Njaa Baba utafanya nini na ndio mteja aliyempata na yeye ndio ajira yake
Ni kweli, Marando inabidi pia aendeleze ajira yake ya wakili wa utetezi; asije kufa njaa hata kama wengine hatufurahii kutetea wafisadi. Lakini, kujiingiza kwake katika siasa za upinzani kunaweza kumuweka njia panda. Achague moja; asije pata maumivu yaliyowaangukia akina Lamwai.

Hii hata mimi imenikosha. Kama kweli kuna huo mkataba basi sijui ni heshima ipi Manji anayoitafuta. Anaweza kushinda kesi kisheria. Lakini atatuelezaje kampuni yake kuingia mkataba na Kagoda, kampuni iliyothibitishwa kuwa kinara wa hujuma ya EPA na ambayo wamiliki wake halisi hadi sasa hawatamkiki? Na aliporudisha baadhi ya fedha za EPA kufuatia "msamaha" wa Rais, alifanya hivyo kwa madhumuni gani? Asingefungua kesi hii labda kama hajui kuwa nchi inabadilika sasa.

MAOMBI ya Mwenyekiti Mtendaji wa Makampuni ya IPP Ltd, Reginald Mengi, katika kesi anayoshitakiwa na mfanyabiashara maarufu Yusuf Manji yamegonga mwamba baada ya Mahakama ya Hakimu Mkazi Kisutu kukataa kusimamisha kesi hiyo ili akate rufaa Mahakama Kuu kupinga uamuzi aliodai haukutenda haki.

Akisoma uamuzi huo jana, hakimu anayesikiliza kesi hiyo ambayo Manji anadai fidia ya Sh moja kwa kuitwa fisadi papa na Mengi, Hakimu Aloyce Katemana alisema sheria inasema panapotokea ubishi mdogo katikati ya kesi hairuhusu kwenda Mahakama Kuu kukata rufaa au kuomba mapitio ya uamuzi huo.

Katemana alisema hilo tu linawezekana ikiwa uamuzi huo utakaotolewa Mahakama Kuu utamaliza kesi kabisa tofauti na hapo sheria hairuhusu.

Alisema mdaiwa ambaye ni Mengi akienda Mahakama Kuu kukata rufaa ni kupoteza wakati wa Mahakama kwa sababu itabidi kesi hiyo isimame.

Hata hivyo, hakimu huyo alisema amri aliyoitoa Februari 11, mwaka huu iliruhusu kama upande wa Mengi utafanya marekebisho, wana uhuru wa kuzirejesha upya nyaraka zao kwa sababu kesi haijamalizika.

Alisema kwa kuwa jalada la kesi hiyo bado liko hapo, basi kesi hiyo itaendelea kusikilizwa na kuipangia kuendelea na ushahidi Machi 14 na 15 mwaka huu na kuongeza kuwa kama Mahakama Kuu itaona hatendewi haki Mengi, jalada litaitwa Mahakama Kuu ataisimamisha kesi.

Uamuzi uliotaka kukatiwa rufaa na Mengi ni wa Mahakama hiyo kukataa nyaraka alizoziwasilisha mahakamani hapo ambazo ni kivuli na hazikuwa na kibali cha zilikopatikana.

Nyaraka hizo vivuli zilidaiwa zimepatikana Taasisi ya Kuzuia na Kupambana na Rushwa (TAKUKURU) na Ofisi ya Mwanasheria Mkuu ambapo Wakili wa Mengi, Michael Ngalo aliiomba Mahakama kuutaka upande wa Manji uwapatie nakala halisi.

Mahakama pia ilisema nyaraka hizo hazimhusishi Manji, bali kampuni zake.

MAHAKAMA ya Hakimu Mkazi Kisutu jijini Dar es Salaam, jana ilitupilia mbali ombi la Mwenyekiti Mtendaji wa Makampuni ya IPP, Reginald Mengi la kutaka kukata rufaa Mahakama Kuu kupinga mahakama hiyo kukataa nyaraka alizowasilisha kwake kama sehemu ya ushahidi katika kesi yake na Yusuf Manji.

