UN has rejected Doctor's (MAT) Request

Mbona mleta thread haulizwi source? Mnaishia kujadili mawazo yake? Au ndio mwakilishi wa UN hapa Tanzania?

Mimi nafikiri kishoka hapa utakuwa wewe,tumekimbilia kusemea maslahi yao tu ilihali madai yao ya msingi ni pamoja uboreshaji wa huduma muhimu kwaajili ya kuweza kufanikisha utendaji kuwa rahisi na nchi kuepuka gharama za kupeleka viongozi nje ya nchi.Au tumesahau hata kutumbuliwa chunusi viongozi mpk India!

Msitegemee chochote toka UN.... I hope kuwa pamoja na kusoma PCB dokta Namala alisoma pia Civics na General studies.....alisoma kuhusu Roles and functions of the UN....

Pia kama alipata mwalimu mzuri alimfundisha kuwa UN haina executive powers especially ku- interfere sovereign state affairs na haswa zinapokuwa hazina threat yeyote kwenye international peace and security....sidhani kama alikuwa na tegemeo lolote la dhati kuwa UN watamsaidiaje....

Mambo mengine mie nayaona tu kama ni ya kufurahisha jukwaa lakini kama kuna anayesubiri impact yeyote kwa barua ya Namala UN ni kupoteza muda na kufurahisha jukwaa.

Dar es Salaam. The United Nations office in Dar es Salaam yesterday acknowledged receipt of a letter from the Medical Association of Tanzania (MAT) seeking protection of Dr Stephen Ulimboka who is receiving treatment in South Africa.

The UN communications analyst, Ms Hoyce Temu, said yesterday that the resident coordinator of the global body, Dr Alberic Kacou, received the letter on Monday evening and immediately started consulting other partners on how to address issues raised by the document.

"The resident coordinator will be meeting with representatives of UN agencies for consultations and drawing more expertise on how to address issues raised in the letter," Ms Temu said.
She said there were also many actors mentioned in the letter, including the doctors themselves through MAT, the government, and civil society organisations.

As a result, she noted, attending to the doctors' requests would need more time so as to get the issues right from all sides prior to intervention and mediation.

"UN is a transparent organ and believes in peace and stability of its member states, including Tanzania," she noted.
On Monday, MAT appealed to the United Nations and the international community to ensure the security of Dr Ulimboka in South Africa, where he is receiving treatment.

MAT said in its letter that "…anonymous government sources have confirmed to MAT that a team of assassins has been deployed to South Africa to make sure Dr Ulimboka doesn't come home alive."

The letter also appealed to the UN to ensure the security of other key actors in the association. Following the extended strike, the letter said, the security of some of the key actors had been compromised.

Dr Ulimboka, who was a key figure in a committee assigned to negotiate the doctors' new terms of service and salaries with the government, was seriously injured after unidentified assailants kidnapped and beat him up.
He was flown to South Africa last week for specialised treatment.

He was kidnapped as doctors were planning a second nationwide strike after what they described as the government's failure to meet their demands. He suffered grievous injuries during the attack that left the nation stunned.
The letter was accompanied by a DVD video in which Dr Ulimboka gives an account of the attack.

"The Tanzanian judicial system should be advised to refrain from being used for political advantage," said the two-page letter copied to the Legal and Human Rights Centre, Sikika Tanzania, Tanzania Gender Networking Programme, Tanzania Media Women's Association, Human Rights Watch and Amnesty International.

Kulingana na gazeti hili barua ya MAT ndiyo kwanza imepokelewa ofisi za UN na mwakilishi wake anafanya mawasiliano na wenzake kuona jinsi ya watakavyo lishughulikia tatizo hili la Madaktari na tishio la maisha ya Dr. Ulimboka.

UN bado hawajajibu barua hii kama wamekataa kushughulikia au wamekubali. Sasa hizi longo longo za kwamba UN wamekataa zinatoka wapi? Hebu acheni propaganda za kihuni hapa. Madai ya MAT ni ya msingi wanastahili kusikilizwa.

Hata hivyo napenda kuwashauri MAT kwamba walipaswa wapeleke Nakala ya barua yao pia ILO(International Labour Organisation) kwa vile huu mgogoro unahusiana na Madaktari kugoma kazi kwa madai ya msingi.

