Elections 2010 Kikwete akatisha kampeni na kurejea Dar

Nadhani ungetwanga kwa kiswahili ili adhira kubwa ya Chadema humu JF ielewe.

Hao hawaelewi hata kwa lugha za kikwao. Wanajidanganya wameshinda. hahahahaha. Ajabu kweli, tangu lini mtu akashinda kwa kujadili mambo ya watu binafsi???? Wanampotosha Dr. nae sijui kwa nini amekubali kuingia kwenye non-issues.
 
Kikwete alitoa ahadi katika capacity yake ya kiraisi akitekeleza kazi za serikali, kuunganisha kazi za serikali na ugombea urais wa chama itakuwa kitu kigumu sana hapo.

Tatizo ni kwamba Kikwete sasa hivi anazunguka kama mgombea urais na iko wazi kwamba yuko kwenye mikutano ya kampeni. Kutumia mikutano ya Kampeni kutoa ahadi na baadaye aseme naombeni kura, hilo ni kosa.

Kabla ya kipindi cha kampeni alikuwa wapi kuzunguka kutoa ahadi akiwa kama Rais? Kwanini asubiri kutoa ahadi wakati huu wa Kampeni?

Nyanza wanadaiwa bilioni 5, anasema serikali italipa. Kwanza hii siyo ahadi tu, bali impliedly ni hongo kwa wakulima kwa kuwa wakulima wamekuwa wakikatwa hela nyingi ili kulipa hilo deni la Nyanza, so serikali ikilipa wananchi hawatakatwa tena hela kwenye bei ya pamba.

Pili, deni la Nyanza ni la muda mrefu, kwanini hakutoa ahadi ya kulipa deni hilo 2 or 3 yrs ago?

Opinions as to why Presidents Jakaya Kikwete shouldn't be accused of breaking the Election Expenses Act by announcing the status of the decision of the Government to increase the salaries of its workers. These are just someone's opinions; it shouldn't be taken as the ultimate.

21.-(1) during the nomination process, election campaign or election, an act of prohibited practice shall be committed by-(a)every person who, before or during the campaigns period, directly or indirectly, by any other person on his behalf gives ,lends or agrees to give or to lend, or offers, promises, or promises to procure or to endeavor to procure, any money or valuable consideration to or for any voter or to or for any person on behalf of any voter or to or to refrain from voting, or corruptly does any such act, on account of such voter having voted or refrained from voting at any nomination process or election;The section of the law is overt:

• Every person, voter-The government is neither a person nor a voter.• During nomination, election campaigns-In any way The Government doesn't seek for nomination, that act is exercised by party members in their parties.• In order to induce any voter to vote or to refrain from voting- The Government has a constitutional responsibility to pay salaries to its employees/workers and increase/decrease them whenever possible/affordable (by so doing The Government doesn't seek to induce any voter to vote or refrain from voting because it is their rights, neither any worker has no right to claim for salary increment in order to vote or refrain from voting; (as according to the Trade Union law).• Or corruptly does any such act- By paying/giving/increasing salaries to its workers/employees, The Government exercises its constitutional responsibility hence it can never be considered as a corrupt act.• Any money or valuable consideration- HE. Jakaya Kikwete as a Presidential candidate has not been accused to being caught giving money to any person inducing him/her to vote for him or for his party, rather (and mostly as the Head of Government; it is very difficult to distinguish the two titles in campaign elections)has been explaining the matters raised by the people to his Government, normally the matters which affects their daily lives including the issues of low/inadequate salaries, building of hospitals, construction of roads, bridges etc, which he has been explaining and announcing the statuses of each. This is his obligation as the Head of Government.• By this law/this section of the act, basing on the actuality that the Government is not a person or voter, then The Government has not been prohibited to discuss/agree/disagree/sign/announce/explain any matters or even praise itself for its act of doing something beneficial to citizens/country (including increment of salaries to its workers), rather The Government is obliged to continue to practice its day to day constitutional responsibilities regardless it is doing so in election year/period or not.• Addition: The President as Head of Government has moral and constitutional obligation to explain to the citizens the acts of the Government including provision of answers to their questions/claims all the time during the period of his/her presidency. In any phrase of this section the law doesn't prohibit or set the time limit for the Head of Government to do so


