Alisema kama kuna watu wanaohusika watawajibishwa kama walivyowajibishwa wengine kwa kuwa suala linalohusu masilahi ya nchi halina mbunge wa upinzani wala wa CCM.

Dodoma. Sakata la uchotaji wa Dola za Marekani 200 milioni katika akaunti ya Tegeta Escrow limeendelea kuibuka kwa sura mbalimbali bungeni. Safari hii, Bunge limetakiwa kueleza ni kwa nini Ripoti ya Taasisi ya Kuzuia na Kupambana na Rushwa (Takukuru) isifikishwe katika chombo hicho cha kutunga sheria sambamba na ile ya Mdhibiti na Mkaguzi Mkuu wa Hesabu za Serikali (CAG).

Hayo yalijitokeza bungeni jana baada ya wabunge kadhaa kusimamia wakitaka mwongozo wa Spika kuhusu uchunguzi huo, hasa kutokana na kuwapo taarifa kuwa ripoti ya CAG itawasilishwa bungeni mwishoni mwa mwezi huu, lakini ile ya Takukuru ambayo pia inachunguza suala hilo, haitapelekwa bungeni wala kujadiliwa.

Uchunguzi wa Akaunti ya Escrow uliamuliwa na Serikali baada ya Mbunge wa Kigoma Kusini (NCCR-Mageuzi), David Kafulila kulipua ufisadi uliotokana na utata katika uchotaji wa fedha kwenye akaunti hiyo katika Benki Kuu ya Tanzania (BoT) baada ya kutokea mgogoro wa kibiashara baina ya Shirika la Umeme Tanzania (Tanesco) na Kampuni ya kufua umeme ya IPTL.

Katika mgogoro huo, Tanesco ilikuwa inabishia kiwango cha fedha ilichokuwa inalipa kwa gharama za uwekezaji kwa IPTL, ndipo ikaamuliwa na Mahakama ifunguliwe akaunti hiyo ili fedha ilizokuwa inalipa ziendelee kuwekwa huko hadi mgogoro utakapokwisha. Kesi hiyo iliamuliwa katika mazingira yanayoelezwa kuwa na utata na fedha hizo kuchukuliwa haraka na IPTL.

Jana, baada ya kipindi cha maswali na majibu, wabunge kadhaa walisimama wengi wakiwa wa upinzani wakitaka mwongozo kuhusu lini ripoti hizo mbili zitawasilishwa bungeni hasa baada ya ile ya Takukuru kuelezwa na Mkurugenzi Mkuu wake, Dk Edward Hoseah kuwa imekamilika na kukabidhiwa kwa Waziri Mkuu.

Mbunge wa Arumeru Mashariki (Chadema), Joshua Nassari ndiye aliyefungua mlango wa kuomba mwongozo wa Spika akitaka kujua ni lini ripoti hiyo itawasilishwa na kwa nini isiambatane na ile ya CAG kwa kuwa zote zinatokana na maazimio ya Bunge kutaka uchunguzi huo ufanyike.

Pia Nassari alihoji kwa nini mjadala wa ripoti ya CAG umepangwa siku mbili za mwisho kabla ya kumalizika kwa mkutano wa Bunge.

"Naomba maelezo kwa nini hii ya Takukuru haitaletwa wakati imeelezwa kuwa Waziri Mkuu ameshakabidhiwa?" alihoji Nassari.

Akijibu, Naibu Spika, Job Ndugai alisema Kamati ya Uongozi imeshajadili suala hilo na kuamua kwamba ripoti ya CAG itapitia kwenye Kamati ya PAC inayoongozwa na Zitto Kabwe na kuwasilishwa bungeni.

"Ripoti ya CAG itawasilishwa kwenye Kamati ya PAC na wabunge mtakabidhiwa nakala kama tulivyokubaliana kwenye Kamati ya Uongozi," alisema Ndugai na kuongeza:

"Ripoti itawasilishwa tarehe 26 mwezi huu kama ilivyorekebishwa kwenye ratiba. Kuhusu suala la kupangwa mwishoni ni suala la kanuni kwa kuwa huwa tunaanza na shughuli za Serikali kwanza halafu ripoti zinafuata."

Kuhusu ripoti ya Takukuru, Ndugai alisema haiwezi kuwasilishwa bungeni kwa kuwa taasisi hiyo ikishamaliza shughuli zake inaweza kuchukua hatua kwa kupeleka taarifa kwa Mkurugenzi wa Mashtaka (DPP) kwa ajili ya hatua zaidi.

