Assad vs Ndugai au Uadilifu vs Kupuuzia maadili?

Unafiki wetu unachangia sana kuzima mijadala ambayo siku ikilipuka inaweza kuwa na athari kubwa kwa mustakabali wa Taifa letu. Mijadala kama nafasi ya Uadilifu katika medani ya uongozi. It is this simple: kiongozi asiye mwadilifu kwa mkewe hawezi kuwa mwadilifu kwa taifa. Na kiongozi asiyeheshimu ndoa ya mteuliwa wake, hawezi kuheshimu haki za anaowaongoza. Huu ni ukweli mtupu.
 
Namfahamu vema Profesa Assad. Nilianza kusikia jina lake mwanzoni mwa miaka ya 1990s nilipokuwa Tanga kama mwalimu wa sekondari ya Eckenforde. Walimu wenzangu wawili - wote kwa sasa ni miongoni mwa wahasibu wabobezi - walikuwa wanafunzi wa Profesa Assad enzi hizo akiwa Dokta tu. Kwa mujibu wa maelezo yao, msomi huyo alikuwa kama mpishi wa wahasibu, na pengine tu hatuna utamaduni wa kuenzi mchango ya watu waliofanyia makubwa Taifa letu ndo maana mchango wa Prof Assad katika taaluma ya uhasibu hausikiki sana.

Lakini licha ya umahiri wake kitaaluma, Prof Assad ni mcha Mungu kweli kweli. Na hili in some way limemtemgenezea maadui kitambo. Mie ni Mkristo. Mkatoliki. Lakini pia ni mwanafunzi wa zamani wa Sosholojia ya Dini ambayo nilifundishwa na Dr Father John Sivalon, msomi ambaye thesis yake ya PhD inaeleza kwa undani kuhusu mahusiano ya dola na Kanisa, na kwa namna flani kutanabaisha "ubaguzi dhidi ya Waislamu."

Kadhalika, kuna "tafiti endelevu" ninayoifanya kuhusu mahusiano kati ya Dola na Waislamu Tanzania, na kuna findings zisizopendeza kuhusu Tanzania yetu. Hatupaswi kuyasema haya hadharani lakini ukiwa Muislam msomi kisha mcha Mungu, highly likely kutaambatana na label ya "mujahidina." Na ni uadilifu na kinyume chake ndio hasa msingi wa hili sakata la Prof Assad vs Ndugai. Hawa ni watu wawili walio katika mizani tofauti kabisa. Wasifu wa Assad upo wazi kwa kila mmoja wetu kuufahamu. Mwanataaluma hiyo ni role model kwa Mtanzania yeyote yule, iwe kitaaluma au kiroho. Ikumbukwe kuwa sio rahisi sana kuwa "msomi sana" kisha "mshika dini sana" kwa sababu unfortunately usomi umeelemea katika facts ilhali dini imeelemea katika imani. So, kudos kwa msomi yeyote yule ambaye pia ni mcha Mungu, takes a lot of courage ku-negotiate usomi na dini.

Kwa Ndugai ni polar opposite ya Prof Assad. Nayajua maisha yake binafsi lakini hapa si mahala pale kuyaongelea. However, laiti sie tungekuwa sio wanafiki, leo hii Ndugai asingekuwa Bungeni, let alone kuwa Spika. We all know alichofanya kwa mpinzani wake wakati wa kampeni za ubunge. Laiti sheria ingefuata mkondo wake, huyu bwana angekuwa mahala anapostahili na si Bungeni wala kwenye wadhifa huo wa Uspika.

Tumeshusha threshold ya maadili kiasi kwamba ni poa tu kwa mtu aliyetenda alichotenda Ndugai kupewa wadhifa mkubwa kabisa kitaifa. Kimahesabu, Ndugai kama Spika anaweza kuwa Rais kwa mujibu wa Katiba yetu (Rais, Makamu, Jaji Mkuu, Spika).

Logically, kama Ndugai ali-behave namna hiyo alipokuwa Naibu Spika, what did we expect from him akiwa Spika kamili?

