Iko hivi kuna mfuko una itwa "Workers Compensation Fund" (WCF) uliondwa kwa mujibu wa sheria ya namba 20 ya mwaka 2008 section 5.

Ambapo section 74(6) na 75(1) inawataka watumishi wote wa serikali na wale waajiriwa wa mashirika binafsi kuchangia mfuko huo kutokana na tangazo la serikali Namba 169 la tarehe 1may 2015,watumishi wa serikali watachangia 0.5% ya pato lao na wa mashirika binafsi watachangia 1%

My take:
Kwa wale mnaojua zaidi tunaomba ufafanuzi katika hili(labda mimi sijaelewa vizuri) maana linagusa maslahi ya watumishi amabao tuna lipa kodi kubwa (income tax) kila mwezi na tumekua tuki lalamika ipunguzwe.

Inaelekea hujaelewa. Hii inawahusu waajiri na si watumishi kama ulivyotafsiri.
 
Sasa hawa wwajiri michango hiyo wataitoa mbinguni? Hii kodi itawaathiri watumiaji wa mwisho hasa ktk pato lao. Kama mtu angekuwa


Atalipa mwajiri kama anavyolipa asilimia 10% (15%) ya pensheni...
 
Wametanguliza kutunisha huo mfuko, ila kwa jina la Workers Compensation Fund - inaelekea ni kwa ajili ya kuwalipa fidia wafanyakazi ila haipo clear fidia za vipi, maana mashirika mengine tayari yana bima za wafanyi kazi wao, it needs to be clear otherwise hiyo pesa itakuwa inatunisha majamaa flani,

Mwaka huu badala ya kubembeleza Wananchi ndio kwanza nyundo mpya za kuongeza mzigo kwenye maisha ambayo tayari ni magumu yawe magumu zaidi ya jana. Hivi kweli kura sitatosha kweli mwaka huu??? maoni yangu tu....Wenye uelewa zaidi watujuze ili tufanya maamuz sahihi na si yakukomoana

Tanzania sasa tumekaa katika state ya kupanic kwa kila kitu kinachotokea. Sheria iliyoanzisha hizo kanuni ni nzuri na kama ukiisoma ina manufaa kwa mfanyakazi hasa kwa wale ambao wajaairi wao hawajawakatia bima za ajali kazini au maisha. Mchango huu unalipwa na mwajiri. Ukilinganisha faida na hasara zake nadhani ina faida kubwa mno, na sio kwa wafanyakazi wa serikali tu bali hata binafsi. Labda mtoa mada kwa hali kama hii wewe ulitakaje?

Ila Wadau msijifariji kwa vile inamgusa mwajiri. Kumbuka kimsingi Total employees' cost to the employer itaongezeka na hivyo your next increment will automatically be affected as a result of this tariff...meaning mwajiri atahakikisha his next year budget for employees ina-consider hiyo tariff na hivyo will only be willing to adjust your salaries in consideration of the additional employee related tariff . See the Act attached

Soma kwanza sheria yenyewe ndo uanze kulalamika!

Hakuna mahali palipotajwa kwamba mwajiriwa atachangia kwenye huo mfuko, bali mwajiri ndiye atawajibika kulipa mchango huo. Nahisi kule sekta binafsi kuna namna itafanyika ili kufidia pengo hilo (ingawa ni dogo), pengine msije kushangaa kama hamtapandishiwa mshahara kama ilivyo ada kwa kisingizio hiki! Sheria yenyewe hiyo hapo kwenye attachment!

THE CITIZEN : September 21, 2014 | Highlights in the new Workers Compensation Law

Employer’s liability at the workplace can arise from a number of sources. The employer may be liable to the employees or their dependants for the death, injuries or diseases suffered by the employee in the course of his employment as a result of employer’s negligence, any wrongful act or omission, or breach of statutory duty like failure to provide safety equipment, protective gear, appropriate technology or safeguards to avert disaster or injuries. The employer may also be vicariously liable for injuries caused to his employee by fellow employees’ negligence or wrongful acts or omissions. This liability extends to injured third parties.