Februari 11 mwaka huu, Mahakama hiyo ilikataa kupokea nyaraka hizo kuwa sehemu ya ushahidi wa kesi hiyo ya madai ya Sh1, uamuzi ambao Mengi alitaka kukata rufaa kuupinga. Akitoa uamuzi huo jana, Hakimu Mkazi Aloyce Katemana alisema sheria hairuhusu pale panapotokea ubishi mdogo ambao hauwezi kumaliza kesi kukatiwa rufaa au kufanyiwa mapitio. Hivyo ataendelea kuisikiliza kesi hiyo kuanzia Machi 14 na 15, mwaka huu.

Awali Februari 11, mwaka huu, Katemana alitoa uamuzi katika kesi hiyo ya madai ya Sh1 iliyofunguliwa na Manji dhidi ya Mengi na zilizotupiliwa mbali nyaraka 14 zilizowasilishwa na Mengi kwa madai kuwa hazina msingi. Katika nyaraka hizo, upo mkataba kuhusu kampuni ya Quality Finance Cooparation Group na Kagoda Agriculture.

Nyaraka hizo za Mengi zilitupiliwa mbali mahakamani hapo kwa sababu zilikuwa hazina kibali kutoka kwa ofisa wa serikali na kwamba hazimuhusu Manji. Uamuzi huo ulifuatia mahakamani hapo mara baada ya Wakili wa mfanyabiashara, Yusuph Manji, Mabere Marando,kuiomba mahakama kufuta nyaraka hizo zilizowasilishwa na Mengi kwa sababu haziendani na sheria za mahakama. Marando alidai kuwa sheria inakataa nakala zisizo halisi, lakini ipo sheria ambayo inaruhusu kuomba kibali ambacho ilitakiwa upande wa Mengi wakipeleke kabla ya kuanza kusikilizwa kwa kesi hiyo.

"Na kama waraka unahusu serikali inatakiwa waraka ufanyiwe marekebisho na ofisa aliyetoa nyaraka hizo na kwamba inatakiwa zilipiwe,lakini upande wa Mengi vitu hivyo vyote havijafanyika,"alidai Marando. Aliongeza kudai kuwa kutokana na hoja hizo,nyaraka zote zilizopelekwa mahakamani hapo na upande wa Mengi hazina msingi, ziondolewe mahakamani na kwamba zinawapotezea muda kwa kuwa haziendani na sheria.

Marando pia aliutaka upande wa Mengi ueleze umezipata wapi risiti za malipo za serikali kuhusu kampuni ya Quality Finance Cooperation Group na ni nani aliyempa. "Kuna mkataba kuhusu Quality Finance Cooperation Group na Kagoda Agriculture lakini haumhusu Manji kwa sababu kesi hii inahusu udhalilishaji wa mtu na mtu na siyo mtu na kampuni,"alidai Marando.

Baada ya Marando kutoa hoja hizo, Wakili wa Mengi Michael Ngaro alizipinga hoja hizo zilizotolewa na jopo la mawakili wa Manji, Marando, Richard Rweyongeza na Ringo Tenga kwa madai kuwa vielelezo hivyo vilitolewa wakati usio muafaka na aliiomba mahakama isubiri muda muafaka ambapo shahidi husika angefika kuvithibitisha mahakamani hapo. Lakini akina Marando walipinga hoja hiyo ambapo hakimu Katemana alifikia kutoa uamuzi huo.

Baaada ya kutolewa kwa uamuzi huo, wakili wa Mengi, Ngalo aliiomba mahakama ya Kisutu itumie busara zake kumruhusu ili aweze kukata rufaa Mahakama Kuu dhidi ya uamuzi huo uliotolewa na hakimu Katemana. Awali mahakama hiyo ya Kisutu ilishuhudia mkanda wa video (DVD) wa hotuba ya Mwenyekiti Mtendaji wa Makampuni ya IPP, Reginald Mengi wakati akizungumza na waandishi wa habari ambapo alimtaja mfanyabiashara Yusuph Manji kuwa ni miongoni mwa mafisadi Papa wanaoihujumu nchi.