Na mimi nilijibu kwa hoja zifuatazo:

the question here is did BUNGE approved any salary increment before being disolved? the answer is no, then where did the government get an authority to increase the salary without BUNGE approval? however President JK admitted the gov......ernment was unable to increase the salary in the near future and in his speech admitted he rather loose workers vote rather than increasing their salary, despite several presure from TUCTA he was reluctunt to increase the salary, but the President was under intense presure from CHADEMA when Dr. Slaa appealed to workers that he need their vote if JK does not need them, thus the government wanted to reconcile and correct their mistake by increasing the salary silently so as to cool workers and an attempt on pandering to their vote,

but the procedure were not properly followed as i have explained earier because Bunge had been dissolved already and the past bunge budget did not approve or discuss any salary increament as presented by minister for finance Mustafa Mkulo, so what CHADEMA is objecting why should the government do it now? and The president use it in his campaign? while he refused to do the same thing before campaign?

It is obvious the government has not only violated and breached election expenses act of 2010 but also did not follow proper procedure because they were in hurry to get a talking point on workers welfare which the government failed to handle the matter professionally when they were supposed to do so.......................

The act of the government under such circumstance shows their intensions to buy workers vote after so much pressure from TUCTA and wananchi. However CHADEMA is demanding to know whether the fund used to increase workers salary during campaign was JK personal fund or from public fund? and if from public fund, there is some procedures stipulated by our constitution to increase workers salary?................

Moreover, if there is no clear dermacation in the constitution when the sitting president assumes his presidential role and when may act as mare CCM Candidate for presidency, dont you see that JK has a comparative advantage to use his presidential power for his own or his party benefit? and the election expenses act of 2010 will never apply to the sitting presidence?...................................................
If the sitting president has a comparative advantage to use his role as the head of government in a political compaign do you think the whole election process will be democratic, free and fair

According to Tz constitution, Parliament has two part, MP and President, president by him self is a parliament and has power to do parlimentary decision for the betterment of the Nation. Unaweza kusoma sheria lakini usijue tafsiri ya sheria, Na hili ndilo linalotokea, na kwa kweli ccm wanapangua pingamizi hilo la kitoto, na watamuaibisha Dr. kukubali kupeleka pingamizi sehemu husika. Unajua JK kama Rais, anapokuwa kwenye campain lazima atoe ripoti kwa waajiri wake ambao ni wananchi, sasa hawezi kusema siwezi kusema mambo yakuongeza mishahara kwa kua chadema wataniwekea pingamizi, akifanya hivyo maana yake Chadema ndo wanaoongoza nchi . Kwa hili chadema mmechemka. Hata chadema wakiwa madarakani watafanya kama anavyofanya JK.

Kwa kifupi ni kwamba, sheria mpya ya gharama za uchaguzi ina mapengo mengi yanayoweza kumfanya Kikwete atumie udhuru wake wa kirais, kwamba rais anapokuwa amefanya jambo katika shughuli zake za urais, basi hashitakiki wala kupatikana na makosa mpaka avuliwe madaraka ya urais kwanza.

Kikwete anaweza kujitetea kwamba alitoa ahadi za mishahara kwa wafanyakazi katika nafasi yake kama rais, na wala si kama mgombea wa urais, na hivyo kumpata na makosa itabidi kwanza avuliwe madaraka ya urais.

Hili jambo hata likipelekwa mahakamani, kwamba iamuliwe kama Kikwete avuliwe urais ili aangaliwe kama alivyotoa ahadi za nyongeza za mishahara alifanya makosa kulingana na sheria mpya ya gharama za uchaguzi, majaji wataweza kuona kwamba kumzuia rais kufanya kazi zake kwa uhuru kwa sababu ya sheria ya gharama za uchaguzi litakuwa jambo lisilo tija, kwani kesho rais anaweza kushindwa hata kwenda kufungua visima vijijini wakati wa karibu na uchaguzi kwa kuhofia kuambiwa anawapa watu rushwa ili wamchague.

Kwa hiyo hili jambo ni vigumu kupita kwa Tendwa, ni vigumu kupita mahakamani, na zaidi ya yote hayo, sheria yenyewe ya gharama za uchaguzi ni dhaifu na haijaweka bayana vitu kwa uhakika kiasi cha kufanya kesi dhidi ya Kikwete iwe na nguvu. Sheria ina matobo mengi ambayo Kikwete anaweza kuyatumia ili hili lisiwe jambo la athari kwake.
 
