The International Criminal Court (ICC) has ruled that four senior Kenyan officials are to stand trial over violence after the 2007 election.

Those who will stand stand trial are Finance Minister Uhuru Kenyatta and cabinet secretary Francis Mutaura.

They are accused of crimes against humanity, including murder and persecution.

In a separate case, ex-minister William Ruto and radio presenter Joshua arap Sang will also stand trial.

All have denied the allegations against them.

Charges against two others were not confirmed.

More than 1,200 people were killed in weeks of unrest after the 2007 poll.

Some 600,000 people were forced to flee their homes.

The violence began as clashes between supporters of the two rival presidential candidates - Raila Odinga and Mwai Kibaki - but it snowballed into a bloody round of score-settling and communal violence.

'Big day'
Chief prosecutor Luis Moreno-Ocampo has asked to bring two separate cases, reflecting the ethnic divisions behind Kenya's post-election violence.

Mr Kenyatta, a supporter of Mr Kibaki, is accused of organising a campaign of violence including murder and rape against Odinga supporters.
Prosecutors say he met members of a secretive criminal organisation known as Mungiki at a shopping centre in Nairobi before the election in 2007 to arrange some of the attacks.

He denied the accusation at a preliminary hearing at The Hague-based court last September.

Mr Kenyatta, the son of the country's first President Jomo Kenyatta, is hoping to stand in next year's presidential poll, with analysts suggesting that he has a realistic chance of winning.

Two other senior Kibaki supporters face similar allegations.

Mr Ruto, a former education minister, says he also intends to run in the election.

He and two other supporters of Mr Odinga in the 2007 poll face claims that they organised attacks on Kibaki supporters.

Monday is a big day for Kenya, as the people are eagerly awaiting the court's decision, the BBC's Will Ross in Nairobi reports.

Kenya's government has been lobbying for the cases to be dropped - a position endorsed last year by the African Union.

Mr Kibaki was eventually declared the winner of the 2007 election, and is serving his second term as president. Mr Odinga was installed as prime minister under a power-sharing deal brokered by Kofi Annan to end the violence.

Mr Ruto and Mr Odinga have since fallen out and are expected to face each in the elections.

Q+A: ICC to decide whether Kenyan suspects face trial

(Reuters) - The International Criminal Court (ICC) is due to rule by next Monday on whether to try six Kenyans for crimes against humanity for orchestrating the violence that followed the disputed 2007 election.

There are two separate cases for the six men that are being closely watched because of the potential political impact. Two of the men, William Ruto and Uhuru Kenyatta, are running for president at elections due by March 2013.

WHO HAS BEEN CHARGED?

The first case is against former Higher Education Minister William Ruto, former Industrialization Minister Henry Kosgey, and radio presenter Joshua arap Sang, accused of crimes against humanity, including murder, forcible transfer and persecution.
In the second case, Cabinet Secretary Francis Muthaura, Finance Minister and Deputy Prime Minister Uhuru Kenyatta and former police chief Mohammed Hussein Ali are accused of crimes against humanity, including murder, forcible transfer, rape and persecution.

WHAT DECISIONS COULD THE ICC TAKE?

The ICC's pre-trial chamber made up of three judges will decide if the evidence presented by the prosecutor is sufficient to commit the suspects for trial.
The following are the likely possibilities:
* The court may confirm the charges, totally or partially, against all or some of the suspects if it is convinced there are "substantial grounds" to believe a suspect has committed a crime.
* The pre-trial chamber may decline to confirm any of the charges. The case will not proceed to trial. It remains open to the prosecutor to request confirmation for these charges at a later date by presenting additional evidence.
* The chamber may also ask the prosecutor to provide more evidence, to conduct further investigation or to amend the charges if the evidence appears to establish a different crime.

IS THE PRE-TRIAL CHAMBER'S DECISION FINAL?

No. Both the prosecutor and the suspects can request the pre-trial chamber's leave to appeal.
If the authorization is granted, the appeals chamber composed of five judges may consider the issues identified as appealable by the pre-trial chamber. That does not mean the confirmation of charges hearings will be held a second time.

ARE THE SUSPECTS REQUIRED TO BE AT THE HAGUE FOR THE RULING?

No. They will be notified of the decision through their defense counsel.

IF THE CHARGES ARE CONFIRMED AGAINST A SUSPECT, WILL THAT PERSON BE KEPT IN THE CUSTODY OF THE COURT?

If one or more charges are confirmed, totally or partially, against a defendant, that person will remain free unless ordered otherwise by the judges. The person must, however, attend the trial at The Hague. The Rome Statute does not allow trials in the absence of the defendants.

IF A SUSPECT HAS TO FACE TRIAL, WILL THAT BLOCK THEM FROM TAKING PART IN KENYAN ELECTIONS?

Candidates' eligibility to run for office in Kenya is governed by the Kenyan Constitution and laws, not by the Rome Statute that established the ICC. It is up to Kenyan authorities to interpret and apply national laws on that issue.

CAN THE ICC FREEZE THE ASSETS OF THE SUSPECTS?

The ICC may request a state's cooperation for identifying, tracing and freezing or seizing proceeds, property and assets. Suspects' assets can be frozen to ensure reparations can be paid to victims.

IF CHARGES ARE NOT CONFIRMED, WHAT HAPPENS TO WITNESSES?

In the Kenyan situation, some witnesses were granted protective measures. The ICC says that if the charges are not confirmed, it would drastically reduce the risk posed to these witnesses. If the risks continue after the decisions on the charges, the witnesses will continue to receive protection.

ICC judges plead for calm as ruling awaited

NAIROBI, Kenya, - The International Criminal Court (ICC) is cautioning Kenyans to remain calm after the fate of the six prominent Kenyans is announced by the Pre-Trial Chamber.

In a video interview, ICC Spokesman Fadi el Abdallah said the Pre-Trial Chamber led by Judge Ekaterina Trendafilova has asked Kenyans to accept the court's decision and restrain their actions or utterances likely to provoke tension in the country.

"The judges reiterated their appeal to all Kenyans to refrain from engaging in any actions that may endanger the security, the property or the safety of any victim or witness, and to also refrain from engaging in actions likely to raise tensions in the country," Abdallah said.

In case the charges are confirmed, the spokesman stressed that the suspects would remain innocent until conclusion of their trial.

The Head of the ICC's Public Affairs Unit explained; "The defendant is and continues to be presumed innocent until guilt is proven after a trial beyond any reasonable doubt."

Kenya is in Africa. ICC was created to convict African only.

I do not know in the name of God when kenya will ever walk away from tribal machinations, the other day in nakuru, people were talking of ICC not being fair because it had tried their leaders while others walked scot free. This is a cancer and unless we promote an atmosphere of an intergrated kenya, there is no use. I deeply concur with doctorz.
