Police have summoned a blogger for questioning over alleged abuse of the Kenya Information and Communication Act.

Provincial CID office has received a complaint from government spokesman Alfred Mutua and Communication Commission of Kenya that Robert Alai has been abusing sections of the Act.

Nairobi PCIO Nicholas Kamwende said they want Alai to report to his office to clarify some issues he has been highlighting on Twitter and other channels.

"We summoned him on Thursday and we hope to see him probably and latest Tuesday (today). He has violated sections 26, 29 and 30 of the Act and we feel he should come and tell us more," said Kamwende.

Police boss said they would take further action if Alai fails to honour their summons.

Blogger Robert Alai spent the night in police cells on Tuesday after he was arrested for abuse of the Kenya Information and Communication Act.

Alai was arrested at Nairobi Area CID offices where he had presented himself for questioning.

CID boss Nicholas Kamwende said Alai will appear in court on Wednesday to face charges of abusing the Act.

Provincial CID office had received a complaint from government spokesman Alfred Mutua and Communication Commission of Kenya that Alai has been abusing sections of the Act hence the summons.

"We summoned him on Thursday and we have taken statements from him. He is under arrest for violating sections 26, 29 and 30 of the Act," said Kamwende.

Dr Mutua is said to have recorded a statement at the CID offices saying Alai had been peddling rumours on the social media linking him to the killings of human rights activists Oscar Kingara and Paul Oulu.

The two were killed by assailants along State House Road in the city in 2008 and no arrest has been made so far since then.

Alai tweeted last week saying he had been summoned and revealed the summons were connected with the killing of the two.


He drew attention of his followers on the social media seeking their sympathy.

He on Tuesday insisted he did not fear the summons but expressed fears police were being used to harass him over his stand on many issues and especially on the social media where he is popular.

niliona hii habari kwenye tv na post ya huyu bwana ilivyoandikwa inaonekana kuna ukweli anaoujua. Kwa ujumla ni kuwa hili suala impact yake inaweza kuleta mapinduzi kwenye matumizi ya social media siku za mbeleni

I do not understand the arguments posted here in regard to the tweeter and one of us. The charges facing him arises out of a complaint by somebody that he has been spreading rumours against somebody. In other words, he has been maligning somebody which is a crime. It is even worse to accuse somebody opf the crime of Murder.

Apparently, this character will be taken to Court to day. If he has committed no crime he shall be set free, If he has, he must face the music and the rest of us do not have to mourn his problems.

So far I have noted that we are engaging acts that amount to condoning crime. Let the guy establish his innocence before the courts. Technology advances do not subordinate good manners, respect for thge Law and respect for others. It has only enabled us to reach a wider audience-truthfully.
