria za hati miliki ina maana inavunja haki zetu zilizopo kikatiba! Tutakwenda mahakamani kupata haki yetu hii muhimu.
Sheria hii inaweka kinga kwa vipindi vya radio, television, nyimbo na sanaa zote, kwa kutaka kulazimisha Star-times kupora vipindi vya Star- Tv inadhihirisha kilio cha wasanii wa Tanzania wasivyolindwa na serikali yake.
Taarifa iliyotolewa magazetini na Meneja Mawasiliano wa TCRA Innocent Mungy kwamba chaneli tano za kitaifa lazima zirushwe na ving’amuzi vyote bure ni za kupotosha kwa kuwa hata hiyo Star Times haizirushi bure imekuwa ikibadilika badilika kama kinyonga. Lakini makampuni ya kigeni kama vile Dstv, na Zuku wao hawarushi matangazo ya TV nyingine bila makubaliano yanayotambulika kisheria.
Hata hivyo Vituo vikubwa vya TV vikiwemo Star TV, ITV, Channel 10 na TBC na vinginevyo visivyo vya kitaifa vinarushwa na makampuni ya BTL na TIN bila malipo yoyote ya mwezi na kwa ubora zaidi kuliko Star Times lakini inashangaza kuona TCRA inawakingia kifua Star Times wanaowalipisha watanzania badala ya kutetea vituo vya ndani visivyotoza chochote.
Star TV inaamini kwamba kazi ya usimamimizi au tuseme urefa wa matangazo ya TV inayofanywa na TCRA haipashwi kupendelea upande wowote na haipashwi kuingilia masuala ya kibiashara kuilinda Star Times kwa kuwa sio jukumu lao. Kwa mfano, Star TV na TV nyinginezo nchini zilizimiwa matangazo yao ya analojia na TCRA ili kuwalazimisha waingie Star Times na pia kuwalazimisha waTanzania wanunue ving’amuzi vya Star-Times bila dhana nzima ya ushindani, watake wasitake hawakuwa na njia nyingine ya kuonyesha matangazo yao.
Sasa miundo mbinu ya humu nchini imejengwa na kampuni za kizalendo kwa

gharama kubwa na kwa ubora zaidi kuliko Star-Times. Sasa ushindani umewaelemea Star-Times, hivyo TCRA inajaribu kuwasaidia tena. Hili halikubaliki na tupo tayari kuwaonyesha watanzania matumizi mabaya ya chombo hiki kwa maslahi ya wageni na watu wachache wasio waaminifu kwa nchi yao.
Pamoja na kazi ngumu ya kujenga miundo mbinu ya DTT ambayo imewakamua wawekezaji wa Kitanzania, Mkurugenzi wa TCRA hajawahi kuwatembelea kuwatia moyo. Star TV inapinga kwa nguvu zote TCRA kufanya usimamizi kwa mtizamo wa kibiashara kwa kujaribu kuwasaidia Star-Times ambao, nia yao ni kupata bure matangazo yanayotayarishwa kwa gharama kubwa na vituo vya Tanzania na kuhodhi urushaji wa maudhui ya TV za humu nchini kupitia DTT kwa faida yao. Kimsingi Star-Times ni TV ya kigeni na kwa mujibu wa sheria mpya ya EPOCA haistahili kupewa leseni ya ndani ya maudhui kushindana kama local TV.
Hata hivyo, kama inadaiwa kwamba Star Media (T) Ltd na Star Times ni kitu kimoja basi kampuni zote mbili zinafanya kazi kinyume cha sheria ya EPOCA na kanuni zake ambayo kwa mujibu wa kifungu cha 12(h) kinaonyesha jinsi mwenye leseni ya miundo mbinu (Multiplex) anavyotakiwa kutekeleza majukumu yake. Kinasema: “Multiplex Operator hataruhusiwa kurusha maudhui yake mwenyewe, vituo vyake vya TV au kifurushi chenye maudhui yake (Bouquet)”.
Kwa hiyo Star TV haiko tayari kujihusisha na Star-Times au kufanya biashara na chombo chochote ambacho mwenendo wake wa kibiashara haufuati matakwa ya sheria. Pia, Star-TV haikubali kusukumwa kwenye makubaliano ya kibiashara kwa matumizi ya nguvu na tafsiri potofu ya sheria zetu. Hii ni kugombanisha watanzania kwa kutumia sheria zao wenyewe zinazotafsiriwa vibaya kukidhi tama ya watu wachache waovu hapo TCRA.

