The International Criminal Court, after conducting a pre trial hearing, has decided to confirm charges against me.

I would like to reiterate before the people of Kenya and before the entire world, that my conscience is clear, has been clear and will always remain clear that I am innocent of all the accusations that have been leveled against me. I have cooperated with the ICC throughout the process and will continue to do so because I believe in the rule of law.

I thank you all for your moral support, your prayers and your abiding faith in my innocence. I, therefore, urge all Kenyans not to lose hope following today's ruling. I am confident that the truth will come out and I will be vindicated in the fullness of time.

Fellow Kenyans, as I have gone through this process, it has been abundantly clear to me that this trial has not been just about the individuals charged at the ICC. This trial has been about more. This trial has been about a country trying to come to terms with itself and its past - a country that is picking up the broken pieces from this dark period. It is about a country trying to get past the trauma of what happened and seek a fresh start.

I believe in Kenya. I believe that among the many traits that the Kenyan people have in common, none is stronger than our unanimous love for our country and hate of conflict. For in conflict, which brings burdens and dangers to so many – our nationhood and dignity is the biggest casualty.

Let us all remain calm and peaceful during this period.

In due course I will issue a more comprehensive statement.

PRESS STATEMENT BY WILLIAM SAMOEI ARAP RUTO, EGH, MP, ON THE DECISION OF THE INTERNATIONAL CRIMINAL COURT'S PRE-TRIAL CHAMBER, NAIROBI, MONDAY, JANUARY 23, 2012

Aeschylus, a Greek playwright once said that "time brings all things to pass." Today one stage of the International Criminal Court cases involving my colleagues and I, has come to pass. Whereas the details and substance of the decision are yet to be analysed by my legal team, the gist is that the court has decided to confirm the charges against me.

I want to state, and categorically so, that I have been, I am and forever will be a stranger to all the accusations levelled against me. It doesn't matter how long it takes the truth will finally prevail, my innocence confirmed and the devil put to shame. In the meantime my lawyers and I will take all the necessary steps to ensure that justice is served expeditiously.

My faith is firmly rooted in God to whom I express my gratitude for the grace and the fortitude he has continued to grant my family and I during this challenging period.

To my family, especially my wife Rachael, my mother Sarah and my children, I am grateful for their love and constant moral support.
To my legal team, lead by David Hooper QC, Kioko Kilukumi and Katwa Kigen I am indebted to them for their dedicated commitment to demonstrate my innocence.

To my friends and supporters I cannot find a single word that describes my appreciation the way I feel inside me, for the prayers, support and messages of encouragement extended to me during these challenging times. With great honour and humility, allow me to just simply say one word, Thank You.

To the millions of Kenyan who support my candidature, my plain reading of the Constitution and advice from my legal team confirms that I am firmly in the race. To my worthy competitors lets us meet at the ballot and let the will of the Kenyan people prevail.


As my legal team focuses on this case, we the Kenyan people should move on. We must focus on our commitment as a people to peaceful coexistence, step up our efforts to reconciliation and healing and expand our horizon on democratic engagements.

We must focus on building a united republic whose firm foundation is the family. Let us direct our energy and focus in tackling the challenge of hunger afflicting millions of Kenyans, create an enabling environment for millions of young people to access opportunities that will reduce unemployment and expand our economy so as to give hope to millions living in want. These are the real priorities even at this point in time for our country.

Uhuru, Muthaura to stay in office, says AG

Finance Minister Uhuru Kenyatta and Head of Civil Service Francis Muthaura will not be asked to resign despite a ruling by the International Criminal Court confirming charges against them, Attorney General Githu Muigai has said.

The AG reasoned that the two suspects, accused of perpetrating crimes against humanity, are charged in their "individual capacity".

He said the government will await the result of their appeals before determining whether to dismiss the duo from office.

"The suspects are appearing in their individual capacity. The Government can not speak on their behalf on what to do and what not to do," said Mr Muigai.

The suspects must submit an appeal against the ruling within five calendar days from Monday. The appeal will then be determined within 60 days.

The Attorney General also unveiled a 10-man panel to advice Government on the ruling by the ICC Judges confirming charges on four out of six Kenyan suspects.

The panel is composed of Jeffrey Nice, Rodgers Dixon, Godfrey Musila, Fred Ojiambo, Joe Olwach, Waweru Gatonye, Betty Murungi, Lucy Gambuni, Grace Wakil and Henry Mutahi.

The panel will also revive the Government's initially unsuccessful efforts to question the jurisdiction of the ICC on the Kenyan cases.

