Regulation 59.(1) of PPR 2013 requires any formal contract arising out of the acceptance of tender whose value is fifty million shillings or more to be vetted by the Attorney-General before the contract is signed by the parties.
Further sub regulation 2 of the same regulations states that; ‘Subject to sub-regulation (1), a contract whose value is fifty million shillings and above, which is not vetted by the Attorney General shall be void’ Contrary to the given Regulations, on review of procurement and procurement management we noted that; the fund procured subcontractors and subcontracting the same to perform various thirteen (13) works in regard of two projects namely ‘Proposed Constructions of Mzizima lot 2&3 and Construction of NSSF Tourist Hotel at Mwanza for price amounting TZS. 79,541,566,752.84
The thirteen signed contracts were not submitted to Attorney General for vetting as required by Regulation 59 (1) of PPR 2013.