Mkanda huo ulionyeshwa katika mahakama ya wazi, mbele ya Hakimu Katemana wakati Manji alipokuwa akitoa ushahidi wake dhidi ya kesi hiyo. Wakati mkanda huo ukichezwa mahakama ilimshuhudia Mwenyekiti huyo Mtendaji wa Kampuni ya IPP akiwataja watu watano wanaotuhumiwa kuhusika na ufisadi mkubwa nchini na kuitaka serikali iwashughulikie haraka iwezekanavyo ili kuinusuru nchi kuyumbishwa nao.

Mengi akitoa hotuba hiyo iliyoonyeshwa mahakamani hapo aliwataja wanaotuhumiwa kuwa ni `mafisadi papa`, ni pamoja na Mbunge wa Igunga na Mjumbe wa Kamati Kuu ya Chama Cha Mapinduzi (CC-CCM) na Halmashauri Kuu ya Chama hicho (NEC-CCM) Taifa, Rostam Aziz.

Wengine ni wafanyabiashara, Tanil Somaiya, Yusuf Manji, Jeetu Patel na Subash Patel, ambao alisema wanatuhumiwa kuiba mabilioni ya wananchi na kuzihamishia nje ya nchi.

Baada ya kumaliza kuonyeshwa kwa mkanda huo mahakamani hapo (DVD), Manji aliiomba mahakama iipokee DVD hiyo kama moja ya kielelezo cha ushahidi katika kesi hiyo. Licha ya kutoa DVD hiyo kama sehemu ya ushahidi katika kesi hiyo, Manji pia alitoa nyaraka mbalimbali ikiwemo mikataba yake ya kazi pamoja na vyeti vya shule na vyuo mbalimbali alivyosoma mahakamani hapo kama vielelezo vya ushahidi kwenye kesi hiyo.

Court okays Mengi`s appeal on defamation case exhibits

A Dar es Salaam court ruled yesterday that proceedings of a defamation case before it would continue but without the defendant being barred from appealing an earlier ruling in relation to exhibits it has rejected.
Magistrate Aloyce Katemana of the Kisutu Resident Magistrate's Court made the remarks in connection with a case in which the complainant is businessman Yusuf Manji and the defendant is IPP Executive Chairman Reginald Mengi, who is objecting to the rejection of his exhibits by the lower court.
The magistrate was ruling on a notice of intent to appeal filed by counsel Michael Ngalo for Mengi after the court struck off 14 items from the list tendered by the defendant as part of documentary evidence to support his defence.
The documents rejected by the court include one associating Kagoda Agricultural Company with the looting of a total of USD131 million from Bank of Tanzania's External Payment Arrears (EPA) account.
"Defence counsel have the right to appeal but that does not stop the court from carrying on with the proceedings while the files (containing the said documents) are summoned," said magistrate Katemana, adding that the court had not closed its doors to the defence counsel to submit fresh items to support the defendant's case.
Counsel Ngalo last week filed an application in the same court seeking to be granted leave to pursue a review of the ruling in the High Court or the Court of Appeal immediately after the Kisutu court ruling.
He said the ruling had come as a surprise to them, adding that it would do his client great injustice continuing with the hearing without defence documents "and because it is the court's obligation to see that justice is done, we humbly request to pursue justice at high levels".
Ngalo argued that the ruling prevented the defence from using the documents, which he described as "so much of a violation of my client's right that he cannot defend himself".
The discovery of the illegal payment made controversially to Kagoda in 2005/6 was made by the central bank's former external auditors, Deloitte and Touche.
Manji is demanding from Mengi one shilling in compensation and an apology to run for seven days in IPP's media outlets for allegedly being referred to by the defendant as "a shark of corruption".
Magistrate Katemana set the hearing of the case for 9am to midday on March 14 and 15.