"Ripoti ya Takukuru haiwezi kuja hapa, tutajadili nini? Takukuru wakishachunguza wanachukua hatua," alisema Ndugai.

Akizungumzia ripoti ya Takukuru kuwasilishwa kwa Waziri Mkuu, Ndugai alisema si kweli, bali alichopewa ni mwenendo wa uchunguzi hivyo akawaomba wabunge wawe na subira kuhusu suala hilo.

Kauli ya kwamba ripoti ya Takukuru haitawasilishwa bungeni ilizua minong'ono na wabunge kadhaa kusimama. Ndugai alitoa nafasi kwa Zitto huku Kafulila akiwa amesimama.

Zitto alisema kamati yake itahitaji taarifa ya ziada kutoka Takukuru kuhusu mambo ya jinai ambayo yanazungumzwa kwa kuwa taarifa ya CAG haitoshi.

"Maelezo ya Naibu Spika yako sawa kabisa lakini ripoti ya Takukuru itatusaidia katika suala la uchunguzi. Hakuna namna tunaweza kukwepa ripoti ya Takukuru," alisema Zitto.

Alimwomba Ndugai kuiagiza Serikali kuwasilisha ripoti zote mbili na mahojiano ya wanaohusika yafanyike kwa uwazi ili minong'ono iishe.

"Kumekuwa na minong'ono inatembezwa kwa wabunge kuwa kuna watu wamehongwa au wanalipwa fedha kuhusu suala hili, haya mambo yafanyike kwa uwazi na kumaliza minong'ono hiyo," alisema Zitto.

KUTOKANA na kashfa za ufisadi zinazozidi kuiandama Serikali ya Rais Jakaya Kikwete huku kukionekana kuwepo kwa danadana katika kuchukua hatua dhidi ya wahusika, Kambi ya Upinzani Bungeni imemtaka Rais kumfukuza kazi Waziri Mkuu Mizengo Pinda na kuunda serikali upya la sivyo itaanza maandalizi ya kuwasilisha hoja ya kutokuwa na imani na rais mwenyewe.

Akizungumza na waandishi wa habari waliotaka ufafanuzi wa ziada baada ya kutoa kauli mbalimbali kuhusu kashfa za ufisadi wa ujenzi wa bomba la gesi na Akaunti ya Escrow kwenye mkutano wa hadhara uliofanyika jana mjini Kigoma, Kiongozi wa Kambi hiyo (KUB), Freeman Mbowe, alisema kuwa kumfukuza kazi Waziri Mkuu na kuunda upya Baraza la Mawaziri itakuwa suluhisho la muda mfupi kuelekea uchaguzi mkuu na kuinusuru nchi.

Mbowe ambaye pia ni Mwenyekiti wa Chama cha Demokrasia na Maendeleo (CHADEMA), alisema kuwa Baraza la Mawaziri linaonekana kushindwa kazi ya kumsaidia rais, akitoa mfano kuwa, limeshindwa kumshauri Rais Kikwete kwenye suala la Katiba Mpya ili uwe mchakato wenye kuzingatia maridhiano na muafaka wa kitaifa, hivyo kujikuta nchi ikikosa uongozi wa kisiasa.

Aliongeza kuwa, kashfa za ufisadi ni eneo jingine ambako serikali imeonesha udhaifu mkubwa huku Ikulu, mawaziri waandamizi, Ofisi ya Waziri Mkuu, Ofisi ya Mwanasheria Mkuu, baadhi ya majaji na familia ya rais, wakituhumiwa kuhusika katika kashfa kubwa zinazolitikisa taifa kwa sasa, hususan IPTL na ujenzi wa bomba la gesi.

“Kila kitu kiko wazi, Serikali ya CCM imeelemewa. Kashfa IPTL kwenye sehemu ndogo tu ya Akaunti ya Escrow inaitikisa, haina pa kutokea. Imebanwa kila kona. Lakini kuna hii kashfa mpya ya ujenzi wa bomba la gesi kutoka Mtwara kwenda Dar es Salaam, ambayo inavunja rekodi ya ufisadi wote nchini, serikali nzima inajua, haiwezi kutoka.

