Immigration office and law

Immigration office and law

1. Constant trips since 2008 ;in and out of Tanzania,Last entrance was January 2013, on a normal tourist visa. The main reason was death in family of my husband and important matters to settle. The initail expity date was April 13th,It was extended to May after a request when the baby was born.A month was not sufficient. Are revist extended a further two months until July.
As soon as the baby was born on the 30 march 2013 ,the first registration attempt was made. The officer said it was not possible as they awaited data from Bagamoyo Hospital and it would be possible onlyy in July. There was another attempt close to my visa expiry and to no avail. We applied in July and were given a retun to collect date in August. The baby's passport form was thus incomplete without a birth certificate. There was another plea at immigration for an extension due to this and it was refused.I cannot travel without the baby. The baby needs a passport. My husband lives with me but is currently away on a tour guide project at national parks in Tanzania. He assisted with crossing the border for an extension until October. The birth certificate was processed on Monday and the passport forms have been delivered for finalities.Temporarily resolved until I secure a dependant pass.I do however think that there needs to be a re-evaluation on dealing with each case independantly. The matter was definately a violation of rights. Seperating a newborn from his mum is not justified

So, by right since 2008 you were visiting Tanzania as a tourist with South African passport. As a member of commonwealth, you were given 6 months maximum as per requirement. Your son is approximately four months old, … …. Why didn’t you include your son in either your father’s passport or yours? It’s easy to do that via your embassy (read requirement to be helped outside your country by your embassy) as your visa is running out. Alternatively you should have all required papers to satisfy officials that your case is genuine. In this case it seems you do not have genuine papers for your son.

I do not believe that your case is urgent because your husband is somewhere else and you can’t satisfy the Immigration officials with proper documentation. In actual fact our immigration officials have been lenient to you, you have been dilly dallying for quite some time, and they should have deported you as soon as possible. Your issue does not have any business to do with human rights as you can travel with your baby without any problem. (Get temporary documentation from SA embassy).

Another issue - when you enter a foreign country as a tourist you should have enough money to cater for yourself and any eventualities. How much money did you declare when you entered? It seems your husband does not really care about the wellbeing of his family and hence the Immigration does not believe whatever you say.

Thank you for your response. I am sorry to read the death in the family of your husband.

Good to read that the problem has been temporarily resolved and your husband has helped to extend your visa until until October. I hope it will finally be resolved once you receive your baby's passport as well as your dependant visa.

I do agree with you that each case should be determined based on its own circumstances. The fact that your visa was expiring and you were medically advised by doctors that you cannot travel at that particular time, then these should have been taken into account by the immigration officials in deciding your case.

However, this will depend on the discretion they have, though I still think they could have decided on exceptional circumstances, provided that you furnished them with those circumstances.

Our bureaucratic system should also be noted. This could also have happened in a very straightforward case. I am not condoning it, but when it comes to dealing with our immigration system we have a problem not only for foreigners, but also for Tanzanians.

Regarding whether it was a definitely violation of human rights, well it is unjustifiable to separate a new born baby from his/her mother. However, I can't see how they could have deported you without your new born baby.

On the other hand, it appears that since 2008 you have been in and out of Tanzania through a tourist visa. It also appears that your tourist visa has been extended from time to time.

If you don't mind, may be I should ask you when and where did you marry your husband?

After marrying your husband, why you didn't apply for a dependant visa at the earliest possible time?

I think a dependent visa would have helped you to avoid some of the immigration problems you're currently facing.

Is there a particular reason why you didn't apply for a dependant visa?

You also said that your last entrance was in January 2013 on a normal tourist visa, the reasons for your visit being a death in the family of your husband and to settle important matters. Can you clarify on these important matters?

I am Muslim, I do not fast, and I haven't fasted for more than 10 years now and have no intention of doing so now or in the future. (Please save me the lecture!) Besides, having a full stomach is not a prerequisite of thinking straight, having common sense or running a country wisely, otherwise Tanzania would be like Switzerland by now!

I must admit Tokyo40 you are very good when it comes to manipulating and moving things in zigzag way!
You are accusing the poor lady of not making any sense in her claims!
By saying her english is not up to " your standards!
Now ! You jump into my throat and saying things out of this thread!
Telling me that. U r a muslim bla bla bla ...!
What is that got to do with corruptions in Tanzania!?

