THE National Assembly on Saturday resolved that the government should take appropriate action against the Chief Secretary, Mr Phillemon Luhanjo, and the Controller and Auditor General, Mr Ludovick Utoh, following unlawful collection of money to finance endorsement of the Ministry of Energy and Minerals' annual budget.

The House has also resolved that the government should take disciplinary and legal action against the Minister for Energy and Minerals, Mr William Ngeleja, his Deputy Minister Mr Adam Malima and the Permanent Secretary for the Ministry of Energy and Minerals, Mr David Jairo, over similar offences.

The resolutions followed a report by a Parliamentary Select Team that established that Mr Jairo collected the money contrary to the laws of land and government's regulations.

Mr Jairo wrote letters to Tanzania Petroleum Development Corporation (TPDC) requesting 50m/-, the Rural Energy Authority (REA) asking for 50m/-, TANESCO (40m/-) and EWURA (40m/-) for finalization of a budget process of the ministry.

Three institutions contributed as requested except for EWURA who resorted to financing dinners at a total cost of 9,797,600/-. Presenting the report, the Chairman of the team, Eng. Ramo Matala Makani (Tunduru North-CCM), revealed that the ministry, through Mr Jairo's initiative collected 418,081,500/- posting it in the bank account of the Geological Survey of Tanzania (GST).

Mr Makani revealed further that out of the amount, payment of 126,044,480/- were doubtful and therefore the National Assembly resolved that a forensic audit should be conducted to establish the validity of the payments.

The team questioned the rationale of such initiative considering the fact that the ministry had in June this year received 171,542,000/- from the Treasury as other charges. Available documents show that the ministry had 35,500,000/- for such purpose while requirements stood at 207,042,000/-.

According to the report, available ministry's documents showed that 17,480m/- were paid on July 19, 2011 to African Dreams Conference Centre Ltd for food and entertainment for five consecutive days without supporting documents.

It also uncovers that the ministry claimed to have paid 39m/- for renting Pius Msekwa Hall for a seminar for MPs while actually the hall is offered free of charge for any MPs seminars.
"The team also failed to establish as to why the number of allowance recipients (during the budget session in Dodoma) who are officials of the ministry rose drastically from 103 to 243, from the 61 permitted earlier," said Mr Makani.

The MPs resolved further that security organs should investigate payments of 88m/- during MPs seminar organized by the ministry in July this year as numbers of participants and amounts of money disbursed are said to have been forged. The report indicated that one motor vehicle with Registration Number. STJ 9429 consumed 230 litres of fuel per day while its logbook did not show that the vehicle travelled long distances that particular day.

Mr Makani stated that Mr Luhanjo should be taken to task for clearing Mr Jairo while knowing that the PS had violated laws and regulations of the country. "The Chief Secretary deliberately cleared Jairo by concealing the truth of the special audit conducted by the CAG, something that has misled Tanzanians", noted Mr Makani.

According to the Team report, the Chief Secretary has blatantly abused his office. He stated that the government should also take appropriate actions againstCAG for deliberately misleading the public. "The CAG in his opinion and conclusion in his audit report, said he did not respond to terms of references given to him by the Chief Secretary on authenticity of the contributions and their expenditures.

"He concentrated on establishing the number of institutions requested to contribute as not 20 and the amount raised was not 1bn/-, this was a total misleading" Mr Makani explained. The team Chairman said that the report of the CAG also failed to establish expenditure of 190,823,120/- which were identified by the Parliamentary Select Team.

On case of Mr Jairo, Mr Makani stated that the PS contravened the prescribed laws, regulations and rules of the country for making such collections and worse enough, some payments of the collected money were dubious. The MPs also said that the PS showed wanton disregard of the laws and regulations.

The report shows that Mr Ngeleja, his deputy Adam Malima and Mr Jairo were paid 4m/- each as entertainment allowance while they are receiving the same each month (Dah! WIZI MTUPU!). Although the Team failed to establish if Mr Ngeleja was directly involved in the scam, yet he was found irresponsible and negligent.

