ARE BABU SEYA & SON NOT VICTIMS OF CELEBRITY BACKLASH?

Am emboldened by what Nyerere once said about our jurisprudence: Better allow nine criminals out rather than wrongfully convict one innocent person. Our criminal system endears painstakingly to protect the innocents even if criminals benefit, as well. In the Babu Seya Court of Appeals decision the gist is not whether the convicts had committed rape but rather whether there was sufficient and unambiguous evidence to condemn them into life of confinement without parole.

In a 55 pages narrative, the three justices unanimously made their compelling case of convictions and acquittals. For me, the evidence spoke with clarity that there was insufficient evidence to convict and some of it was outrageously contradictory that I was flabbergasted that the justices decided otherwise. On page 46-47 of the verdict, it is where a red herring of celebrity backlash reeled its monstrous head when Justice Kimaro queried...”The question we ask is if PW8 was able to mention the names of the 1st and 2nd appellants why not the rest of the appellants? The 3rd and 4th appellants are given the benefit of doubt on this offence and they are acquitted

The celebrity stature of Babu Seya and Papi Kocha was not at par with other appellants because the former were megastars in the public eye while the latter were not. The justices should have taken a deep breath and ask themselves why the trial Magistrate failed to factor in this celebrity albatross which had undermined Nguza & Papii defence rather than upending this factual inconsistency in favour of prosecutors. The most controversial evidence came from the “star” witness PW2 whose hospital diagnosis established she had contracted gonorrhea.

Nowhere in the evidence submitted by the prosecution case, it was alleged there were other witnesses who had contracted that excruciating STD. That blatant inconsistency should have pricked the consciences’ of the justices to dismiss outright all offences of gang rape. Gonorrhea is an infectious disease which; if the alleged victims were telling the truth, should have ravished most of them! Surely, from the evidence on record, PW2 contracted STD from other sources but not from Babu Seya. This fact alone was sufficient on its own to uphold the appeal. The justices’ inadvertence ricocheted more loudly on collaboratory evidence of Nguza’s room.

All the evidence cited by the justices heavily relied on the alleged victims’ description of the room after they had seen it when under police’s escort. Justice demands fairness and I could not sniff it! The justices had no business to permit that kind of police coerced evidence to stick knowing the alleged victims were privy of the room as a result of police supervised inspection. The evidence volunteered by alleged victims in the police statements prior to that Nguza’s house police visitation should have been compared with the facts collected after that inspection to establish whether the complainants really knew the contours of the room.

Unfortunately, the nature and extent of evidence in the room was transfixed upon movable evidence of two mattresses and a bed which could easily have been tampered with! The alleged victims who had adduced evidence of oral sex should have revealed descriptions of the anatomy of the pudenda of their alleged perennial pedophiles rather than specifying numbers and locations of a bed and mattresses in the room. Complainants should have blabbed whether the appellants were circumcised or not and pinpoint other genital marks; if any, to tighten their case knowing the offences involved daylight, frequent attacks. The judicial bombshell was nowhere but on Babu Seya’s defence of impotence which was treated surprisingly with utmost disgust!

The fact remains since Babu Seya was in police custody when he learnt of the offences he was charged of, the Appeals Court was wrong to regard a remanded suspect could discharge that burden of impotence proof without police cooperation: How could Babu Seya go to hospital and verify his virility while in custody if the police refused him to? Gang sodomy offences were thrown out because the law is silent: We urgently need a law to criminalize them… What a flub dub!
 
BABU SEYA NA MWANAE NI WAHANGA WA MAFANIKIO YAO?


Baba wa Taifa, Mwalimu Nyeyere kwenye moja ya hotuba zake alitukumbusha ya kuwa mfumo wetu wa kutoa haki upo radhi kuwaruhusu wahalifu tisa wapete ili mradi kuhakikisha raia mwadilifu mmoja tu analindwa. Mimi ninaamini kabisa kama waheshimiwa wanahaki wangelipembua ushahidi uliokuwa mikononi mwao bila ya kuangalia hadhi ya watuhumiwa wangeliwafutia mashitaka yote kwa vile ushahidi unapingana vilivyo na ni mdhaifu mno kwa mahakama kutoa maamuzi ya kumfunga mtu kifungo cha maisha.