HATIMAYE Mahakama Kuu Kanda ya Dar es Salaam, imeitisha jalada la kesi ya madai ya kashfa ya shilingi moja iliyofunguliwa katika Mahakama ya Hakimu Mkazi Kisutu Dar es Salaam na mfanyabiashara Yusuf Manji dhidi ya Mwenyekiti Mtendaji wa Makampuni ya IPP Ltd, Reginald Mengi na ITV kwa ajili ya kupitiwa upya.
Akizungumza na Tanzania Daima Jumatano kwa njia ya simu jana wakili wa Manji, Dk. Ringo Tenga, alisema kesi hiyo ambayo ilipangwa kuendelea kusikilizwa juzi na jana katika Mahakama ya Hakimu Mkazi Kisutu ilishindikana kusikilizwa na Mahakama ya Kisutu kwa sababu wao wamepata taarifa kuwa jalada la kesi ya msingi limeitishwa Mahakama Kuu kwa ajili ya kulikagua jarada hilo.
"Kama mlivyoona juzi na jana sisi mawakili wa mlalamikaji na nyie waandishi wa habari tulikaa sana pale Mahakama ya Kisutu kusubiri mteja wetu (Manji) aendelee kutoa ushahidi wake lakini baadaye tulipata taarifa kuwa jalada la kesi hiyo limeitishwa Mahakama Kuu na hatujui limeitwa kwa ajili ya nini ila kwa mujibu wa sheria za nchi Mahakama Kuu ina mamlaka ya kuitisha jalada la kesi inayoendeshwa katika mahakama za chini….hivyo tunasubiri taarifa zaidi," alisema Dk. Tenga.
Alipotafutwa Jaji Mfawidhi wa Mahakama Kuu, Semistocles Kaijage, kuzungumzia suala hilo alisema yuko safarini na kwamba hakuwa kwenye nafasi nzuri ya kulizungumzia suala hilo.
Februari 15 mwaka huu, Hakimu Mkazi wa Mahakama ya Kisutu, Alocye Katemana, alitupilia mbali ombi la Mengi lililotaka mahakama hiyo iwapatie nakala ya uamuzi ilioutoa Februali 11 mwaka huu wa kuzikataa nyaraka 14 zikiwemo zinazoihusu kampuni ya Kagoda Agriculture Ltd ambazo zina uhusiano na Manji, ili aweze kwenda Mahakama Kuu kuomba afanyiwe mapitio.
Mapema mwaka juzi, Manji alimfungulia kesi ya madai ya kashfa Mengi na kituo cha televisheni cha ITV akitaka amlipe fidia ya shilingi moja kwa madai kuwa Mengi alitumia televisheni yake kumkashfu kwa kumuita ‘Fisadi Papa' na kwamba ni mmoja wa watu wanaopora rasilimali za Tanzania.

WAKILI Michael Ngaro anayemtetea Mwenyekiti wa Kampuni ya IPP Bw. Reginald Mengi katika kesi ya madai ya sh. 1 iliyofunguliwa na mfanyabiashara Bw. Yusuf Manji, ameiandikia

barua Mahakama Kuu kuomba ichukue kesi hiyo kutokana na kutoridhishwa na mwenendo wake katika Mahakama ya Kisutu.

Bw. Ngaro amewasilisha barua hiyo kwa Msajili wa Mahakama Kuu Kanda ya Dar es Salaam ili ampe Jaji Mfawindi wa mahakama hiyo jalada la kesi hiyo ili aone mwenendo wake katika Mahakama ya Kisutu.


Habari za kuaminika kutoka Mahakama Kuu zilibainisha kuwa katika barua iliyoandikwa na Bw. Ngaro inadai kuwa hakimu aliyekuwa akiendesha kesi hiyo, Bw. Aloyce Katemana anaegeme upande mmoja na kutolea mfano wa moja maamuzi ya Februari 11, mwaka huu.


Maamuzi hayo yalikuwa ya kutupitilia mbali nyaraka 14 zilizowasilishwa na Bw. Mengi ili vitumike katika mwenendo wa kesi hiyo kwa sababu hazina msingi na hazikuhusiana na kesi hiyo.


Miongoni mwa nyaraka hizo zilitupiliwa mbali na Hakimu Mkazi, Aloyce Katemana ni mkataba kuhusu Kampuni ya Quality Finance Cooparation Group na Kagoda Agriculture kwa sababu hazimhusu Bw. Manji bali kampuni yake, na hazina kibali kutoka kwa ofisa wa serikali.


Uamuzi huo ulitokana na Wakili wa Manji, Bw. Mabere Marando kuomba mahakama kufuta nyaraka hizo zilizowasilishwa na Mengi kwa sababu haziendani na sheria.