COMPLIANCE ORDER

Communications Regulatory Authority Act, Cap. 172 of the Laws of Tanzania as amended by Section 179 of the Electronic and Postal Communications Act, Cap. 306 of the Laws of Tanzania)

WHEREAS:
A. On 8th June, 2010 the Tanzania Communications Regulatory Authority
(herein after referred to as “the AUTHORITY”) issued to Star Media (Tanzania) Limited (herein after referred to as “the LICENSEE”) Network Facilities License (herein after referred to as the “LICENCE”) for provision of signal transmission services (herein after referred to as “the SERVICES”), and was assigned frequencies for provision of the Licensed services, and;

B. Under the LICENCE the LICENSEE is obliged to ensure that all free to air channels are accessible without any subscription fees on any digital platform through an integrated digital television or a set top box;

C. On the 9th day of June, 2013 the AUTHORITY apprehended that the LICENSEE had removed from its digital platform the free to air signals of Star Television (herein after referred to as the “CONTENT SERVICE PROVIDER”);

NOW THEREFORE the AUTHORITY does hereby:

1. DECLARE that the LICENSEE’S removal from the digital platform of the free to air signals of the CONTENT SERVICE PROVIDER contravenes the must carry obligation of the LICENSEE as prescribed under Regulation 14(2)(a) and availability of services obligation as prescribed under Regulation 13(2)(h) of the Electronic and Postal Communications (Digital and Other Broadcasting Networks) Regulations, G.N. Number 418 of 2011; all of which amount to breach of license obligation;

2. ORDER the LICENSEE to resume the must carry obligation and re-instate in the digital platform the free to air signals of the CONTENT SERVICE PROVIDER by this 10th day of June, 2013 before 4.00 p.m.;

3. ORDER the LICENSEE to appear before the AUTHORITY on Monday 17th June, 2013 at 10.00 a.m. to show cause why legal and regulatory actions should not be taken against it for abdicating its must carry obligation, thus contravening Regulations 14(2)(a) and 13(2)(h) of the Electronic and Postal Communications (Digital and Other Broadcasting Networks) Regulations, G.N. Number 418 of 2011.

Should the Licensee fail, neglect or refuse to comply with this Order, the Authority will proceed to take legal and regulatory actions without any further notice and at the Licensee’s own risk as to costs and consequences of the legal and regulatory actions.

A. On 16th June, 2000 the Tanzania Communications Regulatory Authority
(herein after referred to as “the AUTHORITY”) issued to Star Television (herein after referred to as “the LICENCEE”) a Content Services (TV) Licence (herein after referred to as the “LICENCE”) for provision of television content services (herein after referred to as “the SERVICES”), and;

B. Under the LICENCE the LICENSEE is prohibited from intentionally interrupting or suspending the operation of the licensed system and services in the normal course of business without having first notified the AUTHORITY in writing and having provided reasonable advance notice to persons affected or likely to be affected by such interruption or suspension;
C. On the 9th day of June, 2013 the AUTHORITY apprehended that the LICENSEE had instructed Star Media (Tanzania) Limited (herein after referred to as the “MULTIPLEX OPERATOR”) to remove from its digital platform the free to air signals of Star Television;

NOW THEREFORE the AUTHORITY does hereby:

