This is the book which pacts with the significant area of practice in law, ‘Execution’, especially in Tanzanian context. It covers almost all important areas of the law and therefore gives answers to all possible questions which a law student and law practitioners like practicing advocates, Magistrates and judges ought to know in their daily normal practice and research about execution process in Tanzanian context.

The judiciary of Tanzania has recently in September 2020 formulated rules and guidelines to ensure efficient management of the law in execution to let the decree holders enjoys the fruits of their decree and promote the spirit and essence of rule of law to prevail.

In his forewords of the execution guidelines booklet, the Chief justice of Tanzania wrote that Execution of court decrees and orders is an integral component of administration of justice. Efficiency, transparency and high degree of discipline are of the essence not only in trial and determination of suits, but also in the process of executing court orders and decrees.

Despite of the judiciary efforts in issuing those guidelines, the understanding of Order XXI and other laws governing execution process in Tanzania has been difficult among the law learners and practitioners in general as it seems a-bit complicated.

This book contains Execution notes and Guidelines developed from statutes, case law and practice as well. This manuscript is issued with the hope that, their use will increase efficiency, effectiveness, transparency and uniformity in the execution of court orders and decrees.

The book will be revised and modified when necessary to cope with developments in the law and practice.