JALADA la kesi ya madai ya kashfa ya shilingi moja iliyofunguliwa katika Mahakama ya Hakimu Mkazi Kisutu na mfanyabiashara Yusuf Manji dhidi ya Mwenyekiti wa makampuni ya IPP Ltd, Reginald Mengi, limetua rasmi Mahakama Kuu Kanda ya Dar es Salaam.
Kwa mujibu wa vyanzo vya kuaminika kutoka ndani ya Mahakama Kuu vililithibitishia gazeti hili kuwa jalada hilo limefika mahakamani hapo jana asubuhi likitokea katika Mahakama ya Hakimu Mkazi Kisutu.
Vyanzo hivyo vilibainisha kuwa chanzo cha jalada hilo kuitwa katika mahakama hiyo ya juu ni kutokana na barua ya Februari 23 mwaka huu, iliyoandikwa na wakili wa mdaiwa (Mengi), Michael Ngaro kwa Jaji Mfawidhi, Semistocles Kaijage, ambapo ndani ya barua hiyo Ngaro anamuomba Jaji Kaijage apitie mwenendo mzima wa kesi hiyo kwani Hakimu Mkazi anayeisikiliza kesi hiyo, Alocye Katemana, alionyesha kuupendelea upande wa mlalamikaji (Manji).
"Nakukuhakishia kuwa ni wakili wa Mengi ndiye aliyemwandikia Jaji Mfawidhi Kaijage barua ya malalamiko kwamba Hakimu Mkazi Katemana ameonekana kupendelea upande mmoja na jalada hilo limefika leo hapa Mahakama Kuu na hivi lipo mbioni kupelekwa kwa Jaji Kaijage ili aweze kuyafanyia kazi maombi ya wakili wa Mengi," kilisema chanzo chetu.
Hata hivyo, alipotafutwa wakili Ngaro ili athibitishe taarifa hizo hakuweza kupatikana, kwani simu yake ilikuwa ikiita bila majibu.
Gazeti hili lilipomtafuta wakili wa Manji, Mabere Marando, alithibitisha kuwepo kwa taarifa hizo za wakili Ngaro kuwasilisha malalamiko hayo Mahakama Kuu lakini hata hivyo kwa upande wao wanachosubiri ni kuitwa na mahakama.
Februari 15 mwaka huu, Hakimu Mkazi wa Mahakama ya Kisutu, Katemana alitupilia mbali ombi la Mengi lililotaka mahakama hiyo iwapatie nakala ya uamuzi iliyoutoa Februari 11 mwaka huu, kwa sababu Sheria ya Mabadiliko ya Sheria ambazo zimeandikwa Na. 25 ya mwaka 2002, inakataza upande wowote katika kesi yoyote kwenda mahakama ya juu kupinga amri za muda zinazotolewa na mahakama ya chini hadi kesi ya msingi itakapomalizika na kutolewa hukumu.

Jalada hilo lilitishwa katika mahakama kuu na Jaji Mfawidhi, Semistocles Kaijage, kufuatia ombi la Mengi kupitia kwa wakili wake, Michael Ngalo.

Katika ombi hilo, Mengi alilalamikia kile alichodai kuwa ni kutokuridhishwa na namna hakimu Aloyce Katemana, anavyondesha kesi hiyo.Malalamiko hayo yalikufuatia tukio la Februari 11 mwaka huu, wakati haki huyo, alipozikataa nyaraka 14 zilizowasilisha na Mengi ili ziwe sehemu ya vielelezo vya ushahidi katika utetezi wake.

Februari 23 mwaka huu, wakili wa Mengi, Ngalo alindika barua kwenda Mahakama Kuu ya Tanzania, akilalamikia jinsi hakimu Katemana anavyoiendesha kesi hiyo.Alidai kuwa hakimu huyo alikuwa analia upande mmoja na kwamba hata uamuzi wake ulikuwa wa mashaka.

Wakili huyo alimuomba Jaji Kaijage, alipitie jalada la kesi hiyo.Hata hivyo habari zilizopatikana jana zilisema baada ya kupitia jalada hilo, Jaji Kaijage, aliridhika kuwa hakuna ukiukwaji wa sheria wala taratibu katika uendeshaji wa kesi hiyo na hivyo kuagiza jalada lirejeshwe katika Mahakama ya Kisutu, ili kesi iendelee kusikilizwa mbele ya hakimu Katemana.