1. DECLARE that the LICENSEE’S withdrawal of its free to air signals from the digital platform of the MULTIPLEX OPERATOR amounts to intentionally interrupting or suspending the operation of the licensed system and services in the normal course of business without having first notified the AUTHORITY in writing and having provided reasonable advance notice to persons affected or likely to be affected by such interruption or suspension contrary to the provisions of Regulation 19(1) of the Electronic and Postal Communications (Digital and Other Broadcasting Networks) Regulations, G.N. Number 418 of 2011 and is also a breach of the quality of service as enshrined under Regulation 13(2)(h) of the same G.N. Number 418 of 2011 as regards availability of services, all of which amount to breach of license obligation;

2. ORDER the LICENSEE to re-instate transmission of its free to air signals through the MULTIPLEX OPERATOR by this 10th day of June, 2013 before 4.00 p.m.;

3. ORDER the LICENSEE to appear before the AUTHORITY on Monday 17th June, 2013 at 11.00 a.m. to show cause why legal and regulatory actions should not be taken against it for abdicating its obligation, thus contravening
the provisions of Regulations 19(1) and 13(2)(h) of the Electronic and Postal Communications (Digital and Other Broadcasting Networks) Regulations, G.N. Number 418 of 2011.

Should the Licensee fail, neglect or refuse to comply with this Order, the Authority will proceed to take legal and regulatory actions without any further notice and at the Licensee’s own risk as to costs and consequences of the legal and regulatory actions.
 
TRCA MPOOOOO? Kama ilivyo ada, taasisi zetu zina tabia ya kuyabeba makampuni ya kigeni kwasababu wanapata chochote! Haya Star TV imetunisha misuli na tunaitaka iendelee na uzi huo huo ili tuone ubabe wenu TCRA!

Mnatoa agizo kwa STAR TV lakini Star times mnaichekelea tu. Ifikie watanzanie tuwe na msimamo kwasababu mitambo iliyofungwa na Star TV imegharimu fedha na haikununuliwa kwa njugu! Watanzania tuko nyuma ya starTV na sidhani kama mna ubavu wa kuifungia!

Number 418 of 2011 and is also a breach of the quality of service as enshrined under Regulation 13(2)(h) of the same G.N. Number 418 of 2011 as regards availability of services, all of which amount to breach of license obligation;

the provisions of Regulations 19(1) and 13(2)(h) of the Electronic and Postal Communications (Digital and Other Broadcasting Networks) Regulations, G.N. Number 418 of 2011.

Duh, sasa waweza kuibuka mvutano kati ya TCRA,StarTV & Sar Times, huku akitafutwa mbabe!

Nashauri hata kama mvutano unatokea, basi uwe wa kufikia suluhu ili mwananchi aendelee kuhabarika.
 
Tangu mwanzo wananchi wengi tulitilia mashaka msukumo wa TCRA kufunga matangazo ya analojia na kulazimisha matangazo ya digiti wakati bado hakukuwa na miundombinu toshelezi.

Wakatulazimisha kununua visimbusi vya startimes ambavyo muda mwingi vimekuwa vikitusumbua pamoja na kulipia lakini hatupati matangazo yenye ubora. TCRA tulipowaambia kuwa matangazo ya Starttimes hayana ubora bado wakawatetea.

Pamoja na kuwa nitaikosa startv kwa kujiondoa startimes lakini kwakweli ninawaunga mkono mia kwa mia katika madai yao. Barua yao nimeisoma nimeona ina mambo mengi ya msingi ambayo yanatakiwa kuzingatiwa kwa ajili ya kuweka mazingira sawa ya ushindaji wa kibiashara na kuhakikisha kuwa watanzania tunapata huduma bora za matangazo ya tv.
 
Tunawahudumua wananchi Wa Tanzania kwa mujibu wa sheria na kanuni pamoja na matakwa ya leseni walizopewa Star TV na Star Media. Leseni zina masharti na ndio hayo maamuzi. Sheria yenyewe iko kwa kiingereza na Complience Order iliyotolewa itatafsiriwa hivi punde.
 
