Further, "A disclosure is a relevant pay disclosure if made for the purpose of enabling the person who makes it, or the person to whom it is made, to find out whether or to what extent there is, in relation to the work in question, a connection between pay and having (or not having) a particular protected characteristic.
Although this section does not outlaw secrecy/confidential clauses, it does make them unenforceable in certain circumstances.
I think the United States is moving in the same direction. See, for example, the First Circuit case of NLRB v. Northeastern Land Services (2011) in which it was held that "confidentiality clauses in employment contracts can constitute a per se violation of employees' protected employee rights under the National Labor Relations Act (NLRA) if the clauses can be read as prohibiting all discussions of wages, hours, and working conditions." Sidhani kama njia muafaka ilikuwa ni kuzipiga marufuku hizo recruitment agencies, bali kuhakikisha kuwa zina-operate kwa mujibu wa sheria au taratibu zilizowekwa.

Kama hii habari ni kweli, then this is the worst decision for the government. Pia ni ushahidi kuwa serikali inashindwa ku-regulate the emerging businesses across the country.

Kuna baadhi ya mambo yanaweza kuwa controllable lakini kuna mengine itakuwa ngumu tu hususani linapokuja suala la maslahi ya wafanyakazi. mambo kama michango ya NSSF na mengine kama hayo ni controllable lakini upunjaji wa maslahi itakuwa ngumu coz' hawa nao ni wafanyabiashara unless kama serikali i-intervene relationship kati ya employers and recruitment agencies. Nasema wa-intervene coz' wengi wao uhusiano uliopo ni kwamba employer anamlipa recruitment agency na recruitment agency ndie anajua anamlipa nini employee! So, ili waweze kutengeneza faida kubwa zaidi, wanalazimika kuwapunja wafanyakazi coz' kwa kadri wanavyowapunja zaidi ndivyo wanavyopata nyingi zaidi. Na employers huwa wanai-favor njia hii ili kujivua gharama za "other benefits" kv matibabu, likizo,n,k coz' hata kama mtu anafanya Tigo lakini anakuwa si mwajiriwa wa Tigo bali ni wa yule aliyemleta! Na kama ukizingua, employer wala hana haja ya kupoteza hata dakika moja kwako; anakurudisha tu waliokuleta na yeye ku-demand immediate replacement na legal problems zote zinakuwa kwa agent na sio kwa employer! Sasa huu uhusiano wa kuwa mfanyakazi anakuwa chini ya agent (in contrast na ile system kwamba employer anamlipa tu agent kumfanyia recruitment lakini mkataba anaingia mfanyakazi na employer) unam-favor sana employer wakati unamuumiza mfanyakazi! Na hata linapokuja suala la promotion sijui wanafanyaje manake ukienda kwenye kampuni yenye wafanyakazi wa aina mbili, kutoka kwa agent na wale employed na employer mwenyewe, basi kuna hatari favor wakawa wanapata wale wa employer mwenyewe coz' hawajibiki kwa huyu wa kuletwa!!
