Wengi wetu tunafahamu kuwa matatizo mengi ya nchi hii, hasara na uduni wa maendeleo, vinasababishwa na viongozi wa Serikali.

Iwe ni matumizi mabaya ya pesa ya umma, inasababishwa na maamuzi mabaya ya viongozi.
Iwe ni ubadhirifu wa pesa ya umma, kwa kiasi kikubwa unafanywa na viongozi na watendaji wa serikali.
Iwe ni wizi wa pesa ya umma, unafanywa na viongozi na watendaji wa Serikali.
Iwe ni mipango mibaya inayoshindwa kulikwamua Taifa, inapangwa na viongozi.
Iwe ni sera mbaya za uchumi, zinaundwa na kusimamiwa na viongozi.

Vivyo hivyo, kesi zote dhidi ya nchi, ambazo hela ya umma inaishia kutumika kuwalipa wadai, sababu kubwa ni maamuzi mabaya na mihemko ya hovyo ya viongozi. Viongozi wetu wanatumia zaidi nguvu kuliko akili, na nguvu haijawahi kuwa mshindi dhidi ya akili. Ng'ombe wale wakubwa kabisa uzito wao hufikia zaidi ya tani 1, hufugwa na kuchinjwa na mwanadamu, siyo kwa sababu binadamu ana nguvu kumzidi ng'ombe bali kwa sababu mwanadamu ana akili kumzidi ng'ombe.

Kwenye upande wa madini pekee, kutokana na maamuzi ya hovyo yaliyofanywa na viongozi wakati wa awamu ya 5, Tanzania inadaiwa kwenye mahakama za usuluhishi kiasi kisichopungua shilingi bilioni 700. Kesi hizi bado zinaendelea, na kwa sababu uamuzi ule uliofanywa na viongozi ulikuwa ni wa kihuni, Tanzania hatuwezi kushinda. Huko mahakamani, kama tukifanikiwa sana, basi itakuwa ni kupunguza tu kiasi cha kulipa. Hata ndege tunazonunua zinaruka ruka kama kunguru kwa sababu ya hofu ya kukamatwa huko nje kutokana na kesi ambazo viongozi wa nchi hii wamesababisha.

Kuhusiana na suala la kesi zinazohusiana na leseni za madini, fikiria, viongozi wa nchi wamezunguka Dunia nzima kutafuta wawekezaji kwenye sekta ya madini. Umewaeleza wawekezaji hao taratibu na sheria zote zinazotumika kwenye nchi yako. wawekezaji wamekuja, wamefuata sheria zote ulizoziweka wewe mwenyewe, umewapa leseni, wakaanza kufanya utafiti maeneo mbalimbali, maeneo mengine wasigundue madini ya aina yoyote, sehemu nyingine wakafanikiwa kugunda madini, wakaamua kwenda kutafuta pesa kwaajili ya kuchimba, wakaomba leseni za kusubiria, Retention Licenses, halafu ukawapa wewe mwenyewe, kisha siku nyingine, unaamka na mswada mpya wa kufuta aina ya leseni inayoitwa Retention License, halafu unatangaza kwenye gazeti la Serikali kuwa eti kuanzia leo, aina ya leseni inayoitwa Retention License, imefutwa kwenye mfumo wa leseni za madini, na wale wote waliokuwa wanamiliki aina hiyo ya leseni, wamepoteza maeneo waliyokuwa wanayamiliki na kuyafanyia kazi, na walichokigundua hawana haki nacho, na wala Serikali haitawalipa gharama zao walizotumia kwenye utafiti. Wewe kweli una akili?

Fikiria maamuzi ya kijinga kiasi hicho. Hata katika akili ya kawaida tu, unategemea haya makampuni yatakaa kimya na kusema, tumekubali yote? Sasa makampuni matatu, tangu mwezi January 2023, yamefungua kesi dhidi ya Tanzania:

Montero, kampuni ya Canada inadai fidia ya US dola milioni 66.6 (CAD milioni 90).
Indiana Resources ya Australia inaidai fidia ya US dola milioni 83.82 (AUD milioni 127).
Winshear Gold ya Canada inadai fidia ya US dola milioni 91.76 (CAD milioni 124)
JUMLA US DOLA 242.18 (TZS BILIONI 570). Hizi ni pesa tu zile zinazodaiwa na haya makampuni, bado gharama za zinazotumika kuendesha kesi, kesi ambazo tuna uhakika hatutashinda. Na tunaijua Serikali ya Tanzania, kwao kila kitu ni fursa ya kujitajirisha. Si ajabu, mwisho wa kesi, tutaambiwa tumeshindwa, tuyalipe hayo makampuni bilioni 500, halafu waendeshaji wa kesi nao wamelipwa bilioni 500. iliwahi kutokea huko nyuma, pesa iliyolipwa kampuni ya Mkono iliyokuwa ikiitetea Serikali huko nje ilikuwa inazidi hata kiasi ambacho Serikali ilikuwa inadaiwa kama fidia. hata kwenye hizi kesi, kwao hii ni sehemu ya kuvuna utajiri.

USHAURI 1:
Serikali iombe kuzungumza na makampuni haya nje ya mahakama. Iyarudishie hayo makampuni maeneo waliyokuwa wamefanyia utafiti, yamalizie na kujenga migodi. Serikali ikubali kulipa fidia halisia za hasara za kibishara (walizozipata kwenye share markets) lakini siyo kwa kutoa cash bali wakianza uchimbaji wa hayo madini waliyoyagundua, fidia ikatwe taratibu kutoka kwenye kodi walizostahili kuzilipa Serikalini.

USHAURI 2:
Lazima kuwepo na sheria kali ya kuwajibisha viongozi wote na watendaji wa Serikali ambao wanaliingiza Taifa kwenye hasara ambazo zingeweza kuepukika. Ni jambo la kusikitisha sana kwamba mapato yetu madogo yanayotokana na watu wenye msululu wa matatizo kukatwa kwenye tozo za miamala, tozo za kwenye mafuta, VAT, n.k. zinaishia kwenda kwa mataifa tajiri kutokana na maamuzi ya hovyo yanayofanywa na viongozi wa Serikali.

Hasara kubwa tuliyo nayo kwenye nchi hii ni kushindwa kuwapata viongozi na watendaji wafanya maamuzi wanaofaa. Viongozi na watendaji wa Serikali ambao walistahili kulisaidia Taifa na wananchi, ndio wanaolididmiza Taifa na kuwanyong'onyesha wananchi.
Tuwe na sheria ambayo wafanya maamuzi wanapoliletea Taifa hasara, wanafukuzwa kwa aibu kwenye nafasi zao, halafu wanafikishwa mahakamani, na kisha wakithibitishwa kuhusika kwenye hiyo hasara kutokana na maamuzi yao ya hovyo, wanapelekwa jela, angalao hata kwa miaka 3. Mathalani wahusika wakuu kwenye hasara hii ya madini, ni Kabudi, Biteko na mwanasheria wa madini. Biteko bado ni Waziri, kwa nini? Kabudi tunaambiwa eti ni mshauri wa Rais kwenye masuala ya mikataba. Yaani mtu aliyelitia hasara Taifa kiasi hiki, anamshauri nini Rais? Mwanasheria wa Wizara, bila shaka na yeye bado yupo ofisini. Hivi nchi hii kweli tuna dhamira ya kupiga hatua za maendeleo? Yaani watu wasiofaa, waliolitia hasara kubwa Taifa, bado wanakumbatiwa na kupambwa. Kweli hii ni banana republic. Nimeamini, umaskini wa akili, maarifa na dhamira ndiyo umaskini mbaya kuliko umaskini mwingine wa aina yoyote.

Mwalimu Nyerere alisema kuwa ili tuendelee tunahitaji watu, ardhi, siasa safi, na uongozi bora. Lakini kwa kweli vilivyo muhimu kuliko vyote hapo, ni viwili tu, uongozi mzuri na wenye maono na watu wanaojitambua. hawa ndio wanatengeneza aina ya siasa, na hao ndio wanaoweza kuifanya ardhi kuwa na thamani au ikabakia kuwa sehemu ya fisi na tumbili kufanyia mazoezi.




Wigu Hill Expropriation By The Government Of Tanzania

Montero Claim CAD 90 million in Damages at ICSID Tribunal
Background
Montero commenced exploration activities on the Wigu Hill Rare Earth Element project in March 2008 under a Prospecting License and spent over CAD$ 15.5 million on exploration works in the discovery and development of the project. In 2015 a five-year Retention License was awarded by the Tanzanian Government (Tanzania) on the property.