“Waziri Mkuu yupo, anasema amechoka, Rais yupo naye juzi akiwa China amesema amechoka…kama wamechoka basi waondoke sasa. Maana nchi iko kwenye wakati mgumu. Tunahitaji uongozi imara. Nchi iko kwenye hati hati, ufisadi unazidi kutamalaki. Kuna ombwe kubwa la uongozi wa kisiasa katika masuala nyeti kama mchakato wa Katiba Mpya.

“Ufisadi unasababisha hospitalini hakuna dawa, yaani hatuna fedha za kulipa deni MSD wananchi wapate dawa, lakini tunazo fedha tena matrilioni za kujiibia sisi wenyewe kwa sababu viongozi wanawajibika wa mifuko yao zaidi. Mawaziri hao hao ndiyo wanatuhumiwa kwenye ufisadi huu mkubwa. Imefikia mahali kwenye sakata la Escrow waziri amehongwa bilioni, hapo kuna waziri tena?

“Huduma za msingi kama elimu, maji, umeme nyingine zinayumba, mbovu au hakuna kabisa maeneo mengi, lakini ufisadi umewekwa mbele. Ufisadi unasababisha wafadhili wamekata ufadhili, yote haya yanaendelea Baraza la Mawaziri lipo, limeshindwa kumsaidia rais. Tunamtaka Rais Kikwete amfukuze kazi Waziri Mkuu na aunde upya Baraza la Mawaziri,” alisema Mbowe na kuongeza;

“Hiyo itamsaidia yeye walau amalize ngwe yake…kwa mwaka mmoja uliobakia. Kwa sababu ni hatari sana kwa nchi…as a country we are going to crash. Huwezi kuwa na rais ambaye amesema mwenyewe amechoka, waziri mkuu amesema amechoka, mawaziri wanahongwa tu kisha wanasema wamepewa zawadi, kisha ukategemea serikali imara…ni hatari sana kwa nchi.

What CAG found out in escrow deal

Dar es Salaam/Dodoma. Pan African Power Solutions (T) Limited (PAP) did not legally acquire 70 per cent of Independent Power Tanzania Limited (IPTL) from Malaysia-based company Merchmar Berhad, an investigation by the Controller and Auditor General (CAG) has established.


PAP is owned by Kenyan tycoon Harbinder Singh Sethi, who claims that he did not come to Tanzania to make money but to help end chronic electricity problems in the country.


The CAG has also established that all money in the Tegeta escrow account was supposed to be paid back to Tanzania Electric Supply Company (Tanesco) because the state-owned power utility had been overcharged a total of Sh321 billion by IPTL between 2002 and 2012.


According to two senior officials from the CAG’s office, who were among investigators who probed the multibillion-shilling scandal, Mr Sethi presented forged documents to the Tanzania Revenue Authority (TRA) and Business Registration and Licencing Authority (Brela) in an attempt to hide the dubious nature of the transactions.

The Citizen exclusively reported last month that documents submitted by PAP to TRA show that Mechmar purportedly sold its 70 per cent stake in IPTL in September 2013 for a paltry Sh6 million.

Mr Sethi and his son own 50 per cent of PAP, while the rest is owned by a company called Simba Trust that is said to be incorporated in Australia, according to investigations conducted by The Citizen.

What brings the transaction into question is the fact that at the time of the purported sale of shares, IPTL had power plants located in Tegeta, Dar es Salaam, worth millions of dollars plus cash totalling $250 million—including $122 million sitting idle in an escrow account that was under the custody of the Bank of Tanzania (BoT).

Billions of shillings were paid to Mr Sethi from the account after he convinced the relevant officials he had acquired the 70 per cent stake in IPTL from Mechmar, which enabled him to reach out-of-court settlements with VIP Engineering and Marketing, a local firm that owned 30 per cent of IPTL.

To reach a deal with VIP, Mr Sethi had to pay a whopping $75 million to acquire 30 per cent of IPTL in order to have full control of the Tegeta escrow billions as well as the power plants.

What does not add up, however, is 70 per cent of IPTL being acquired for only $3,750 (Sh6 million) and, a few weeks later, 30 per cent of the same company being bought for $75 million (Sh120 billion).

The documents show that Piperlink, a British Virgin Island offshore company, bought the 70 per cent IPTL stake for Sh6 million before transferring it to Mr Sethi for $300,000 (Sh480 million).

