Chadema yesterday filed an appeal notice against last week's nullification by the High Court of Mr Godbless Lema's election as Arusha Urban MP. Advocate Method Kimomogoro filed the notice at the Court of Appeal. Mr Kimomogoro represented Mr Lema in the election petition in which three voters successfully challenged the former lawmaker's election in the 2010 polls. "That was a notice of intention to appeal against the unseating of our MP. Other procedures will follow later," Chadema Arusha regional party secretary Amani Golugwa said.
He said the party was required to file its appeal against the High Court judgment within 14 days, adding that Chadema would by early next month be ready for the hearing of the appeal. Mr Golugwa added, however, that it would take some time for the appeal to start being heard after its actual filing. "There is the usual business of appointing judges who will hear the appeal and the need to give the appellant and respondents time to prepare their arguments," he said.
He said Chadema had decided to appeal after concluding that the verdict delivered last Thursday by Mr Justice Gabriel Rwakibalira was a "travesty of justice". "It was alleged that defamatory and abusive language was used against the CCM candidate, but she did not appear before the court to corroborate the claims. No concrete evidence was given to support these claims," Mr Golugwa said.
Chadema chairman Freeman Mbowe told a rally in Arusha on Saturday that the party would appeal against Mr Lema's unseating. "To decide against an appeal and wait for the by-election will amount to accepting defeat and the wild allegations levelled against Godbless Lema. We have decided to follow the full course of the law," Mr Mbowe said.
Mr Lema said on Thursday that Chadema would not appeal against the nullification of his election, adding that he preferred to stand in a by-election straight away.
