Siku hizi kumekuwa na mtindo ambapo mtu mwenye kiwanja anamkodishia mtu mwingine ajenge frem ya duka then awe mpangaji.

Sasa huyu jamaa yangu kaingia mkataba wa aina hii na mwenye kiwanja na baada ya kujenga banda ndio wakakaa chini kuandikiana mkataba baaada ya kujua gharama halisi. Lakini mwenye kiwanja amegeuka na hataki kwenye mkataba kuwepo na kipengele cha kurudisha gharama kwa madai eti akiwa anafanya biashara si atakuwa anajilipa gharama alozotoa? Mbaya zaidi anataka kodi ilipwe kama kawa.

Jamani wenzetu wa ardhi na wanasheria hii inasomekaje? Na siku jamaa akitaka kuondoka hatima itauwa nini? Tumsadie mawazo na facts.

mpe pole kwa matatizo, lakini alitakiwa kujua kwamba, siku hizi hakuna uaminifu, so mkataba ni muhim sana. mkataba sio lazima muandikishiane, hata kwa makubaliano ya maneno tuu, inaweza kutosha kufanya mkataba. mpaka kujenga hapo ina maana palikuwa na makubaliano fulani ndo maana hata mwenye eneo hakupinga huyo jmaa kujenga hapo.
hicho kipengele wanachobishania, kilikuwepo kwenye makubaliano ya awali? na kama ni kujilipa ktk biashara itakuwaje pale atakapo pata hasara?
USHAURI WANGU: mpaka hapo kuna mkataba tayari, 2. ifanyike kama walivyokubaliana awali, kama anakiuka basi amfikishe sheriani, 3. ahakikishe ana document yoyote inayoonyesha yeye kujenga hapo, 4. ache kufanya vi2 bila kuandikishiana, coz anakuwa hana ushaidi.

mara nyingi watu hukubaliana kodi kwanza,halafu wanakubaliana ajenge hapo kwenye kiwanja baada ya kumaliza huangalia gharama ni kiasi gani then wanaangalia hiyo kodi itacover hizo gharama kwa muda gani,kama ni mwaka au miaka kadhaa.halafu jamaa anafanya hapo biashara mkataba hilo duka au fremu inakuwa ya mwenye kiwanja wanaingia mkataba upya sasa wa kulipa kodi kama kawa.

hata nuymba,unaweza kubalianana mpangaji afanye ukarabati halafu mnaangalia gharama zilizotumika zinacover miaka miangapi ya kupanga mnakubaliana tu.ndivyo biashara ilivyo.

sasa ili kumshauri vizuri,hebu eleza terms za makubaliano yao kwanza...

Mpe pole sana........mwambie amueleze mwenye kiwanja kuwa kama hakubaliani nae basi kiwanja kitakuwa chake na mmiliki wa awali atanyang'anya kwa kukiuka masharti ya umiliki wa kiwanja na wewe ukiwa kama shahidi.........kwani masharti ni kuwa atakiendeleza yeye na si mtu mwingine na kama amekishindwa akirudishe kwa Serikali ili apatiwe mmiliki mwingine.............UPO HAPO MWA KWETU?

Watanzania tunaaminianaga sana, vitu vya msingi vya kuwa na mkataba hatuwazagi au hata ukijua inabidi ni-draft mkataba unaanza fikiria atanionaje huyu?