Pamoja na kurejesha jalada hilo, jaji Kaijage pia alimtaka wakili Ngalo kama atakuwa , awasilishe ombi katika Mahakama ya Hakimu Mkazi Kisutu, ombi la kutaka hakimu huyo ajitoe kusikiliza kesi hiyo.

Habari zilisema tayari jalada hilo limekwisha rejeshwa katika Mahakama ya Kisutu, tangu juzi.

Awali, Hakimu Katemana alitupitilia mbali ombi la Mengi kupitia wakili wake , la kutaka kukata rufaa katika Mahakama Kuu ya Tanzania kupinga uamuzi wa Februari 11 mwaka huu, kwa sababu sheria hairuhusu panapotokea ubishi mdogo wa kesheria na ambao hauwezi kumaliza kesi, kukatiwa rufaa au kufanyiwa mapitio.

Awali Februari 11, mwaka huu, Katemana alitoa uamuzi Katika kesi hiyo ya madai ya Sh1 iliyofunguliwa na Manji dhidi ya Mengi na zilizotupiliwa mbali, nyaraka 14 zilizowasilishwa na Mengi kwa madai kuwa hazina msingi.

Nyaraka hizo ni pamoja na mkataba kuhusu kampuni ya Quality Finance Cooparation Group na Kagoda Agriculture.Nyaraka hizo za Mengi zilitupiliwa mbali mahakamani hapo kwa sababu zilikuwa hazina kibali kutoka kwa ofisa wa serikali na kwamba hazimuhusu Manji.

Uamuzi huo ulikuja baada ya Wakili wa Manji, Mabere Marando,kuiomba mahakama ya kufuta nyaraka zilizowasilishwa na Mengi kwa maelezo kuwa zinapingana na matakwa ya kisheria.Marando alidai kuwa sheria inakataa nakala zisizo halisi, lakini ipo sheria ambayo inaruhusu kuomba kibali ambacho ilitakiwa upande wa Mengi wakipeleke kabla ya kuanza kusikilizwa kwa kesi hiyo.

"Na kama waraka unahusu serikali unatakiwa ufanyiwe marekebisho na ofisa aliyetoa nyaraka hizo na kwamba inatakiwa zilipiwe,lakini upande wa Mengi vitu hivyo vyote havijafanyika,"alidai Marando.

Aliongeza kudai kuwa kutokana na hoja hizo,nyaraka zote zilizopelekwa mahakamani hapo na upande wa Mengi hazina msingi na zinapaswa kuondolewa mahakamani.