Katika hukumu yenye kurasa 55, Mahakama ya Rufaa ilitegemea sana ushahidi wa kusimuliwa wa watoto wahanga wa kubakwa ambapo mahakama haikutumia uwezo wake iliyopewa na sheria kuupima ushahidi huo ipasavyo. Mahakama ya Rufaa ilikiri ya kuwa ushahidi ulikuwa haukupimwa na hivyo usingeweza kusimama pekee yake na kuwatia watuhumiwa hatiani na hivyo ulihitaji kuungwa mkono na ushahidi mwingine. Ushahidi mwingine ambao Mahakama ya Rufaa iliutumia katika kumtia hatiani Babu Seya na mwanaye ulikuwa una mapungufu mengi na hivyo kuniondolea mashaka kabisa watuhumiwa wote wawili hawakupaswa kutiwa hatiani bali kuachiwa huru.

Katika ukurasa wa 46-47 wa uamuzi, Mahakama ya Rufaa ilikuwa na haya ya kusema: “Swali tulilojiuliza kama shahidi Na. 8 aliweza kuwatambua kwa majina mtuhumiwa namba 1 na namba 2 kwa nini alishindwa kuwatambua watuhumiwa wengine? Watuhumiwa namba 3 na namba 4 tunawapa nafuu ya mashaka na hivyo kuwafutia shitaka hili.”

Utata ambao Waheshimiwa wanahaki hawakuona ni kuwa washitakiwa namba moja na namba mbili walikuwa ni Babu Seya na mwanaye Papii. Hawa ni watu maarufu kutokana na mchango wao mkubwa kwenye nyanja ya burudani la muziki. Ushahidi wa shahidi namba 8 ulipaswa utupwe kwa kutambua watu maarufu tu na kushindwa kuwatambua watuhumiwa baki.

Shahidi namba mbili ilidaiwa alipopimwa alikutwa ameambukizwa kisonono na kulingana na ushahidi wake alidai Babu Seya ndiye aliyembaka. Sasa tatizo hapa ni kuwa kulingana na hati ya mashitaka - haya ni makosa ya kubaka kwa genge ikimaanisha ya kuwa kama kweli Babu Seya ndiye aliyembaka shahidi namba mbili basi ndiye aliyemwambukiza kisonono lakini kizungumkuti kilivurumishwa na mashahidi wengine tisa ambao nao walidai kubakwa na genge lililoongozwa na Babu Seya lakini hakuna hata mmoja wao aliyedai kuambukizwa kisonono! Pia shahidi namba 20 ambaye ni muuguzi alithibitisha ya kuwa shahidi namba mbili hakuwa na kisonono.

Vilevile shahidi namba 5 aliyedai kuwemo kwenye kundi la kubakwa ushahidi wake ulibezwa na shahidi namba 20 ambaye alikuwa ni muuguzi kwa kuthibitisha ya kuwa shahidi namba tano alikuwa bado ana bikira yake kinda hivyo asingeliweza kuwa alibakwa. Ushahidi mwingine uliotumika kuwatia hatiani unatokana na ushahidi uliotolewa kuhusiana na magodoro mawili na kitanda ambacho polisi na walalamikaji walivikuta kwenye nyumba ya Babu Seya mtuhumiwa. Ushahidi wa mashahidi ulifanana kwa sababu siyo walitendewa unyama ule ila polisi waliwapa nafasi ya kuivinjari nyumba ya mtuhumiwa Babu Seya. Polisi walipaswa walinganishe ushahidi kabla ya kukagua nyumba ya Babu Seya na ule ushahidi walioukuta baada ya ukaguzi wao ili kujihakikishia walalamikaji kweli wanaijua vizuri undani wa nyumba ya mtuhumiwa. Kwa vile baadhi ya walalamikaji walidai walilazimishwa ngono ya kinywani ni dhahiri waliona maumbile ya uume wa watuhumiwa na hivyo walipaswa waelezee ulivyo. Mfano walipaswa watamke kama watuhumiwa walikatwa jando au hapana na kama wana alama zozote zile sehemu za siri na polisi kuwakagua watuhumiwa ili kuthibitisha ukweli. La mwisho ni utetezi wa Babu Seya kuwa yeye hana nguvu za kiume. Inatosha kusema hapa ya kuwa kisheria Babu Seya alijua makosa yaliyokuwa yanamkabili pale aliposomewa mahakamani kisutu mbele ya hakimu mkazi akiwa rumande mikononi mwa polisi. Alipoomba akapimwe hospitali nguvu za kiume polisi walimkatalia lakini mahakama hawakuiona polisi kitendo ilichokifanya kilikuwa ni cha kupindisha haki kwa kuzuia mahakama kupata ushahidi wote ili kutenda haki. Kwa lugha ya mwingereza wasema: “there was an obstruction of justice and an abuse of public office.” Mazingira haya yote yalikuwa siyo ya kuthibitisha hukumu bali kuwaachilia watuhumiwa wote kwani kuna ushahidi wa kutosha polisi walishindwa kutekeleza majukumu yao na hivyo kushindwa kuthibitisha makosa. Hapa haki ilipindishwa kabisa!!!
 
