Haya sasa ndugu zetu wana Diaspora, mliopoteza uraia wa Tanzania, mnapewa uraia pacha, kwa kutambuliwa rasmi kupitia special status kwa kuomba tena kurejeshewa uraia wako wa Tanzania uliopoteza, kwa kusajiliwa na kupewa Kadi ya Diaspora Tanzanite Card, ambayo itakupa haki zote za Utanzania ulizopoteza, ikiwemo kumiliki mali, ila sijajua kama na haki ya kupiga kura pia mtapewa, maana kuna mijitu mioga kama kunguru!.

Mambo yenu ni haya.... yameishatua Bungeni na kusomwa kwa mara ya kwanza, sasa serikali inapokea maoni ya wadau, kikao kijacho cha Bunge, hii ngoma, inasomwa kwa mara ya pili na kupitishwa, hivyo huu ndio uraia pacha wetu.
PART V
AMENDMENT OF THE IMMIGRATION ACT,(CAP. 54)
16. This Part shall be read as one with the ImmigrationAct, hereinafter referred to as the “principal Act”
17. The principal Act is amended in section 3, by adding the appropriate alphabetical order the following new definitions:

““Diaspora Tanzanite Card” or “Card” means avalid card issued under this Act to aTanzania non-citizen diaspora afterbeing granted a special status;

“special status” means the status granted to aTanzania non-citizen diaspora under thisAct-

(a) for the purpose of entry, stay or exit out of the United Republic; and
(b) for such other purposes as may be provided under any other written laws; and “Tanzania non-citizen diaspora” means a person who was formerly a citizen of the UnitedRepublic other than a citizen by naturalisation or whose either parent, grandparent or such other descendant isor was a citizen of the United Republic;”.


18. The principal Act is amended in section 28(1) by adding immediately after paragraph (d) the following:
(e) he is in possession of a valid DiasporaTanzanite Card; or
(f) he is in possession of a valid DiasporaTanzanite Card enrollment notification issued to the applicant prior to issuance of the Diaspora Tanzanite Card.”.

19. The principal Act is amended by adding immediately after section 36 the following: “Grant of special status to Tanzanian on-citizen diaspora

36A.-(1) A person who intends to be granted special status shall apply to the Commissioner General in the manner prescribed in the regulations:

Provided that, where such person is a child, the application shall be made by his parent or guardian.

(2) A person shall be eligible to apply for a special status if such person
(a) is a Tanzania non-citizen diaspora;
(b) observes national ethos, traditions, customs an cultural values;
(c) is not a fugitive offender or has not been convicted of an offence of or related to money laundering, economic and organised crimes or other transnational crimes;
(d) holds a valid passport or travel document;
(e) is of good moral standing; and
(f) complies with such other requirement as may be prescribed in the regulations made under this Act.

(3) The Commissioner General shall, upon being satisfied with the fulfillment of the requirements under subsection (1), grant special status and issue a Diaspora Tanzanite Card to the applicant.
Validity of Card

Dependant of Tanzania non-citizen diaspora
36B. A Card issued in terms of this Act shall be valid for a period of ten years and may be renewed.

36C.-(1) Subject to the conditions prescribed in the regulations, the Commissioner General may, on application made on that behalf by the person who has been granted a special status, issue a dependant pass to dependants of the holder of the Card.

(2) The provisions of section 39of this Act shall apply mutatis mutandis in respect of the expiration of a dependant pass.

(3) For the purpose of this section, “dependant” means spouse or child of the Tanzania non-citizen diaspora:

Provided that, the dependant is not Tanzania non-citizen diaspora.

36D. A person who has been granted a special status shall-

(a) observe the Constitution of the United Republic and other written laws;

(b) observe the requirements of a special status as set out under this Act; and

(c) be of good moral standing.

36E.-(1) The CommissionerGeneral may revoke a special status if he is satisfied that-

(a) a person granted a special status has breached any conditions of the special status;

(b) the special status was obtained by means of fraud, false representation or concealment of any material fact;

(c) a person has shown him self by act or speech to be disloyal or dis - affectionate towards the United Republic;

(d) a person has unlawfully traded or communicated with an enemy to the United Republic or has been engaged in or association with any business that is carried on in such a manner as to assist the enemy;

(e) a person is engaged in any act which is against the morals of the United Republic;

(f) it is not conducive to the public good that, that person should continue to hold the special status; or

(g) a person engages in politics contrary to the laws governing political affairs in the United Republic.

(2) Revocation of special status in terms of subsection (1) shall constitute the automatic invalidation of the Card, and the holder shall be under obligation to return the Card to the issuer thereof.