Or to do with bureaucracy in the country!!

When did I mention that because I'm fasting "I dont think straight? !
I was only joking by say" r u fasting!! Thats all!!

YOU CLAIM TO BE A TZ CITIZEN (born and raised) at the same time PAYING $200 FOR RESIDENCE PERMIT!!

You dont pay to live in your own country mr!!
Your arrogance does not reflect your claims at all!

Your comment and accusations towards Issues1000 make very clear to me and other fellow Tanzanian that YOU ARE NOT ONE OF US!

Look for yourself! Other Tanzanian who join in to try to help this lady! For example EMT and Wacha1

Most of them do understand her and her problems! And humble towards her!,
Its only YOU who seems to be Different! !

Tanzanian are NOT hard hearted like you!. Mr lying so called muslim Tokyo40

Poor lady is crying for help and you are firing non stop accusations!

Regardless our differences we are humble people!
We dont jump into conclusions!

We do choose what to say when it comes to someone who is in difficulties!
So dont come here and make all Tanzanian look bad!

You sound like HUTUS from Rwanda!

YOU ARE NOT EVEN A MUSLIM!! AND IF YOU ARE.!! THEN YOU NEED TO TAKE YOUR FAITH FOR SERVICE BEFORE IT EXPIRES!

So why dont you get a life and join Hutus Forum (if there is any!!)

And live Issues1000 alone!

Hey mrs Issues1000 ,
That Tokyo40 he is Not one of us!

As you have noticed yourself.
He said that He paid $200 for his permit.!! To live in Tanzania!!

Just ignore that HUTTU/CHINESE/Jap etc etc!
And listen to good people frm Our beautiful BONGO LAND!

And mr Tokyo40 you have to forgive me
But thats the only way I could think of you!

But I AM FASTING AND I DONT WANT TO SPOIL MY FAST!

NO HARD FEELINGS PAL!
And if I say something which is not true!
I do apologise again!

Kahtaan, Asalaam Aleikum, Kuna kitu kimoja muhimu kinaitwa "uhuru".

How many times should I address this issue about paying for the permit???? Please READ before you ask a question. Labda niandike kwa Kiswahili, utanielewa vizuri. NIMELIPA $200 (wakati huo) KWA NIABA YA MKE NA MTOTO. Labda ningesema NILIWALIPIA mke na motto. How many times should I clarify it???? Labhna unataka nikuonyeshe pasi yangu???? You make it sound like it's sooooooooooooooooooo difficult or it's too special to obtain Tanzanian citizenship. Whichever way, I will not lose sleep over it. The level of intelligence on some people here is amazing.

Spelling mistakes anafanya hata muingereza aliyekuwa "BON N BREAD"!!!!

Ndugu yangu ktk imani!

Halafu ndio inafuata wazazi n.k,
HUO NDIO UISLAMU !, kaka

Fee amanillah.

I initially travelled to Tanzania since 2008 on another personal note after a major car accident and brain injury ,mainly just as a retreat to recover .The first time I requested an extension was for the delivery of the baby and another one after he was born as the extension was only a month.Way too soon to travel. We got married on the 12 03 2012 in South Africa where we initially met.We then returned to Tanzania in May and registered the marriage here. The reason for not prioritising the dependant pass is that travelling was constant for us.From August to December we were in South Africa and returned after messages of the family funeral. It was then decided to deliver the baby in Tanzania as the pregnancy was way too advanced to allow travelling .The baby arrived in March. The dependancy pass new fee law was only initiated last year and very few people are aware of it. The decision to settle in Tanzania came at a later stage after the father of my child secured a new projectopportunity.I meant to travel home and return. So the dependant pass application would be applied for on my return. The consequences of baby's travel documents and the refusal of an extension caused shambles. And even if they deported me with my new born,a Tanzanian by birth and genes,it would still be a human right violation. The picture headline would read baby son removed from father by forced regulation

Mheshimiwa Kahtaan, Salaam Aleikum!

Kwanza, nimefurahi kusoma Majibu yako hata Kwamba hayaniridhishi.