Nakubaliana nawe SMU kwa nini wao na si wengine? Au kwa kuwa wao ni waimbaji kwa hivyo hawafanyi hivi?????

NIMEMSOMA sana babu seya humu JF na magazetini,na i have been wondering how can such injustice prevail-well nilipata bahati ya kumjua a certain musician anayeishi EUROPE,who according to what he told me,yeye ni wanamuziki wa kwanza kwanza kuingia bongo,anasema na nimeverify from other sources kwamba alingia tanzania na BANA NGENGE,mimi hii bendi siijui but i have been made to understand kweli ni bendi za mwanzo mwanzo tanzania kutoka zaire.On Babu seya,ameniambia kwamba ni ukweli kwamba babu S ana makosa although hii number ya watoto imekuwa exaggerated.Huyu source ni a household name in the music scene ya miaka hiyo,hence credibility of what he told me haina ubishi.

Mkuu tunamwomba Babu Seya awe huru kama zawadi ya ushindi wako kurudi kuongoza dola,mkuu huyu baba na mwanae,wanaomba kwa mara ya mwisho waweze kurudi duniani kuungana na 'nguza viking family' pamoja na Watanzania wote. Najua mzee Nguza amekuwa mpore tayari kuchukua msamaha wako na kaapa mara nyingi kutorudia makosa. Mwl. Nyerere alisikika kusema wakati ule wewe ulikuwa hujakomaa kuongoza taifa la Tanzania,leo umekomaa na kukabidhiwa dola,sasa tunaomba uoneshe ukomavu wako na umahiri ili maneno ya Nyerere yawekwe kando. Baada ya yote,mh.tupe Nguza Viking and family! Siku ya shehere za Ceaser akawauliza nimfungue nani? Wengi wakasema Yesu mnazareth! @GSANA, ktk maelezo yako wewe umekiri na umeonyesha hata Nguza mwenyewe amekiri kuwa ana makosa, sasa iweje utetee mkosefu? Mfano wa Pilato na Barnaba msaliti ni mfano mbaya sana kutumiwa na kiongozi mwadirifu, yaani mwenye haki asulubiwe, msaliti aachiwe? Hapana... kama si kwa maslahi yako binafsi basi uadirifu wako una mashaka.

mr Acid salaam! Nadhan nimekuwahi kabla ujatoka jamvini. Mi naelewa kuwa haki isiwe zawadi ila kwa kuwa tumeshajiwekea utamaduni kuwa watu wanapewa zawadi ya kutoka jela kila siku ya Uhuru basi ata babu seya apewe. Hii aijalishi alikutwa na hatia kihalali au la! Mi nasema kama tumempa rais uwezo wa kutoa msamaha basi awaangalie hata watu hawa wenye kukutwa na kosa linalofanana sana na dhambi! Mkuu nielewe,being found guilty means not rotting or decaying in jail. Doesn't means no need of forgiveness,pardon is always fair!
