Habarini wanajamvi,

Nina cousin wangu alipata kuajiriwa na International Organization moja hapa Tanzania kama Consultant kwanza na baadae kama muajiriwa wa kawaida. International Organization hii baadae ilifanikiwa kuwa UN Agency tangu October 2016. Alipoajiriwa kama consultant kituo chake cha kazi kilikuwa Kigoma & Kasulu kuanzia Sep 2015 hadi Feb 2016. Mnamo feb 2016 kazi husika hazikumalizika kwa wakati hivyo ilibidi wakubaliane na employer kuongeza mkataba husika kwa vipindi vinne tofauti mpaka October 31 2016. Ktk extension hii kiliingizwa kipengele kwamba endapo consultant huyu atasafirishwa nje ya kituo chake cha kazi kwa masuala ya kiofisi ya employer basi atakuwa entitled kulipwa 'Daily Subsistence Allowance' kwa kila siku kwa kipindi atakachokuwa huko.

Ilipofika May 2016 consultant huyu alitaarifiwa ktk mazungumzo na kupitia jumbe ktk simu yake ya kuwa baada ya siku 2 anatakiwa awepo Dar es salaam kwa ajili ya kazi mpya zilizojiri kwa wakati huo. Hivyo basi ilimbidi asafiri na kufika DSM ktk siku aliyotakiwa na kuanza kazi ile mara moja hadi ilipokamilika mnamo October 2016. Mara baada ya kukamilika kwa kazi ile Cousin alianza kudai malipo yake mara moja kutoka kwa muajiri. Na kwa wakati huo tayari cousin alikuwa ameshaajiriwa kama staff na sio consultant tena,lakini cha ajabu kidogo muajiri alianza kuwa mtata kuhusiana na madai yale akitoa kigezo kwamba hakukuwa na email confirmation iliomtaka consultant awasili DSM kwa ajili ya kazi hizo,na pia travel rules na regulations hazikufuatwa. Ikumbukwe pia kuwa sababu hizo 2 hazikuwa set out ktk mkataba waliosainishana.

Mara baada ya kuvutana kwa muda mrefu pasipo majibu ya kueleweka toka kwa Muajiri,muajiriwa alifikia kuchukua maamuzi ya kuachia ngazi kwa nafasi alokuwa nayo akiwa na matarajio ya kuanza kufuatilia haki zake kisheria. Akiwa ktk harakati hizo alijulishwa na muajiri ya kuwa wao kama International Organization na UN Agency sasa wana priviledges na immunities ambazo zinawalinda wao na kuwafanya wasiweze kushtakiwa ktk mahakama yoyote ile TZ.