Mimi nalaumu elimu Duni!
Kuhusu Huyu mama, Kama nilivyokubia mwanzo, Alikuwa haeleweki. As long as there is poverty, there will be corruption. Whether in Tanzania or USA.

Futari Njema.

Salaam Aleikum Kahtaan, I hope last night's Daku wasenough to energize you this morning!
Since you claim that I have no heart ofhelping people like other Tanzanians, I have taken the task of helping you tocorrect your English grammar fished from your very own comments here. I hope itis useful to improve your English skills. I’m not the beast you try to portrayme here but rather a gentle soul. I’m however a straight forward person, I don't hide behind the bush, something many fellowTanzanians are not used to handle and confuse/misunderstand it with arrogance. Either way, itdoesn’t bother me much.
The first sentence is yours, and the second one is mine (the correct one).
You might think that's crazy! but its thefacts!
You might think that’s crazy but it’s the FACT.

Some EVIL PEOPLE have decided to live alife of corruptions, and because of that, A lot of US will pay the price.
Some evil people have decided to live the life of corruption and because ofthat, we are forced to bribe them to get any public services.

mr Tokyo40i was born and bread in Tanzania!i know my country like my own house!
Mr. Tokyo40, I was born and bred in Tanzania. I know my country likethe back of my HAND!

Especially when it comes to permits andlicences and immigration issues! or taxation, even healthy service!!
…….even HEALTH services!

I dont know which country you are comingfrom ! or which nationality you are holding but!
….. country I come from is the same as my nationality of that country… BUT …what???…..you never finished the sentence.

Tanzania authorities stinks "CORRUPTIONS BIG TIME" Starts from secondarygovernment institutions all the way to the Heads of the Country!

Expecting mothers to get a basic serviceTHEY HAVE TO BRIBE!,
Expecting mothers have to bribe to get basic services!

Even when you want to use a publictoilet(if there is any!] for a quick sh...t! YOU HAVE TO BRIBE TOO!!!!
Is there such a thing as a slow or a quick shit? Besides, it is rude torefer to “take a shit” in public conversations, it is preferable to use theterm “going to the toilet to relieve yourself”.

SO i dont know which Tanzania you are living which yousay
So which Tanzaniaare you living in????

Work the systemthe way you want but without BRIBING those Evils in positions, my friend youwill play a guitar and dance yourself! no one will dance with you!
“Play theguitar and dance yourself and no one will dance with you” makes no sense inEnglish. You have probably translated Swahili expression directly into Englishlike many people here.

You cant make a conclusion just because shedo not mention a lot about her Husband!?
You can’t make such conclusion based on thefact that she doesn’t mention her husband often.

You dont know how she is going through withall this visa and permits nightmares!?
You need to understand what she is going through at the moment (with allTHESE visa and permit problems).

May be the Husband is not cooperativeenough or disable or very poor Guy who is struggle even to find a daily bread!!
in Regards to Bagamoyo and healthy service and all that!

…….who is struggling. (struggling to find his bread and butter, poor guyand struggling in life is the same meaning.

So i cant see why you suspect that poorlady, all i suggest is ! as you seemsto have a lot of confidence about the system in TANZANIA!
why dont you arrange a meeting with that poor lady! and help her!?

You lost me here. I suggested to her thatit would have been better to bribe and get her paperwork like 99% of the peoplein Tanzania do, rather than be a commando and cross the border and come backagain in order to get her visa stamped renewed. I have ZERO confidence in Tanzania, but IKNOW, like most Tanzanians, how to play with the system to get what I want. Ihave already accepted that I am part of the problem not the solution to thecorruption issue, I will leave it to others to fight it.

Now you understand that “D” grade? I hope Ihave been helpful in improving your English.

Have a delicious Futari!