"According to job descriptions of a minister as stipulated in Cabinet guidelines, the minister was supposed to be aware of the move as he is the Overseer of the Ministry", stated Mr Makani.

Despite Bunge resolutions on the matter, during the debate of the report, MPs were divided over whether Mr Ngeleja and Mr Malima should resign over the offence committed by Jairo without their knowledge.

Some urged that the two cannot take responsibility for the offence committed by another person. Others said that the two were aware of the scam and it was a conspiracy. Most of the MPs who debated the report wanted all culprits to be prosecuted to instill discipline and spirit of good governance and restrain other government officials from committing similar offences.

They further called on the president to take urgent and stern action against the culprits as they tainted his image and that of the presidency. The MPs also attacked the CAG for discrediting his integrity and credibility.

The team was formed following recommendation floated by Mr Zitto Kabwe (Kigoma North-CHADEMA) following a tip-off by Ms Beatrice Shellukindo (Kilindi-CCM) who managed to obtain a copy of the letter written by Mr Jairo to institutions.

The National Assembly also resolved that all ministerial officials who were involved in the financial scam be taken to task. It questioned 147 people including the Prime Minister, Mizengo Pinda, former three Premiers, Mr Luhanjo, several former and existing ministers, 17 MPs, former Speaker of the National Assembly Pius Msekwa and Clerks of Parliament, heads of several government institutions and other prominent people.

Christopher Ole Sendeka (Simanjiro-CCM) and James Lembeli (Kahama-CCM) bitterly said that the officials have tainted the image of the president and the State House. "For Ikulu to remain a sacred place, Luhanjo and Jairo should be prosecuted for abuse of office, and I'll not remain silent until justice prevails," charged Mr Ole Sendeka.

On his part, Mr Tindu Lissu (Singida East-Chadema), quoting the report, noted that the ministry's officials were being paid as much as 900,000/- each as per diem allowance when they were in Dodoma. He added that all the officials plus heads of the institutions which contributed the money had committed criminal offences.

Parliamentary probe committee’s report fingers Luhanjo, Ngeleja, Malima, Jairo and Utouh

Dodoma. Parliament yesterday called for stern disciplinary measures, including dismissal, against five senior government officials, among them Energy and Minerals minister William Ngeleja and Chief Secretary Philemon Luhanjo.


Also mentioned in the report of a parliamentary select probe committee tabled in Dodoma were Controller and Auditor General (CAG) Ludovick Utouh, suspended Energy and Minerals Permanent Secretary David Jairo and deputy minister Adam Malima.


In a heated and sometimes emotional debate on the last day of the fifth sitting of Parliament, MPs bayed for the blood of the five after they were implicated in embezzlement, forgery and cover-up of corruption at the ministry.


MPs who debated the report said they were shocked at its findings and urged the President crack the whip to rid the government of corrupt officials and show that it was committed to good governance.


Committee chairman Ramo Makame tabled the report after investigations were instituted in August into allegations that Mr Jairo had dubiously collected over Sh400 million to influence the passage of his ministry’s budget.


Yesterday’s debate was reminiscent of the 2008 report on the infamous Richmond emergency power scandal, popularly referred to as the ‘Mwakyembe Report’, that prompted the resignation of the then Prime Minister, Mr Edward Lowassa, and Cabinet ministers Nazir Karamagi and Ibrahim Msabaha.


Mr Makame (Tunduru North-CCM) said Mr Jairo abused the powers of his office and irregularly collected millions and misappropriated tens of millions of shillings. The PS was accused of abetting theft at the ministry, with findings showing that he approved fraudulent allowance claims by senior officials.


The committee said in its 150-page report that Mr Ngeleja should either shoulder responsibility and resign or be sacked by the President for presiding over impropriety at the ministry and its agencies.


