Ombi limewasilishwa katika Mahakama Kuu ya Uganda kutaka kumwondolea sifa mwanasiasa mkongwe na aliyekuwa Waziri wa Fedha chini ya utawala wa Idi Amin, Mheshimiwa Jenerali Moses Ali, asigombee nafasi ya Ubunge (Adjumani West County), likitaja madai ya kutokuwa na uwezo wa kiakili na kimwili.
Ombi hilo, lililowasilishwa na wakili na mwandishi aliyeshinda tuzo, Kakwenza Rukirabashaija, chini ya Ibara ya 50(1) na 137(3) ya Katiba, linawalenga Tume ya Uchaguzi, Jenerali Moses Ali, na Mwanasheria Mkuu.
Linaomba mahakama itangaze uteuzi wa Ali kuwa kinyume cha katiba na kutoa amri ya kumzuia kugombea.
Kakwenza anadai kuwa Jenerali Ali, ambaye sasa ana umri wa miaka 80 na zaidi, hana uwezo wa kimatibabu na kiakili, na kwa hivyo hastahili chini ya Ibara ya 80(2)(f) ya Katiba, inayomwondolea sifa mtu “asiyekuwa na akili timamu” kugombea Bunge.
Kampala, Uganda | A dramatic petition is being filed in the High Court of Uganda to disqualify veteran politician and former Finance Minister under Idi Amin’s regime, Rt. Hon. Gen. Moses Ali, from contesting for Member of Parliament (Adjumani West County), citing alleged cognitive and physical incapacity.
The petition, brought by lawyer and award-winning author Kakwenza Rukirabashaija under Articles 50(1) and 137(3) of the Constitution, targets the Electoral Commission, Gen. Moses Ali, and the Attorney General.
It requests the court to declare Ali’s nomination unconstitutional and issue an injunction against his candidacy.
Kakwenza argues that Gen. Ali, now well into his 80s, is medically and cognitively incapacitated, and therefore ineligible under Article 80(2)(f) of the Constitution, which disqualifies a person of “unsound mind” from standing for Parliament.
He further cites Sections 4 and 12 of the Parliamentary Elections Act, 2005, which obligate the Electoral Commission to reject nominations that fail to meet constitutional qualifications.
Gen. Moses Ali recently made headlines when he appeared at the NRM headquarters in Nakasero, Kampala, to be nominated from his car, as he was reportedly unable to walk to the nomination tent.
Visibly frail and gasping for breath, his condition shocked members of the press and raised concerns over his fitness to serve.
Despite this, his nomination was actively supported by Minister Balaam Barugahara, who posted on X (formerly Twitter):
