Government Withdraws Retirement Benefits for Former President Lungu After Return to Politics​

Former President Edgar Chagwa Lungu recently announced his return into active politics, to the surprise of no one. According to information in the public domain, it strongly suggests that he resigned as PF President in August 2021 and he then wrote to Cabinet Office informing them he was no longer party President and therefore entitled to his benefits as per Benefits of Former Presidents (Amendment) Act of 1998.

Cabinet Office obliged and have been paying him taxpayer money for his benefits as a former president, presumably because they did their due diligence and were satisfied that he was no longer in active politics. The Act states in Section 5(1) as follows:

5(1) The pension and other benefits conferred by this Act shall not be paid, assigned or provided to a former President who is—

(a) in receipt of a salary from the Government; or
(b) engaged in active politics

“Active politics” is defined in the Act to mean either “the doing of any act indicating a person’s intention to hold elective or appointive office” or “the holding of elective or appointive office” in a political party or in an organization whose main aim is the furtherance of political objectives.

All this raises a number of pertinent issues. Mr Lungu on 28th October 2023 declared out of his own mouth the following as quoted by News Diggers:

“I have decided to return to active politics and continue as president of PF…. I am back to active politics as PF president elected in 2021 with a mandate up to 2026. The PF will hold a general conference at the right time to choose a leader before the next elections in 2026. After this conference, I will hand over to whoever will be elected to lead the PF in the 2026 general elections.”

He was thus clearly admitting that he has been the PF president all along since 2021, hence the use of the word “continue” and referencing his “mandate” up to 2026. Three big issues immediately arise:

1. If Mr Lungu is still PF president from his election in 2021 by his own public admission, does it mean he is guilty of obtaining money under false pretences which is an offence under Zambian law? Why would he claim his benefits from the government if he was still PF president at the time? Does it mean he deliberately misled the government of Zambia that he was no longer in active politics (as defined by the Act) when in fact, he was?

2. Mr Lungu receiving his generous benefits on the basis of a misleading letter he wrote to Cabinet Office suggests he uttered a false document to the government of Zambia. The law frowns upon such, and he may be liable to being prosecuted for this.

3. If Mr Lungu is still the PF president and this was already known to Cabinet Office, why have they been spending hundreds of thousands of Kwacha on him, including spending possibly millions to build him a retirement home?

Mr Lungu might be at risk of being dragged to court for fraud, obtaining money under false pretences and uttering a false document to the government. Provided he did in fact resign as PF President and there is documentary proof of this, he will have to answer some very difficult questions on the witness stand to square his latest public statements with the letters on file.

If he ends up in court and faced with fines and possible jail time he retreats to the previous default position of retirement, his zombie party dies even faster. And it means his foot soldiers have to go fight Mr Miles Sampa without him and that fight will be very ugly and protracted with no prisoners taken.

Zambia's former President, Kenneth Kaunda, who jailed on Dec. 25 on charges of inciting a coup attempt, was released from prison today but put under house arrest.

Mr. Kaunda, 73, internationally known during his presidency for his leadership of black African opposition to South African apartheid, had been arrested soon after returning from a trip abroad. Today, he arrived home in the capital, Lusaka, after an 80-mile journey from the Mukobeko maximum security prison. He was escorted by about 100 heavily armed police officers, said his son, Wezi Kaunda.
Mr. Kaunda said his father did not accept the conditions imposed by President Frederick Chiluba in exchange for the release, including a ban on political activities, but was unsure how to protest them.
The United States, Britain, South Africa, Botswana, Libya and the Organization for African Unity all have called for the former President either to be put on trial or be released.
President Chiluba said today that he granted house arrest for Kenneth Kaunda after appeals from the former Tanzanian leader, Julius Nyerere, and President Robert Mugabe of Zimbabwe, the chairman of the Organization of African Unity.

Mr. Kaunda will be restricted to his home under a state of emergency enacted after the Oct. 28 coup attempt. He will not be allowed to engage in politics, give interviews or issue press statements.
The police would have ''complete access'' to Mr. Kaunda's villa and determine who could visit, he said.
''I hope he will cooperate because if he doesn't, maybe we will be compelled to take him back,'' Mr. Chiluba said. The restriction order, which would allow the police to arrest anyone coming within 100 yards of Mr. Kaunda's home without permission, will be reconsidered when the state of emergency decree is reviewed on Jan. 29. The curbs would be extended if investigations into his alleged role the failed coup are incomplete, Mr. Chiluba said.



Mr. Kaunda's lawyers plan to go to Zambia's High Court on Friday to press the Government to put him on trial and are expected to contest the house arrest conditions.

Mr. Kaunda led Zambia to independence from Britain in 1964. He governed for 27 years until he lost to Mr. Chiluba in the nation's first multiparty elections in 1991.

