JE one can apply for extension of time for an appeal of which had been dismissed for being time barred?

YES, please refer to section 14(1) and (2) of the Law of Limitation Act (CAP 89 R.E 2002), there must be reasonable or sufficient cause to do the same.

appeal up to the court of appeal is a constitutional right you do not need any precedent ruling on that..................hata hiyo dismissal may be an illegal one.........................higher court ought to ascertain the correctness of that decision............
