Nini Hasa Maana Ake Na Je Inatofautiana Vipi Na Mudder? Na Katika Section 196 Of Cap 16 Kuna Neno Malice Aforethought Lina Maana Gani Hili? Msaada Wadau!
 
Section 196 of THE PENAL CODE CAP 16 REVISED EDITION 2002 It states that any person who with malice aforethought causes death of another person is the guity of murder ,At the same time section 198 of THE PENAL CODE CAP 16 it states that any person who causes death of another person is the guity of ananslaughter , so the difference between murder and manslaughter is that by considering elements of MURDER which are i.causation ii.malice aforethought while element of MANSLAUGHETER is only causation, let me clarify your point of contraversal which is MALICE AFORETHOUT this is the intention of commiting an offence , so the difference between murder and manslaughter is malice aforethought (intention) ,in manslaughter there is no intention(malice aforethought)
 
Kwakuongezea angalia punishment kwa kila offence zipo tofauti... kifungo cha maisha n kifo..
 
manslaughter is unintended killing while murder is intended one na hata punishment ziko tofauti, murderer anapata death penalty na kwenye manslaughter ni life imprisonment.