Tokyo40; ever so boastful and arrogant about what he claims or believes is his perfected English.Start a English school or something. Some of us express what we want to in any way we feel to,some of us get creative, use other terms, etc, not all stick to academics you know, many are creative, poets, lyric writers and so forth.Like I said before soak in a farm of bulls shitting,I meant that literally.Your aim to demoralize and insult by pointing out full stops ,commas and letters has no place here.Go teach A B C and use your skill to teach bribery

Points taken.Yes since 2008 i was just that a tourist,Tanzania my getaway.I married in 2012 in South Africa to a Tanzanian that I met in South Africa. And yes I was unaware of possibilities of adding minors to our passports .AND YOU ARE CORRECT,LITTLE PLANNING WAS DONE AND ALL IN REGARD TO CONSEQUENCES AND EVENTS OF EMERGENCY, and decisions were made accordingly.BUT LIKE IN LAW CASES OF THE WORST CRIMES,THERE is a trial, and the case is analyzed before judgement is passed. I have many valid points.Le

Lenient ? How ? Like saying get sixty years in prison instead of a lifetime. But valid points raised.I will use the knowledge in any future cases of consequence

Issues1000, Hate the Game not the Player!! I was merely helping a fellow Tanzanian to write English better. Reading from your replies, I think you might need my help too. There is a huge difference between writing poetically/creatively/lyrically and writing in POOR grammar like in your replies. If you don't agree, then you are the one who is arrogant and ignorant. You can't expect to write in poor English and claim to be "creative". If you don't know English, it is better to say so and get help rather than claiming to write it "poetically/creatively" etc. This is a childish claim to say the least. I don't mean to insult anyone and if that's how you think of it, then go ahead, I will not lose sleep over it since you are just an ID here to me. If you know anything about Tanzania or your supposedly country of South Africa, you would know that nothing works without bribing. And like some people said here, you are naïve to think that just because you are supposedly South African, the government will bend backwards to get your baby's birth certificate on time when you can easily obtain all the documents at your "Embassy". They have done all they can to extend your tourist visa and yet you are still complaining!!! If you are broke, say so, Tanzanians have a generous heart, and we would have easily raised funds for you to obtain the permit instead of coming here and starting a humble but hopeless war against corruption!

I'm not the beast you try to portrayme here but rather a gentle soul. I'm however a straight forward person, I don't hide behind the bush, something many fellowTanzanians are not used to handle and confuse/misunderstand it with arrogance. Either way, itdoesn't bother me much.
The first sentence is yours, and the second one is mine (the correct one).
You might think that's crazy! but its thefacts!
You might think that's crazy but it's the FACT.

Tokyo Let me tell you something.

I think I was right to call you" mentally slave".
You spend all that time try to correct my english!? Bravo! Bravo!

Pathetic! Thats what i would say!

You think that someone will reward you for that!
After all, this is same language which your colonial master used when they give orders to ur grand father to polish their shoes!

You make me feel sick by calling yourself a muslim at the same time make fun of it.

Now I have no doubt in my mind that you are one of those corrupt few!

Who are willing to sacrifice their dignity for the sake of a white man!

Uislamu huujui!

sio uislamu uliopo ndani ya mafundisho halisi ya mtume mohammad {s.a.w}

Una akili nyingi and so on!
Na sasa unajiita MWALIMU

You call yourself "a muslim" and you say that "muslim is a backward religion"??

You know what I call you!?

"The 21st century black slave"

Uislamu huujui!

I dont know if you are wearing a trouser in your house!
I think she does! ! (She is a foreigner! Right?? whom you paid bla ...bla ...bla ) and I bet she is black too!

She makes you just like herself!

Wearing a white man's skin and attitudes!

ALL IN COULD SAY TO YOU MY SO CALLED "MUSLIM BROTHER" IS:

Shame on you partner!

And guess what! Most of these behaviours came from people who call themselves"the chosen nation" u know what I'm takn about!

Wewe kama ni muislamu kweli (which I doubted very much)!

Then your level of islamic knowledge is almost "0".

Islam is not NATIONALITY! Black/white boy!
Its principles and orders! And one who obeyed and followed those orders, is called "A MUSLIM".

You mr Tokyo40 not only disobey those orders! You try to correct ISLAM!

You seems to have better proposals that ISLAM! by sayying that" mwanamke mwenye elimu huwezi kumuendesha"
Wapi umesikia uislamu unamuendesha mwanamke??

We kijana mwenye elimu duni unaweza kukosoa uislamu wewe!?

Wameshindwa hao mabwana zako unao watukuza na kujigamba kwa lugha ilio tuletea majanga huku kwetu?!

Kosa nini!?

Just Google it!

Bwana awe nawe!
Haleluyah