The Retention License was expropriated by Tanzanian in 2018 when the Mining (Local Content) Regulations 2018, cancelled all previously issued Retention Licenses. In December 2019 Tanzania published a Gazette announcing the public and open tender of previous Retention Licenses. Montero filed a request for arbitration with the ICSID on January 8, 2021, in order to preserve its rights. On February 9, 2021, ICSID registered Montero’s request for the institution of arbitration proceedings to resolve the illegal expropriation matter. The arbitral tribunal was constituted on November 18, 2021, with the appointment of the President, and appointees from Montero and Tanzania.

In May 2022 Montero submitted its Memorial on the Merits (“Memorial”) to the ICSID arbitral tribunal. The Memorial contains the basis for compensation of CAD$ 90 million which includes interest that continues to accrue. The damages claimed are for the unlawful expropriation and mistreatment of Montero’s investment in Tanzania which is in breach of the Agreement for the Promotion and Reciprocal Protection of Investments (“BIT”) signed between Canada and Tanzania in 2013.

On October 24, 2022, Tanzania submitted its Counter-Memorial on the Merits (“Counter-Memorial”) where it responded to Montero’s arguments and claims.

On November 17, 2022, Montero and Tanzania (the “Parties”) also submitted their respective requests for production of documents. The Parties submitted responses to the other party’s objections on January 9, 2023.

On January 30, 2023, the arbitral tribunal will issue its decision on requests for production of documents and the parties will have to produce the ordered documents by March 1, 2023.

On June 1, 2023, Montero will file its reply to Tanzania’s Counter-Memorial and Tanzania will file its rejoinder on September 1, 2023.

Montero has engaged Timothy Foden of Boies Schiller Flexner (UK) LLP to act as co-counsel with Mr. Thierry Lauriol of Jeantet AARPI as legal counsel in the arbitration against Tanzania. Dr. Neal Rigby of SRK Consulting (USA) Inc. has been engaged as quantum expert. The Company has secured dispute funding of US$ 2.32 million from Omni Bridgeway.

Montero is one of a number of companies that have filed arbitration procedures with ICSID against Tanzania for the expropriation of Retention Licenses. ASX listed Indiana Resources Limited (Home Page - Indiana Resources) has a claim of AUD$ 127 million for the loss of the Ntaka Hill Nickel Project and TSX-V listed Winshear Gold Corp. (Welcome to Winshear Gold Corp. Website) has a claim of CAD$ 124 million for the loss of the SMP Gold Project. Court hearings for both these cases commenced in January and February 2023.

Soma tena bandiko. Hao ni wawekezaji walifuata sheria zote za nchi. Waliokiuka sheria ni viongozi wa Serikali ya Tanzania waliotumia nguvu na ubabe, na siyo sheria.
 
Wakati mwingine najiuliza, ni kitu gani kinachowafanya hawa viongozi wa serikali wafute ghafla, tena bila taarifa sheria ambayo tayari ilikuwepo, na imeshaanza kutumika?

Jibu nalopata, ni kwamba, inawezekana kabisa wanafanya hivyo makusudi kwa manufaa yao, wanafanya hivyo ili watengeneze sheria mpya, wakijua fika itawalazimu wawekezaji waje ku negotiate upya, ili wao kupitia hapo, wapate nafasi ya "kuwapiga" hao wawekezaji.

Hawa ni wabinafsi, wahujumu uchumi, wanaofanya hivyo makusudi wakijua fika, hata kama wawekezaji wakiamua kwenda mahakamani kuwashtaki, na kushinda kesi, bado pesa itakayolipwa haitatoka mifukoni mwao, itakuwa ni pesa ya walipakodi.

Ndio maana hawajali chochote kwa maamuzi yao ya kijinga wanayofanya yanayolisababishia taifa hasara kila kukicha, kwasababu tunaongozwa na wapiga dili wanaozitumia ofisi za umma kufanikisha malengo yao ovu dhidi ya taifa, kwa manufaa yao binafsi.
 
Soma tenabandiko. Hao ni wawekezaji waliofuata sheria zote za nchi. Waliokiuka sheria ni viongozi wa Serikali ya Tanzania waliotumia nguvu na ubabe, na siyo sheria.
Huyo unayemjibu hana lolote ajualo, yeye hata kuandika kwa usahihi tu ni tatizo. Kwa uzito wa hii hoja yako hakuna lolote aliloelewa.
 
Tumebakia kulipa madeni tu, mengi ya kizembe na kujitakia....Ila waliotufikisha hapa wapo tu wanafurahia maisha.