Investigators who spoke to The Citizen yesterday on condition of anonymity said a section of the media was waging a relentless propaganda war in support of a questionable transaction. “The CAG’s office acted professionally, and we established that PAP didn’t buy 70 per cent of IPTL as it claims…we were not tasked with taking anyone to court but to conduct a forensic audit to establish whether the deal was aboveboard or shady. We concluded that it was shady,” one of the officials said.

The CAG investigation has also established that Attorney General Frederick Werema erred by granting a tax exemption to PAP, which was paid $122 million (Sh207 billion) from the escrow account.

Details gathered by The Citizen show that the AG’s role is bigger than just unlawfully granting a tax waiver to PAP because he also acted as the lead legal counsel and facilitated payment of billions of shillings to Mr Sethi. For instance, in September, last year, the AG wrote to Tanesco’s former chief legal counsel, Mr Godwin Ngwilimi, instructing him to travel to Malaysia on a fact-finding mission related to the PAP’s purported acquisition of the 70 per cent stake in IPTL.


Mr Ngwilimi, who was later forced to resign by the Tanesco board, travelled to Malaysia and established that the purported acquisition did not take place, but the AG overruled him and advised that the escrow billions be paid to PAP.

PAP was supposed to pay tax as directed by TRA, but Mr Werema wrote a letter instructing that the company should not pay value added tax (VAT). The AG has no legal mandate to grant tax exemption as this is the preserve of the Finance minister.


The CAG team has also established that the Ministry of Energy and Minerals failed to obtain proof that PAP had actually acquired the IPTL stake.

Energy and Minerals Permanent Secretary Eliakim Maswi facilitated the release of the escrow billions to PAP without having concrete proof of the purported acquisition.

As a result, Tanesco incurred a loss of Sh306 billion in inflated charges by IPTL between 2002 and 2012.

In fact, according to the CAG team, IPTL still owes Tanesco an extra Sh15 billion because the total amount the state-owned utility has been overcharged is Sh321 billion.

The Tanesco board of directors rescinded its earlier decisions, allowing PAP to be paid billions of shillings as well as being granted a contract extension despite the fact that all the money in the escrow account was supposed to returned to the state utility.

Earlier, the Tanesco board raised queries about the deal, but the very same board later rescinded its decisions and endorsed the deal in a questionable move, according to details gathered by the CAG team.

Contacted yesterday, Public Accounts Committee chairman Zitto Kabwe did not deny or confirm the details, only saying, “The public shouldn’t worry because everything is under control.”

Dar es Salaam. Corruption has reached alarming levels and is tarnishing the country's image, Foreign Affairs and International Cooperation minister Bernard Membe said yesterday.

Addressing the 1st Voice of Social Sciences International Conference 2014 organised by the College of Social Sciences of the University of Dar es Salaam, Mr Membe said corruption should be addressed as a matter of urgency and challenged academicians to research on its impact in society.

"There are other challenges such as poverty and problems in education and health, but corruption is by far the most serious, and pretending that it doesn't exist is an equally serious problem," he said.

He made the remarks a day after it was revealed that senior government officials were involved in the irregular payment of tens of billions of shillings to a firm which claimed to have acquired 70 per cent of Independent Power Tanzania Limited (IPTL).


Mr Membe cited the IPTL scandal as an example of the level of corruption in the country and its impact on the economy.


He said donor countries had withheld budget support totalling nearly Sh1 trillion for the current financial year pending the release of the Controller and Auditor General's report on the scam.

Now that the CAG's report is out, Mr Membe said, the Foreign Affairs and International Cooperation ministry would meet with the donor community today to discuss the way forward.

"We, as the government, have been striving to be transparent. The report by the CAG is out and appropriate measures will be taken against those found to be culpable," Mr Membe told journalists on the sidelines of the meeting.

Mr Membe advised Tanzanians to go for "clean and incorruptible" leaders who would be tough on corruption.

Speaking at the meeting earlier, Prof Sam Maghimbi echoed Mr Membe's remarks, saying corruption was crippling the economy.

He said only four out of every 10 shillings set aside for development were spent as planned with the rest ending up in the pockets of corrupt public officials and their collaborators.

Prof Maghimbi denied that scholars had turned a blind eye to corruption, but added that most of them chose not to be vocal because they feared for their lives.

"You can ask other professors and scholars who are here (he names some of them)…we are scared. When you conduct an independent research, you will be accused of taking sides. Some will go out of their way to silence you. Many of those accused of grand corruption are very powerful individuals," he said.