Tales of Colonial Life in Northern Rhodesia (Zambia)

Richard (Tim) Dening lived and worked in Northern Rhodesia (now Zambia) as part of the Colonial Administration from 1947 until independence in 1964. He was a District Commissioner in Mwinilunga, Mumbwa and Samfya Districts, later joining Central Government in Lusaka.
He was in charge of Districts which could be about the size of Wales (which has an area of approximately 20,000 square kilometres and is roughly equivalent to the size of the U.S. state of Massachusetts). The Districts contained small widely distributed populations and Tim would cover hundreds of miles visiting each village about twice a year (initially by bicycle!). He would hear appeals from the local courts, sort out complaints and land disputes, ensure the payment of tax to the local chiefly authorities, as well as a host of other tasks including maintaining bridges and roads.
Tim was ably assisted by his wife Elisabeth (Betty) who remembers life in the bush with something less than affection. However, their life in these isolated outposts threw up many fascinating tales to recount, some of which are included below. They are either written by Tim himself or reconstructed from stories told by Tim and Betty. There are also some excerpts from a local newsletter and a series of images of colonial life in the 1950s.

Zambia’s economy is controlled by foreigners​

The story of Zambia after 59 years of independence is a sad tale, though not unique to this landlocked country; it’s similar to that of many post-independence African states.

Zambia, which has great potential, is surrounded by eight countries. Unfortunately, the mineral wealth, water resources and the arable land does not in any way benefit the people directly.

The problem for Zambia, like that of most of the continent, is the problem of ownership of the means of production. Strategic sectors of this country’s economy are not in the hands of Zambians.

The Republic of Zambia, which came into being on 24 October 1964, promised innovation and adequate resource mobilisation, including state ownership of all relevant sectors of the economy, with research and development being at the heart of nation building. The future of Zambia was as bright as a rising star. The kwacha was on par with the British pound and competed with other major currencies for the best years of post-independence.

But a few years later the performance of the currency became unstable, with a negative trajectory of other economic indicators such as inflation and unemployment. And in light of this observation, Zambia is worse off now after more than five decades of self-rule simply because the masses do not control economic activities that contribute to the GDP.

Zambian leaders’ lack of patriotism is shocking. Nation building does not only require sacrifice by the people. For almost six decades Zambians have been complacent when it comes to what matters the most in terms of fundamental change.

Forget about the “today here gone tomorrow” politicians and their promises. Zambians should wake up to the reality that collectively they do not own anything in this country which is their birthright.

These people have had the privilege of changing governments a few times, something which is unattainable in other African countries. Despite Zambia being a democracy and a great example for peace in the region, many people still wallow in poverty.

Here are a few things Zambians should consider to bring about the kind of change they need. They must recognise the problems for what they are — that the economy is predominantly in the hands of foreign investors. Government policies since the early 1990s are more favourable for foreign direct investment at the expense of local entrepreneurs and innovators.

For example, many industries are heavily controlled if not owned by non-Zambian corporations. Let us consider the construction sector; all road works and other government contracts or tender, are mostly in the hands of the Chinese. There is nothing wrong with having foreign investors as equal partners in development as a nation but what we are faced with is not an equal partnership, because none of the monies obtained go to the Zambian treasury.

Another example is the mining sector. Not one operational and profitable mine is owned by a Zambian individual or corporation. Today the leading mining companies such as First Quantum Minerals, Vedanta and GlenCore are all foreign companies enjoying huge tax holidays from the Zambian government, while making exponential profits year in and year out.

Truth be told, Zambia needs a serious leadership that will fix this problem once and for all.

We should consider another vital sector of the economy, the retail industry, which has been taken over by the likes of Shoprite, Pep and Pick n Pay which are in all the major cities and towns in Zambia. These powerful retail chain stores are all South African companies, and no Zambian company comes close. This means all the profits and paid dividends quietly escape Zambia into the hands of the owners. Again, none of such monies goes to the Zambian treasury, because some of these companies have tax breaks from the Zambian government for a certain period of time.

All banks in Zambia are foreign owned, with the exception of the Zambia National Commercial Bank (Zanaco) and Invest Trust Bank. But these two banks are not the major players in this sector, because Absa, FNB, Standard Chartered, Citi Bank, Stanbic and others dominate the industry.

Zambia needs a government that will boost local direct investment and champion the spirit of entrepreneurship among the people. This should be done in practice rather than in rhetoric, by awarding road works and other construction contracts to local engineers and contractors who in return partners with foreign experts.

In simple terms, Zambians should be the owners of this industry. Instead of building shopping malls countrywide, the government of Zambia must invest money in building factories and agriculture facilities that will create lasting jobs. Goods produced in these factories can be exported, thereby earning forex for the country, and improving the currency.

A cashier at Pick n Pay makes K4 380 (about R3 838) a month. This is pathetic by any standards, because these people deserve a decent living wage for them to pay for housing or rent, put food on the table and take their children to school.

After 59 years of independence Zambia needs real change. But to achieve meaningful change, Zambia will have to answer the question of ownership and control of its means of production. Taking back the economy from the hands of foreigners and investing in the people is the only option to keep the money in terms of profits in the country and so contribute to the GDP growth.

There is no major country in the world that has attained the status of a fully developed or industrialised nation with an economy dominated by foreign ownership.