Vice President Kalonzo Musyoka had been the face of a similar effort last year in a spate of shuttle diplomacy to mobilise the African Union to support Kenya's push to have the cases tried locally. The initiative came to a cropper.

Background (Preamble):

On December 15 2010, The President of the Republic of Kenya President Mwai Kibaki issued a statement after the ICC charged 6 Kenyans with crimes against humanity resuting from the 2007/2008 post election violence (PEV). In part of his statement, the President said and I quote;

"I have taken note of the announcement made this afternoon by the I.C.C. Chief Prosecutor Mr. Luis Moreno-Ocampo in regard to the Kenyan case.

Like other countries, our overriding desire in subscribing to international conventions is to advance our national interest both internally and internationally.

We do expect, therefore, that the International Criminal Court process will meet our expectations as a nation.

I wish to state that the people who have been mentioned have not yet been fully investigated as the pre-trial process in The Hague has only but began. They therefore cannot be judged as guilty until the charges are confirmed by the court.

Calls for action to be taken against them are therefore prejudicial, preemptive and against the rules of natural justice." end quote.

Petition:

On the basis of the President's statement that he would act once the charges are confirmed, and not withstanding the said individuals right to appeal and presumption of innocence until proven guilty, we the undersigned people of Kenya exercising our sovereignty as expressed below under Chapter One and Chapter Four (Bill of Rights) of the Constitution of Kenya 2012 call upon the President to move with speed and honour his word and pledge to Kenyans by compelling Amb. Francis Kirimi Muthaura, Uhuru Muigai Kenyatta and William Samoei Ruto to step down from the public offices they currently occupy.

The President should also state categorically that the said individuals are not fit to hold public office in Kenya unless and if when the very serious charges against them are dismissed. We feel that the three individuals can no longer inspire confidence from the majority of Kenyans in exercise of their official duties and that their personal activities will indeed interfere with the discharge of their duties in service of the people of Kenya.


CHAPTER ONE––SOVEREIGNTY OF THE PEOPLE AND SUPREMACY OF THIS CONSTITUTION
1. (1) All sovereign power belongs to the people of Kenya andshall be exercised only in accordance with this Constitution.
(2) The people may exercise their sovereign power either directlyor through their democratically elected representatives.

CHAPTER FOUR––THE BILL OF RIGHTS
22. (1) Every person has the right to institute court proceedings claiming that a right or fundamental freedom in the Bill of Rights has been denied, violated or infringed, or is threatened.

We wish to bring to your attention that our petition is informed by the following sections of our Constitution that make it untenable for the three individuals to discharge their duties to the Kenyan public diligently and thus to continue holding public office;

Article 10. (1) The national values and principles of governance in this Article bind all State organs, State officers, public officers and all persons whenever any of them––
(a) applies or interprets this Constitution;
(b) enacts, applies or interprets any law; or
(c) makes or implements public policy decisions.

(2) The national values and principles of governance include––
(a) patriotism, national unity, sharing and devolution of power,
the rule of law, democracy and participation of the people;
(b) human dignity, equity, social justice, inclusiveness, equality,
human rights, non-discrimination and protection of the
marginalised;
(c) good governance, integrity, transparency and accountability;
and
(d) sustainable development.

CHAPTER SIX––LEADERSHIP AND INTEGRITY
73. (1) Authority assigned to a State officer-
(a) is a public trust to be exercised in a manner that-
(i) is consistent with the purposes and objects of this Constitution;
(ii) demonstrates respect for the people;
(iii) brings honour to the nation and dignity to the office;
and
(iv) promotes public confidence in the integrity of the
office; and

(2) The guiding principles of leadership and integrity include-
(a) selection on the basis of personal integrity, competence and suitability, or election in free and fair elections;

75. (1) A State officer shall behave, whether in public and official life, in private life, or in association with other persons, in a manner that avoids-
(a) any conflict between personal interests and public or official duties;
(b) compromising any public or official interest in favour of a personal interest; or
(c) demeaning the office the officer holds.

Deputy Prime Minister Uhuru Kenyatta and Head of Civil Service Mr Francis Muthaura will remain in office after all, even after the International Criminal Court on Monday committed them to trial on charges of crimes against humanity. Attorney General Prof Githu Muigai told a news conference in Nairobi today that the Government has no intention of forcing the two to step down from their jobs.
"The four ICC suspects have indicated their intentions to appeal against the ruling of the pre-trial chamber. We are going to wait for the ruling of Appeal Chamber then advice the Government accordingly," Prof Githu said.
The AG further argued that the two, who are among four suspects whose charges were confirmed by The Hague based court, were at the ICC in their individual capacity and not as government officials.