(3) A person whose special status has been revoked, may, within one month from the date of revocation, apply to the Commissioner General for any other immigration status as provided for in the Act.”.

20. The principal Act is amended in section 45(1) by-10
Amendment of section 48
(a) adding the word “Card” immediately after the word“certificate” wherever it appears in that sub section; and

(b) adding the word “Card” immediately after the wordVisa appearing in paragraph (o).

21. The principal Act is amended in section 48(1) by-(a) adding immediately after paragraph

Sasa ningeona hawa waliopendekeza special status kuwa na akili kiasi kama wangesema special status ni permanent, na parent akiwa na special status automatically watoto wanakuwa nayo. Hii nchi imejaa vichwa maji katika jina la viongozi. Waondoe hili wazo lao la special status, hakuna mtu mwenye akili timamu atakubali ujinga kama huu ili eti awekeze mtaji mkubwa nchini.

Hii nchi imejaa vichwa maji katika jina la viongozi. Waondoe hili wazo lao la special status, hakuna mtu mwenye akili timamu atakubali ujinga kama huu ili eti awekeze mtaji mkubwa nchini.

Ni juzi Ijumaa niliuliza humu Kigugumizi cha nini kwenye Uraia Pacha? Shuhudia unavyowakwamisha Watanzania kuwekeza nyumbani. Miradi, mijengo ya maana ingeota kama uyoga, leo nakutana na hii hoja, uraia pacha wetu jameni ndio huu!.

Haya sasa ndugu zetu wana Diaspora, mliopoteza uraia wa Tanzania, mnapewa uraia pacha, kwa kutambuliwa rasmi kupitia special status kwa kuomba tena kurejeshewa uraia wako wa Tanzania uliopoteza, kwa kusajiliwa na kupewa Kadi ya Diaspora Tanzanite Card, ambayo itakupa haki zote za Utanzania ulizopoteza, ikiwemo kumiliki mali, ila sijajua kama na haki ya kupiga kura pia mtapewa, maana kuna mijitu mioga kama kunguru!.

Mambo yenu ni haya.... yameishatua Bungeni na kusomwa kwa mara ya kwanza, sasa serikali inapokea maoni ya wadau, kikao kijacho cha Bunge, hii ngoma, inasomwa kwa mara ya pili na kupitishwa, hivyo huu ndio uraia pacha wetu.
PART V
AMENDMENT OF THE IMMIGRATION ACT,(CAP. 54)
16. This Part shall be read as one with the ImmigrationAct, hereinafter referred to as the “principal Act”
17. The principal Act is amended in section 3, by adding the appropriate alphabetical order the following new definitions:

““Diaspora Tanzanite Card” or “Card” means avalid card issued under this Act to aTanzania non-citizen diaspora afterbeing granted a special status;

“special status” means the status granted to aTanzania non-citizen diaspora under thisAct-

(a) for the purpose of entry, stay or exit out of the United Republic; and
(b) for such other purposes as may be provided under any other written laws; and “Tanzania non-citizen diaspora” means a person who was formerly a citizen of the UnitedRepublic other than a citizen by naturalisation or whose either parent, grandparent or such other descendant isor was a citizen of the United Republic;”.


18. The principal Act is amended in section 28(1) by adding immediately after paragraph (d) the following:
(e) he is in possession of a valid DiasporaTanzanite Card; or
(f) he is in possession of a valid DiasporaTanzanite Card enrollment notification issued to the applicant prior to issuance of the Diaspora Tanzanite Card.”.

19. The principal Act is amended by adding immediately after section 36 the following: “Grant of special status to Tanzanian on-citizen diaspora

36A.-(1) A person who intends to be granted special status shall apply to the Commissioner General in the manner prescribed in the regulations:

Provided that, where such person is a child, the application shall be made by his parent or guardian.

(2) A person shall be eligible to apply for a special status if such person
(a) is a Tanzania non-citizen diaspora;
(b) observes national ethos, traditions, customs an cultural values;
(c) is not a fugitive offender or has not been convicted of an offence of or related to money laundering, economic and organised crimes or other transnational crimes;
(d) holds a valid passport or travel document;
(e) is of good moral standing; and
(f) complies with such other requirement as may be prescribed in the regulations made under this Act.

(3) The Commissioner General shall, upon being satisfied with the fulfillment of the requirements under subsection (1), grant special status and issue a Diaspora Tanzanite Card to the applicant.
Validity of Card

Dependant of Tanzania non-citizen diaspora
36B. A Card issued in terms of this Act shall be valid for a period of ten years and may be renewed.

36C.-(1) Subject to the conditions prescribed in the regulations, the Commissioner General may, on application made on that behalf by the person who has been granted a special status, issue a dependant pass to dependants of the holder of the Card.

