Mahakama Kuu imesitisha kwa muda mpango wa serikali kubinafsisha bandari hizo kutokana na ombi la wakazi wa maeneo hayo wanaodai Ubinafsishaji huo una njama za kutwaa usimamizi na mali za Mamlaka ya Bandari (KPA).
Kwa mujibu wa Wafungua Shauri, wamedai mpango wa Ubinafsishaji wa Gati za Bandari hizo unafanywa na Maafisa wa Serikali wakishirikiana na Kundi la Wafanyabiashara kwa maslahi yao binafsi. Serikali ilitangaza tenda ya ubinafsishaji Bandari hizo Oktoba 17, 2023.

The High Court has temporarily stopped the plan by President William Ruto's government to privatise Mombasa and Lamu ports after a petition by residents of the region who claim that the sale was a ploy to take over the management and assets of the Kenya Ports Authority (KPA).
Justice Chacha Mwita of the Milimani High Court in Nairobi issued the interim orders on Monday, November 27 and gave the government three days to respond, with further orders set to be issued on December 6.
The Taireni Association of Mijikenda filed a petition at the High Court on Monday, November 27, seeking conservatory orders against the government to privatise Container Terminal 1, berths 11–14 at Container Terminal 1 at Port of Mombasa and 1-3 berths at Lamu Port.
The unsavory housing levy proposed by the Kenya Kwanza government has been declared unconstitutional by the High Court.
During the ruling on petitions filed challenging the Finance Act 2023, Justice David Majanja ruled that the court has found the levy to have violated Article 10, 2 (a) of the constitution.
"We find that the introduction of the housing levy amendment to section 84 lacks a comprehensive legal framework in violation of Article 10 of the constitution, that levy against persons in formal employment without justification is discriminatory and irrational," Majanja read in his judgement on behalf of a three-judge bench.

The Kenya Medical Practitioners, Pharmacists and Dentists Union (KMPDU) made good its threat to challenge the implementation of the social health insurance scheme.
The doctors’ union obtained court orders stopping the government from the planned rollout of the universal health coverage envisioned in the laws whose rollout President William Ruto had announced would be in January 2024.