Moja ya mapungufu makubwa ya Ndugai ni short temper. Wanasema ana "anger management issues" ambazo japo wapo wanaoweza kutetea kuwa ni ubinadamu lakini si kila binadamu ni Spika. Moja ya sifa za uongozi hata uwe ukiranja tu let alone uspika ni kudhibiti hasira.

Kwa bahati mbaya suala hili litapita hivi hivi kama ambavyo suala la Bashite lilivyopita hivihivi. Kwa upande mmoja sie ni wepesi wa kukumbuka vitu vya ovyo ovyo lakini wagumu sana kukumbuka masuala muhimu kwa taifa letu. Angalia waliokuwa wakipiga kelele kuhusu Ben Saanane walivyomsahau. Angalia tukio la Lissu lilivyoachwa kuwa suala lake binafsi. Angalia unyama aliofanyiwa Lema na zaidi Sugu lakini jamii inaona poa tu. Angalia kilichojiri MKIRU lakini nobody gives a f*ck.

Sisi kama jamii ni chanzo muhimu cha haya mabaya yanayojiri katika nchi yetu. Tunasherehesha maovu. Tumekubali kuwa kutokuwa na maadili sio big deal lakini pindi dharau hiyo ikizua tatizo, twaanza kulalamika as if hatukujua kuwa "mzaha mzaha huzaa usaha."

Finally, no matter what happens kwa Prof Assad, kwa baadhi yetu anabaki kuwa moja la lulu adimu za taifa letu. Uadilifu wake unamfanya kuwa prone to attacks from watu wasio waadilifu. Ucha Mungu wake unamfanya atizamwe kwa jicho la hofu na "mfumo Katoliki" ambao ndo "umezaa" akina Jiwe, wanaseminari waliotengenezwa kutumikia Kanisa wakaishia kutumikia Taifa, ilhali deep in their beliefs kuna "conflicts za kiroho."

Umeongea sahihi kabisa ndugai huwezi kumulinganisha na prof. Asad kwa mambo mengi tu.

Ulitaka kuongelea nini hasa, kama ni uislam na dola mbona hukuuongelea kabisa. Tukio la Ndugai tunalifahamu, na halina uhusiano na hili la yeye na Assad maana hajampiga. Uspika alipigiwa kura hakuupata kwa kuwapiga wabunge sasa kama ulitaka tumfahamu zaidi ungeandika kwa undani hayo maisha yake unayosema unayajua na sisi tuyajue, lakini kutuonyesha picha ya tukio tunalolofahamu halafu hutumbii tusiyoyafahamu na unasema unayafahamu sasa sijui unamaanisha nini, ujumbe ni nini hasa, kwamba Assad atapigwa pia au kwanini tabia za Ndugai zihusishwe na hili la CAG na Speaker?! Tukirudi kwa Assad unasema kafanya mengi lakini hutaji hata moja, kama ni wasifu(cv) wake uko humu JF wote tunaujua, na dini au dhehebu lake tunalijua, ucha mungu wake hayo ni yake personal na imani yake. Wewe ulitakiwa utuambie hata kwa uchache kati ya hayo mengi aliyoyafanya ambayo hatuyajui. Una analyze hisia zako badala ya kuanalyze vitu au kitu unachokiongelea.
Mkuu kwa kuwa ulikua au bado ni mwana usalama unapaswa kujiandaa, lakini hivi mi sioni ulicho analyze hapa.
Speaker hakupenda ambacho hakupenda yeye, CAG aliisha ongea alichoongea hawezi kufuta wala kukana, hakuna mgogoro wowote zaidi ya speaker yeye kutokufurahishwa na alichokisema CAG. Na nisichoelewa ni kwanini Speaker achukizwe na maoni ya CAG wakati bunge sio lake ni la watanzania, yeye ni kiongozi tu. CAG hata ukimvua wadhifa alio nao anaendelea kuwa Mtanzania mwenye uhuru wa kutoa mawazo yake, sioni mgogoro, haja mtaja mtu yeyote hata cheo cha speaker hakija tajwa, sielewi hasira zake zinatoka wapi. Naweza kusema katumwa na mtu au mamlaka nyingine aongee ma waandishi kuutengeneza mgogoro maana, speaker alisema CAG anafika bungeni na ni mbunge, kwanini asingemuita kiofisi wakaongea wakamuuliza yoote waliyotaka kumuuliza, CAG haja kimbia nchi sasa kwanini aite waandishi wa habari badala ya kumuita CAG?!