Another form of liability arises from situations where the employee is injured or catches a disease or dies while and arising in the course of his employment regardless of the fault of the employer or fellow employees. In this case, the employee is normally supposed to receive what we call a worker’s compensation and is currently covered under the Workers Compensation Act, 2008 (new law). This is the subject of today’s piece. The new law does not extinguish other forms of employer’s liability discussed above, and those forms may be pursued simultaneously with worker’s compensation claims.

The purpose of this law is, among others, to provide for compensation to employees for disablement or death caused by or resulting from injuries or diseases sustained or contracted in the course of employment. So if an employee is injured in a frolic of his own, he may well lose the right to compensation, save for a few exceptions shown below.


Prior to the enactment of the new law, we used to have the Workers Compensation Ordinance which was antiquated and in dire need of overhaul. Under the Ordinance, the highest compensation the employee could receive was Sh108,000 for cases of permanent total incapacity.

The Ordinance has caused untold injustices to deserving workers in numerous cases where courts strictly followed the law and awarded the meagre and unrealistic compensation. However, this is now water under the bridge, the new law is now in force, and has several notable changes.


First, the new law covers all employees including public servants, employees working in Tanzanian ships or aircraft, or employees working abroad temporarily for employers based in Tanzania. The scope and coverage of this law is good.


Second, the manner of computing the amount payable is also stated in the law. We hope the minister for labour will set out realistic rates of compensation in the regulations.


Third, the law creates a Workers Compensation Fund. This is in line with the best practice around the world. Composition of its board is good,though it would be even better to add a medical doctor and an investment expert. Sources of its funds are: mandatory contributions by employers, assessments paid by employers, penalties imposed under the law, any interests on investment of the Fund, subventions from the government, and any other moneys legally acquired. So if this law is enforced as it should be, in 10 years we can predict the emergence of another huge public corporation, with huge finance and potential investment capabilities.


Fourth, the list of diseases covered is fairly long, and item 3 of the schedule to the new law allows the Director of the Fund to consider other diseases not mentioned in the schedule. This is key as some new diseases are surging. I have in mind an employee attending a business meeting in Liberia or such like places and contracts Ebola or a nurse or doctor contracting Ebola and dies while at work.


Fifth, dispute settlement procedure is set out clearly. The law says if a person is aggrieved by the decision of the Director General of the Fund, he can appeal to the minister within 30 days. If one is aggrieved by the decision of the minister for labour, he may appeal to the Labour Court within 30 days.


Having assessed the new law, the following positives are glaring: First, the new law is, by and large, very good and progressive.

More so when it states clearly that the employees or his dependants have a right to compensation for disablement or death caused by injuries or diseases caught in the course of employment.

If the accident leading to the death or injury is caused by serious or wilful misconduct of the employee, then the compensation will not be payable unless: the accident results in total permanent disablement or if the employee dies, leaves behind a dependant who is wholly financially dependant on the departed employee.

Secondly, the idea of establishing a workers compensation fund is equally welcome as it secures workers’ right to compensation. It adds certainty of payment. More so if the usual governmental bureaucratic syndrome will not be transplanted into the workings of the fund.


Besides, employers will be distributing/spreading their risks by making annual contributions to the Fund, and in case employees suffer death, injuries or diseases, the Fund will be obliged to pay them or their dependants compensation regardless of the longevity of contributions by their employers.


Thirdly, the new rates will be up to date. By giving the minister power to set minimum and maximum rates of compensation, and by giving the Director the needed discretion to increase compensation in unique cases, this gives room for flexibility, and allows the minister to review the rates from time to time without necessarily resorting to the arduous process of moving the parliament to amend the law.


Lastly, compensation appears to be not ‘a once and for all payment’ as was the case in the old law, though one may seek for a lump-sum. For example, in cases involving 100 per cent permanent disablement, an employee will receive some pension until he meets his death.


This is a very progressive and sustainable approach, but may be a serious burden to the Fund.