Tunapojadili maada ingefaa tuisome sheria yenyewe ( hususan kuanzia Part V "Prohibited Practices") na kujadili kufuatana na sheria yenyewe, sio tunavyofikiri tu. Ili kusudi kama kuna makosa katika kujadili ambayo hayaendani na sheria yenyewe, tuweze kurekebishana.

Having said all that, PART V "Prohibited Practices" kipengere 21 (e) kiko very hairy kwa Kikwete na kitamsuta sana kiasi cha kwamba hata kama haja violate the letter of the law, ame violate the spirit of the law.

21.-(1) During the nomination process, election campaign or election, an act of prohibited practice shall be committed by-

(e) every person who, for purposes of promoting or furthering a nomination process or an election campaign, or during the nomination or campaign,or during the nomination or campaign period,advances or pays, or causes to be paid, any money to or for the use of any other person, with the intent that such money, or any part of that money,shall be expended in bribery at any nomination process or election or who knowingly pays, or causes to be paid, any money to any person in discharge or repayment of any money wholly or in part expended in bribery at any nomination process or election;

Watu wanaweza kusema kirahisi kabisa kwamba, swala hili halikuhitaji haraka, na halijaanza kusemwa leo, kwa hiyo kwa Kikwete kutaka kupitisha nyongeza za mishahara haraka haraka wakati wa campaign, ni kweli ametaka nyongeza hizi zishawishi upigaji kura na hivyo ame violate sheria ya gharama za uchaguzi.
 
Huu hapa chini ungeweza kuwa utetezi mzuri kwa Kikwete chini ya pengo la "huduma za jamii", tatizo sheria inaongelea kwamba inabidi lifanywe nje ya muda wa kampeni.

(3) For the purposes of this section an act or transaction shall not be deemed to constitute prohibited practice if it is proved to have been designed to advance the interests of community fund raising, self-help, self-reliance or social welfare projects within the constituency and to have been done before the nomination process or election campaign, as the case may be.
 
Huu hapa chini ungeweza kuwa utetezi mzuri kwa Kikwete chini ya pengo la "huduma za jamii", tatizo sheria inaongelea kwamba inabidi lifanywe nje ya muda wa kampeni.

Ndiyo maana nika i disqualify hii kama defense on the grounds that Kikwete katoa ahadi za kuongeza mishahara well within the campaign, worse still, baada ya kusema hataongeza. Ametoa picha kama vile kwanza alisema hataongeza, halafu akaona kwa kutoongeza atakosa kura za wafanyakazi, akatumia nyongeza za mishahara kama rushwa ili wafanyakazi wampigie kura.

Tatizo linakuja, ukiisoma sheria ya gharama za uchaguzi unaona kabisa kwa sehemu kubwa inaangalia rushwa ya moja kwa moja, watu kupeana mlungula ili wapigiane kura na ku influence uchaguzi kwa namna moja au nyingine. Ukija kwenye masuala yaliyo na mazingira ya rushwa lakini hakuna rushwa ya moja kwa moja, kama hili la Kikwete, sheria haiko wazi.

Ndiyo maana nasema Kikwete atatafuta loophole na kupeta tu.
 
Hongera Kiranga; umenikumbusha Kikwete wakati anaongea na wazee wa Dar-es -Salaam,kuhusu swala la mishahara ya wafanyakazi alitamka wazi kwa mdomo wake;"kuwa serikani haina uwezo na hahitaji kura za wafanyakazi." Sasa kaona mambo mazito anageuka na kusema anawashangaa wanaosema yeye Kikwete hataki kura za wafanyakazi na hapohapo kutanganza nyongeza za mishahara na kuwaomba kura wafanyakazi! Huku nikukiuka sheria aliyoisaini yeye mwenywewe kwa mbwembwe. Yawezekana hiyo sheria hakuielewa aliweka sahihi bila kujuwa inamanisha nini; au aliikubali kwa kudhania yeye kama rais haimuhusu; lakini hapa sheria inambana yeye kama mgombea. Lakini je Tendwa anao ubavu? Tayari kesha anza kuweka mukwara kuwa ambaye hataridhika aende mbele ya sheria (mahakamani). Na huko mahakamani Jaji gani anayeweza kuubatilisha ungombea wa Kikwete!?

Mimi ninachoshangaa ni kuwa sheria hii imepitishwa kwa mbwembwe na kuweka katika tovuti lakini haijafanyiwa tafsiri. Itabaki mjadala huu kuwa ya mawakili na si ya jamii hasa ukizingatia kuwa waandishi wetu wa habari ni wavivu wa kufikiria....
