With Zero investment, Rites gains TZS.177bn 'profits'

Rites to be paid 21bn/- for TRL 'divorce'

THE government will pay only 21bn/- for repossessing Tanzania Railway Limited (TRL), instead of a whopping 86.6 US million (about 125bn/-) demanded by Rail India Technical and Economic Services (Rites) for sale of its stake, sources have told the 'Daily News'.

The Tanzania Railway Corporation (TRC) was dissolved in 2007, to create TRL jointly with Rites which owns 51 per cent shares, while the government has 49 per cent stake.


Rites made an offer to sell its shares to the government several months ago, after TRL was dogged by financial constraints and regular workers' strikes over salary delays.


Sources said over the weekend that some claims by Rites were dropped during negotiations because they were baseless under the terms of the concession agreement. The negotiations took almost six months.


"The bargaining power and great negotiation skills deployed by the government team helped in reducing the claims, thus rescuing the government from paying heavily," a source said. (mmhh!!!!)

The negotiation team advised government to pay genuine claims only including services provided by the Indian shareholder to TRL, debts linked with fuel supply, spare parts and other equipment used in rehabilitation of wagons and locomotives.

The negotiation involved government experts and representatives from Rites.


The Minister for Transport, Mr Omary Nundu, declined to comment on the negotiation team reports, he insisted that the government will soon issue an official statement on the fate of TRL.


"We would like to see our marriage (contract) with the Indian investor brought to an end peacefully without causing trouble to the country," Mr Nundu added.


Mr Nundu recently promised to ensure that the investors leave the company as soon as possible.


Mr Hundi Lal Chaudhary, TRL Managing Director, refused to talk on the issue. "I am waiting for the final decision to be made by both TRL shareholders," he said.


Some of the items which Rites demanded to be paid for included US$15million as compensation or transaction expenses for their exit, US$12.68 million as rental charges for leasing of old coaches and locomotives, plus an interest on late payment of US$1.3 million.


Also the Indian based company demanded US$ 16 million for rehabilitation of locomotives, while it didn't do any major repairs during the last three years of their management of TRL.


The company also claimed US$2.36 million being interest on outstanding payment.


The Indian investor's request to sell coaches and locomotives to the government was quashed, on grounds that procurement law does not allow purchase of used goods.


In 2008, TRL leased 25 locomotives and 23 coaches from RITES-India to cover for shortage that faced the company but on condition that they are to be re-exported to India after a year.

In August, 2009, Rites demanded payment of 10.42 million US dollars to cover the lease of 25 locomotives and 23 passenger coaches imported from India to revive passenger services. But after failing to settle the claim, the rolling stock was pulled from operations.

Si kweli kwamba ni zero investment kama watu wanavyotaka kutuaminisha hapa. Hebu wacheki IFC, wanasema wao walitoa US$ 7mil kama part ya loan ambayo ilikuwa inategemea iwe 44 mil. Kwahiyo kuna pesa ziliwekwa pale. Ni rahisi tu kupata info kama hizi.

But while Rites has cornered the government with over seven key demands which, together, totals Sh177 billion, The Guardian on Sunday has established that the company didn't invest a single shilling during the controversial acquisition of TRL. The truth is that the Indian firm expected to use the TRL's shares and assets it acquired dubiously in order to borrow $400 million from International Finance Corporation the lending arm of the World Bank.