Ndugu TCRA kwanini usitoe tamko kwa lugha yetu ya Taifa? kwanini watumishi wa serikali yetu mnapenda kuwa watumwa wa lugha ya wenyewe hata pale mnapowasiliana na watanzania wenzenu? au wachina wa startimes wamekushikia bakora ndio ukaamua kutuwekea bandiko lisiloweza kueleweka vizuri kwa walengwa!?

lakin star tv walikuwa wapi kpnd chte hicho? Had wajitoe ss hv wakati ambao kisimbuzi chao kimeshaanza kufanya kazi? Au ni njia ya kujiongezea mapato kwa kutulazimisha tununue kisimbuzi chao? Nimechukia sna kuzkosa taarfa za habar za BBC znazorushwa na Star tv
 
Miundombinu inahusiana vipi na uvunjaji Wa Sheria na Kanuni za Leseni za Utangazaji? Mitambo ya Analojia imezimwa tu pale kwenye digitali, miji 7 tu iliyokuwa asilima 24 tu ya matangazo. Bado 75% ya matangazo ya TV tanzania yanapatikana Kwa njia ya Satelite na Cable.
 
Ee Bwanae, Tumefika hapa kwa sababu "Refa kashindwa kazi, kavaa jezi na kuwa wa 12 katika moja ya timu zinazokinzana" Star TV wamewaambia waandishi wa habari leo.

"Uliza ni watumishi wangapi wa TCRA wameenda kutembelea makao Makuu ya Star Media huko China, na hata wengine hawajarudi'' ASmewaambia msemaji wa Star TV akiongea na Waandishi wa Habari leo wakati akijibu kinachoonekana kama mapigo.
 
TRCA MPOOOOO? Kama ilivyo ada, taasisi zetu zina tabia ya kuyabeba makampuni ya kigeni kwasababu wanapata chochote! Haya Star TV imetunisha misuli na tunaitaka iendelee na uzi huo huo ili tuone ubabe wenu TCRA!

Mnatoa agizo kwa STAR TV lakini Star times mnaichekelea tu. Ifikie watanzanie tuwe na msimamo kwasababu mitambo iliyofungwa na Star TV imegharimu fedha na haikununuliwa kwa njugu! Watanzania tuko nyuma ya starTV na sidhani kama mna ubavu wa kuifungia!

Kwa namna hawa wachina wanavyobebwa kwa mbeleko ya chuma na hawa TCRA, sina shaka kwamba iko namna hapo hata kama si mke wa kigogo kuwemo humo star media lakini dalili zote ziko wazi kuwa kuna upendeleo na kuwalazimisha watanzania kutumia huduma za startimes ambazo kiukweli ni za kiwango duni sana pamojja na kuwa ni kampuni ya kimataifa.

Mkuu TCRA kwanini mnaitetea sana startimes kwa nguvu nyingi kiasi hiki? mna mmaslahi gani binafsi na hao wachina?
Unazungumzia startv kuvunja sheria lakini hauzungumzii stsrtimes wanavyovunja sheria? kwanini hamuwachukulii hatua yoyote hao wachina kwa kutoweza kufikisha matangazo yao kwa ukamilifu na ubora unaotakiwa kwa wateja wake? tumekuwa tukiwaandikia malalamiko yetu juu ya huduma mbovu za startimes laki i mara zote mmekuwa watetezi wao kwanini mara hii mnajifanya kuwa wakali kwa startv? au kwakuwa startv ni ya wawekezaji watanzania na ninyi huko serikalini mnapenda sana kuwalamba miguu wawekezaji wa kigeni.

Safi sana TCRA watanzania tumeona juhudi zenu,lakini mpak mda huu sioni Star TV kwenye king'amuzi kama wakigoma futeni leseni yao! Kwan kwenye hyo continental kwan kuna chnl yao tu? Kama kuna mgogoro wa kibiashara kwann wasingewatarifu nyinyi direct?