Mr Luhanjo, who is based at State House, was accused of deliberately suppressing the truth to get Mr Jairo off the hook. Mr Luhanjo and Mr Utouh, who has in recent years won praise for his annual government audit reports, was accused of coming up with findings the committee felt were misleading and only aimed at exonerating Mr Jairo.


The committee suggested that disciplinary measures be taken against Mr Luhanjo, who is a presidential appointee. Mr Utouh on the other hand, should be investigated as to why he gave misleading findings and advice after he was asked to investigate the Jairo saga by Mr Luhanjo.


Mr Makame said the committee interviewed 146 people and collected 32 official documents during its investigation.


He said the ministry planned to spend Sh207 million to facilitate the tabling of the budget, Sh171 million of which was collected from agencies on the orders of the PS.


He said while 69 was the actual number of ministry officials assigned duties in Dodoma during the tabling of and debate on the Energy and Minerals budget, this was inflated to 243 individuals, who were supposedly paid Sh127 million in five days.


“There were 182 ghost officials in attendance,” Mr Makame said, adding allowances were inflated by up to 400 per cent.


He said ministry officials brazenly used seminars to steal public funds. “Funds were set aside to pay for the Pius Msekwa Hall in Dodoma, but it is common knowledge that the venue is available free of charge to MPs. While only 150 MPs attended one of the seminars organised by the ministry, records showed that allowances were paid to 350 parliamentarians,” Mr Makame said.


Allowances paid to each participant ranged from Sh20,000 to Sh80,000, but figures were altered to show Sh120,000 and 180,000. Moreover, ministry records show that officials used 15 vehicles in Dodoma and that each car used 230 litres of fuel a day.


“The committee could not find documents to account for Sh126 million of the Sh418 million collected by the ministry,” Mr Makame said, adding that both the minister and his deputy were paid Sh4 million each as entertainment allowance.


According to the report, Tanesco, Ewura, Rural Energy Agency (REA) and TPDC contributed the cash. Mr Makame said Tanesco contributed Sh40 million, TPDC Sh50 million, REA Sh50 million and Ewura paid Sh9.7 million for food and drinks.


The committee chairman told Parliament that officials in the agencies said they feared losing their jobs if they did not release the money.


MPs were unanimous that action must be taken to protect the integrity of the government and independence of Parliament.


The Leader of the Official Opposition in Parliament, Mr Freeman Mbowe, said there was a need to investigate all ministries, adding that misappropriation and outright theft of public funds was widespread in the government.


Mrs Beatrice Shellukindo (Kilindi-CCM), who in July read out in Parliament a damning letter that Mr Jairo sent to various agencies under the ministry, said MPs should demand concrete action.


She said the government must undertake major changes to promote accountability.


Mr Ezekiel Wenje (Nyamagana-Chadema), Mr James Lembeli (Kahama-CCM), and Mr Moses Machali (Kasulu Urban-NCCR-Mageuzi) said Mr Ngeleja and his subordinates must leave office immediately.


Mr Machali went further, saying: “I think the President and Prime Minister must also think of resigning if they will fail to deal with this matter effectively.”


Ms Anne Kilango (Same East-CCM) said state officials were sinking the nation deeper into poverty through greed.


“This is just one ministry…what if we look into others? It is time we acted to stop this theft by permanent secretaries if we are to serve the public diligently,” she said, and warned against the State’s tendency to ignore parliamentary resolutions.


Mr Hamad Rashid (Wawi-CUF) said the CAG had tarnished his good name, while Mr Christopher ole Sendeka (Simanjiro-CCM) asked President Kikwete to suspend all those adversely mentioned in the report.


Mr Tundu Lissu (Singida East-Chadema) said it was time to change the country’s leadership, adding that it had continuously failed Tanzanians.


Responding, the Minister in the President’s Office responsible for good governance, Mr Mathias Chikawe, said the government would implement the recommendations made in the report
