Habar wanajf naomba kujua namna ya kujibu maswali ya law case kama hili niliotuma hapa, nijue vitu vya kuzingatia walat wa kujibu na hua yanajibiwa kwa utaratibu ganii, naamini nitapata majibu sahihi kwani hapa ndio sehem sahihi kwa ma-advocate

The contract between Ben and Ali is legally binding as it is partially executed by the act of Ali's 10% payment deposit. Whether the execution was made by mere oral agreement or in written terms, the contract is already legally binding between them.

Ali is therefore entitled to recover the entire 10% deposit that he has already made to Ben (may claim for damages as well , as he is as well entitled for damages) as Ben's part was supposed to make sure that the car is properly insured and eventually, safely delivered to Ali's possession.

Had Ben safely delivered the Car in Ali's hands before it went broke with fire, the liability would have been on the buyer's/ Ali's side. At the moment, the entire liability is on the seller's side as he had not delivered the goods to the buyer

You may use common sense as well, coupled with your knowledge on SALE OF GOODS CONTRACT. The most important thing to deal with here is the issue of when the liability in such contracts (Sales of Goods contracts), pass from the seller to the buyer