(2) The provisions of section 39of this Act shall apply mutatis mutandis in respect of the expiration of a dependant pass.

(3) For the purpose of this section, “dependant” means spouse or child of the Tanzania non-citizen diaspora:

Provided that, the dependant is not Tanzania non-citizen diaspora.

36D. A person who has been granted a special status shall-

(a) observe the Constitution of the United Republic and other written laws;

(b) observe the requirements of a special status as set out under this Act; and

(c) be of good moral standing.

36E.-(1) The CommissionerGeneral may revoke a special status if he is satisfied that-

(a) a person granted a special status has breached any conditions of the special status;

(b) the special status was obtained by means of fraud, false representation or concealment of any material fact;

(c) a person has shown him self by act or speech to be disloyal or dis - affectionate towards the United Republic;

(d) a person has unlawfully traded or communicated with an enemy to the United Republic or has been engaged in or association with any business that is carried on in such a manner as to assist the enemy;

(e) a person is engaged in any act which is against the morals of the United Republic;

(f) it is not conducive to the public good that, that person should continue to hold the special status; or

(g) a person engages in politics contrary to the laws governing political affairs in the United Republic.

(2) Revocation of special status in terms of subsection (1) shall constitute the automatic invalidation of the Card, and the holder shall be under obligation to return the Card to the issuer thereof.

(3) A person whose special status has been revoked, may, within one month from the date of revocation, apply to the Commissioner General for any other immigration status as provided for in the Act.”.

20. The principal Act is amended in section 45(1) by-10
Amendment of section 48
(a) adding the word “Card” immediately after the word“certificate” wherever it appears in that sub section; and

(b) adding the word “Card” immediately after the wordVisa appearing in paragraph (o).

21. The principal Act is amended in section 48(1) by-(a) adding immediately after paragraph

  1. Najitahidi sana kutafuta maneno malaini kuhusu mhimili wetu wa mahakama wenye jukumu la kutafsiri katiba, sheria na kanuni, Serikali inatunga muswada wa sheria batili kinyume na katiba, Bungelinatunga sheria batili, na mahakama umekaa kimya!.
  2. Mtu akipata uraia wa tanzania kwa kuzaliwa, uraia huu hauwezi kuondoka milele!. Sambamba na mtu akiwa raia wa Tanzania kwa damu ya wazazi wake, uraia huu hauwezi kufutika milele!. hivyo sheria yetu ya uraia iko kinyume na katiba!.
  3. Mtu ambaye ni Mtanzania aliyepoteza utanzania wake kwasababu ya uraia wa nchi nyingine, hakupaswa kupewa special status, tulipaswa kuruhusu uraia pacha, kisha Watanzania wote wenye uraia mwingine, kurejeshewa uraia wao wa Tanzania, na hiyo special status ndio iwe ya ule uraia wa nchi nyingine!.
  4. Mpaka sasa bado najiuliza, hiki kigugumizi cha nini kwenye hoja ya uraia pacha?.
  5. Ushauri wangu kwa Diaspora, if you can't get what you want, just take what you get, shukuru kwa hiki kidogo ulichopata, kisha endelea kudai kikubwa!. Mtu kuzaliwa Tanzania ni haki ambayo haiwezi kuondolewa, na mtu kuwa na damu ya Tanzania ni haki ambayo haiwezi kuondolewa, haki zetu bado zinafanywa ni hisani!.

Paskali.
Paskali hoja zako siyo sahihi. Mtu kaomba uraia nje kapewa wewe huku utawezaje eti useme uraia wake wa nje ni special stutus. Hili la kuwapa special stutus baada ya kupoteza uraia wao wa nchi ya asili yao ambayo hairuhusu uraia pacha ndio jambo sahihi. Hatutegemei kuja kuona wabunge viongozi wa kisiasa au vigogo wa kufanya maamuzi kwa nchi yetu eti ni raia wa nchi zingine. Unajua kila nchi inataka utiifu kwa taifa lao na kutetea maslahi yake. Sasa hapo utakapokua na rais wa tanzania ambaye pia ni raia wa marekani, ufaransa au uingereza unategemea nini kama sio yeye kutakiwa atii maslahi ya nchi hizo zenye kuhitaji kila nchi isalimu amri kwao maslahi yake ya kiuchumi.
Mfano kuna yule jenerali wa Somalia akiitwa Ideed akiongoza Somalia kama mbabe wa kijeshi wakati imeparuka kama tambara bovu. Alivyouliwa na wababe wenzake wamarekani wakamleta mwanae aliyekua mwanajeshi na raia wa marekani kurithi nafasi yake kama kiongozi mbabe wa kijeshi. Kilichotokea ni historia kila mtu anafahamu