HATIMAYE Mahakama Kuu Kanda ya Dar es Salaam imetoa amri ya kurudishwa katika Mahakama ya Hakimu Mkazi Kisutu, Dar es Salaam, jalada la kesi ya madai ya kashfa ya shilingi moja iliyofunguliwa katika Mahakama ya Hakimu Mkazi Kisutu na mfanyabiashara Yusuf Manji dhidi ya Mwenyekiti wa Makampuni ya IPP Ltd, Reginald Mengi na ITV.
Jalada la kesi hiyo lilitua katika Mahakama Kuu Machi 23 mwaka huu, likitokea Mahakama ya Hakimu Mkazi Kisutu kutokana na barua ya Februari 23 mwaka huu, iliyoandikwa na wakili wa mdaiwa (Mengi), Michael Ngaro, kwa Jaji Mfawidhi, Semistocles Kaijage, ambaye aliomba Jaji Kaijage apitie mwenendo mzima wa kesi hiyo kwani hakimu mkazi anayeisikiliza kesi hiyo Aloyce Katemana ametoa maamuzi kadhaa yanayoonyesha anaupendelea upande wa mlalamikaji (Manji).
Vyanzo vya kuaminika kutoka ndani ya Mahakama Kuu, vililihakikishia Tanzania Daima kuwa tayari Jaji Kaijage alishatimiza wajibu wake wa kulipitia jalada hilo na kwamba amebaini hakuna sheria zozote zilizokiukwa na Hakimu Mkazi Katemana hivyo ameamuru jalada hilo lirudishwe katika Mahakama ya Kisutu ili kesi hiyo iendelee kusikilizwa na hakimu yule yule Katemana.
"Tunakuhakikishia kwamba Jaji Mfawidhi Kaijage alishatimiza wajibu wake wa kulipitia jalada hilo na amebaini kuwa Hakimu Mkazi Katemana hakupindisha sheria yoyote hivyo ameliamuru jalada hilo lirejeshwe katika Mahakama ya Kisutu na Hakimu yule yule Katemana ndiye aendelee kulisikiliza.
"Na jalada la kesi hiyo ya Manji na Mengi limeshatoka hapa Mahakama Kuu tangu jana (juzi) na kupelekwa Mahakama ya Kisutu kwa Hakimu Katemana…hivyo ukienda Mahakama ya Kisutu utaweza kujua kesi hiyo imepangwa tarehe ipi kwa ajili ya kutajwa ama upande wa mlalamikaji (Manji) kuendelea kujitetea," vilisema vyanzo vyetu.
Hata hivyo, alipotafutwa Jaji Mfawidhi wa Mahakama Kuu Kanda ya Dar es Salaam, Kaijage ili aweze kuthibitisha taarifa hizo jana saa tisa mchana hakuweza kupatikana kwa sababu simu yake ya kiganjani ilikuwa haipatikani.
Februari 15, mwaka huu, Hakimu Mkazi Katemana alitupilia mbali ombi la Mengi lililotaka mahakama hiyo iwapatie nakala ya uamuzi iliyotolewa na hakimu huyo lakini hakimu huyo alikataa kwa sababu Sheria ya Mabadiliko ya Kanuni Na. 25 ya mwaka 2002, inakataza upande wowote katika kesi yoyote kwenda mahakama ya juu kupinga amri za muda zinazotolewa na mahakama.

RESIDENT Magistrate Aloyce Katemana presiding over the defamation lawsuit of businessman Yusuf Manji against IPP Executive Reginald Mengi and ITV on Friday withdrew from the case at the Kisutu Resident Magistrate's Court.

The Magistrate said that reasons for his withdrawal could not be mentioned in public. In the case, Mr Manji is suing Mengi for broadcasting defamatory statements on one of his media outlets (ITV) that claimed his business dealings are done corruptly and unlawfully.

Mr Manji wants Mengi to pay a fine of one shilling. Previously, according to court reports, on February 23, this year, Mengi's counsel led by Advocate Michael Ngalo, submitted a letter to the High Court Registrar dated February 14.

In the letter, the counsel wanted the case proceedings at Kisutu Resident Magistrate's Court be put before the Judge in charge of Dar es Salaam Zone, Semistocles Kaijage, or another judge of the High Court so that he could examine their correctness, priority, legality or otherwise of various rulings and orders and in particular, the one delivered on February 11, this year.

The letter is mainly concerned with the ruling delivered by Resident Magistrate Aloyce Katemana at Kisutu Resident Magistrate's court on February 11.

In the ruling, the Magistrate had thrown away the defendant's pray to use documents submitted as evidence for Kagoda Agriculture Limited and Quality Finance Corporation Limited whose executive is Yusuf Manji.

Magistrate Katemana had ruled against the defendant's pray because the documents concerned were for the plaintiff's companies and not himself.

The court also cited that the contract document between Kagoda Agriculture Company Limited and Quality Finance Corporation Limited were not in the list of evidence filed in court.

Last week, the High Court after examining the case proceedings referred the case back to the same Magistrate Aloyce Katemana who yesterday withdrew from it. The case was adjourned to April 15 for another mention.

According to the plaintiff, the defendant allegedly defamed Mr Manji on April 23, 2009, in a special programme that was broadcast on ITV soon after the 8:00 pm news bulletin.

Mr Manji, the plaintiff in the case, said the meaning in the broadcast word meant, and were understood to mean, that he was guilty of numerous serious offences and that he was a criminal who has committed and continued to commit other serious offences.

According to Mr Manji, the defendant's statements also meant that he had committed grand corruption, had stolen public property and had planned to murder several people including Mengi.