Pia nawaomba MAT wapeleke Nakala kwa ICC- Mahakama ya Kimataifa kwa vile kuna Maisha ya Dr. Ulimboka yako hatarini huko SA na kwamba kuna wauaji wamepelekwa na Serikali ya Tanzania kwenda kummalizia Dr.Ulimboka.

UN wana haki ya kuchunguza mambo haya kwa vile katika sheria za UN ipo sheria ya Haki ya kuishi kwa kila binadamu mmoja mmoja akiwemo Dr. Ulimboka ambaye uhai wake unatishiwa na Serikali ya CCM kwa vile tu ni kiongozi wa Madaktari katika kudai maslahi yao wanayostahili!
 
Madaktari vijana msiwe na kiburi waombeni radhi watanzania ili mrudi kazini.
Katika suala hili you lose, both public and national sympathy.
Hamuhitajiki sana kama mnavyofikiri na wanaowaunga mkono ni olitical opputunists.
At any rate damage mliyofanya mtalipa tu, kwa vyovyote vile, lakini kwa manufaa yenu ombeni radhi kwa Rais wa Jamhuri.

Ni kweli hauhitaji madaktari?huwa unatibiwa wapi wewe na familia yako?sidhani kama unafahamu haki zako za msingi na wajibu wa serikali kwako wewe mwananchi
 
Kila mmoja anavuta kamba upande wake ila tanzania haijapatwa na tishio la kufikia kuomba msaada UN cha msingi doctors step down rudini kundini tuyajenge then serikali itawaelewa

Ukweli hili c jibu la UN na ukiangalia alichosema Ms Temu ni kwamba hawajayafanyia kazi japo wamepokea maombi hayo. Ni wazi haya ni maoni ya Kupeng'e(Dr?) yeye binafsi
 
It is sad the world works this way. Haki ya watu ina weza kupotezwa na kuburuzwa na Serekali bila chochote kufanyika kwa sababu power zote ziko kwa chama kimoja.
Jawabu, jamani tuunge mkono viama vya upinzani kwa nguvu zote vipate nguvu ili ku balance power badala ya kudanganywa kila siku na CCM.

The Protection of Human Rights and the Principle of​
Non-intervention in Internal Affairs of States

(b) Article 2.7 of the UN Charter​
Article 2.7 of the Charter of the United Nations provides that – “Nothing contained in thepresent Charter shall authorize the United Nations to intervene in matters which areessentially within the domestic jurisdiction of any state or shall require the Members tosubmit such matters to settlement under the present Charter; but this principle shall notprejudice the application of enforcement measures under Chapter VII.” Practice underArticle 2.7 has developed over time, and its practical importance is by now significantlyreduced.

Vienna Convention on Diplomatic Relations, Article 41

It seems to be still well-established the diplomats should not interfere in the internalaffairs of the State to which they are accredited. But even here, as the leading work onthe subject points out, there is a “tension between the duty of a diplomat under Article 41of the Vienna Convention, not to interfere in the internal affairs of the receiving State andthe opinion of liberal States that human rights are a matter of legitimate international
concern whose active promotion is a major part of their foreign policy

Among other activities which, depending on the circumstances, contravene the principleof non-intervention are:
(a) Interference in political activities (such as through financial or other support forparticular political parties or candidates, or even perhaps comment on upcomingelections or on the candidates;
(c) Seeking to overthrow the government - so-called ‘regime change’, especially in thecase of ‘rogue States’ It has occasionally been suggested thatintervention in order to restore (or establish) democracy is permitted under internationallaw​





Nothing in these articles is conclusive as regards UN's ability to intervene in the situation.I point out two paragraphs;

1.Practice underArticle 2.7 has developed over time, and its practical importance is by now significantlyreduced.

2.It seems to be still well-established the diplomats should not interfere in the internalaffairs of the State to which they are accredited. But even here, as the leading work onthe subject points out, there is a “tension between the duty of a diplomat under Article 41of the Vienna Convention, not to interfere in the internal affairs of the receiving State andthe opinion of liberal States that human rights are a matter of legitimate international
concern whose active promotion is a major part of their foreign policy

Non of these two paras are conclusive.Over the time, UN has authorised intervention in several arabic nations' internal affairs.Why not here??

Unless we get an official letter from the local UN diplomat as to this respect,we can not have this as conclusive.