The plaint insists that such statements were false. Manji wants the court to order the defendant to broadcast an apology for seven days consecutively and retract permanently from making such statements in the future.

Meanwhile, the High Court yesterday adjourned the Ubungo constituency election petition case filed by Hawa Ng'umbi of CCM against John Mnyika of Chadema to April 18.

The case, which had come to hear oral submissions by the claimant, Ms Ng'umbi, who wants the court to allow her to proceed with the case without paying security, cost for running the case.

According to the election law, a claimant in any election petition case is to pay 5m/- for each of the respondent in it.

The case was adjourned to April 18 when Judge Upendo Msuya shall give a ruling on whether Ng'umbi should pay the security cost or not.

In the case, Ng'umbi is challenging the 2010 parliamentary election results for Ubungo constituency in which Mnyika of Chadema won.

Apart from Mnyika, the petition is also against the Attorney General and the Ubungo's National Election Commission (NEC) returning officer.

MAHAKAMA ya Hakimu Mkazi Kisutu, jijini Dar es Salaam, imepiga marufuku vyombo vyote vya habari kuripoti kesi ya madai ya Sh1, iliyofunguliwa na mfanyabiashara maarufu Yusuph Manji, dhidi ya Mwenyekiti Mtendaji wa IPP, Reginald Mengi, kwa tuhuma za kumkashifu kwa kumtaja kuwa miongoni mwa mafisaidi papa.

Agizo hilo la kwa vyombo vyote vya habari, lilitolewa saa 7:15 mchana wa jana na Hakimu Mkazi Mkuu Mfawidhi wa mahakama hiyo, Ilvin Mgeta, wakati kesi hiyo ilipofikishwa kwa ajili ya kutajwa.

Hata hivyo hakimu huyo hakusema kama kuna upande wowote katika kesi hiyo,umelalamikia namna vyombo vya habari vinavyoripoti kesi hiyo na wala hakutoa kielelezo chochote kinachoonyesha jinsi vyombo vya habari vinavyokiuka kuripoti mwenendo wa kesi hiyo.

Akitoa agizo hilo, Hakimu Mgeta alisema
"kabla ya kupanga tarehe ya kutajwa kwa kesi hii nina maelekezo na kwamba hakimu atakayeendelea kuisikiliza kesi, mtajua siku hiyo kesi itakapokuja kuendelea kusikilizwa.

"Maelekezo ni kwamba kesi hii imeripotiwa sana na vyombo vya habari ila kinachotupa tabu ni kuripotiwa kwa shahidi kasema nini mahakamani, kaulizwa nini na kajibu nini hivyo taarifa zinapokinzana, zinaathiri uhuru wa hakimu na mahakama kwa jumla,"alisema hakimu Mgeta.

Alisema mahakama ni mahakama ya watu na kwamba kila mtu atakuwa huru kuingia kutazama na kusikiliza mwenendo mzima wa kesi hiyo isipokuwa haitakuwa ruhusa kwa chombo chochote cha habari, yawe magazeti au eletroniki, kuripoti ushahidi wa kesi hiyo.

Kabla ya kutolewa kwa agizo hilo, mmoja wa mawakili wa Manji, Tausi Abdallah, alidai kuwa kesi hiyo ilifikishwa kwa ajili ya kutajwa. Hakimu Mgeta aliiahirisha hadi Juni 3 mwaka huu itakapoendelea kusikilizwa.

Katika kesi hiyo, Manji anadai fidia ya Sh1 kutoka kwa Mengi kwa madai kuwa amemkashifu kwa kumwita kuwa ni mmoja mafisaidi papa.

Manji pia anaiomba mahakama imwamuru Mengi na Kituo cha Televisheni cha ITV, kurusha kipindi cha kuomba msamaha kwa siku saba, mfululizo kupitia kituo hicho.Mengi anadaiwa kumkashfu Manji Aprili 23 mwaka 2009 katika kipindi maalumu kilichorushwa na ITV baada ya taarifa ya habari ya saa mbili usiku.

Katika kesi hiyo, Manji anatetewa na mawakili, Mabere Marando, Richard Rweyongeza, Dk Ringo Tenga na Malima.

Mengi kwa upande wake, anatetewa na mawakili Michael Ngaro, Ringia na Njau.