Re: Unwelcome, unprecedented and dangerous wrangle between the Speaker of the National Assembly of Tanzania and the Comptroller and Auditor General.

I am a Member of Parliament in Tanzania and active member of our CPA Branch having served in the Executive Committee for the Africa Region for more than 6 years (2009-2015). I have also served as Chairman of the Public Accounts Committee and of the Public Organisations Accounts Committee for a total of 8 years and as Secretary General of the African Public Accounts Committees Organisation (AFROPAC) and that for SADC region (SADCOPAC) as the Vice Chairman.

I kindly bring to your attention a worrying dispute involving our Speaker, Rt. Hon Job Ndugai, and the head of our Supreme Audit Institution (SAI), the Comptroller and Auditor General (CAG), Prof. Mussa Assad. The current tensions surfaced when the Speaker summoned the CAG to appear before the Parliamentary Privileges, Ethics and Powers Committee.

This summons was a response to comments Prof. Assad made in an interview, in which he stated, “If we [The National Audit Office] are producing reports, yet no actions is being taken, to me, that’s the weakness of Parliament […]. I believe it is a challenge that will be worked on […]. The Parliament is failing to exercise its responsibilities effectively.” Hon. Ndugai claimed these comments were in contempt of Parliament, and summoned Prof. Assad on those grounds.

Hon. Ndugai’s actions have prompted a heated debate in Tanzania, the focus being the Speaker’s apparent violation of the constitutionally enshrined immunity of the CAG. Hon. Ndugai’s subsequent order that all oversight committees, including PAC, cease working with the National Audit Office has only added to the gravity of the situation. The Speaker’s intervention, moreover, comes just as a highly sensitive report from the National Audit Office is due to be discussed by PAC and tabled in Parliament. The report contains the results of a special investigation of roughly $650m of unaccounted for expenditure by the government in FY 2016/17.

I am particularly concerned about this matter and seek intervention from the CPA not only because Hon. Ndugai’s order constitutes a serious constitutional breach in Tanzania but also because of the dangerous precedent it will set for the Commonwealth as a whole. If Tanzanian CAG is grilled by a parliamentary committee for exercising his freedom to air misgivings regarding the work of parliament on his reports, that is a clear violation of a Supreme Audit Institution’s (SAI) independence.

May I kindly refer you to the Commonwealth Heads of Government meeting (CHOGM), held in Sri Lanka in November 2013, where the Heads of State reaffirmed their commitment to the independence of SAIs, stating in the final communique that:

“Heads recognised the contribution that strong, properly resourced and independent supreme audit institutions play in improving transparency, accountability and value for money to ensure that public funds are appropriately spent.”

For SAIs to exercise their independence, they must be free to publicise the results of their work and then undertake follow-up investigations as required. It is, therefore, worrying that the Speaker of a Commonwealth member country should hold the CAG in contempt for doing his job, namely for communicating to the public the results of his audits and for raising concerns about the failure of partner institutions to consider and address key recommendations from his reports.

At the Commonwealth Auditors General Conference held in Malta in March 2014, the participants took a collective decision to launch a campaign across the Commonwealth to realise the commitments articulated in the above-mentioned CHOGM communique. The recent comments by Tanzania’s CAG regarding our Parliament’s failure to hold the government to account is fully in keeping with the spirit of the Malta decision.

Since the Tanzanian Parliament is a CPA Member, I kindly urge that your office make a diplomatic intervention by communicating with the Speaker of the Tanzanian Parliament, alerting him to the dangers of his decision. I believe that the matter can be amicably resolved and improve the relationship between the two key institutions, Parliament and the National Audit Office, which depend on each other.

This summons was a response to comments Prof. Assad made in an interview, in which he stated, “If we [The National Audit Office] are producing reports, yet no actions is being taken, to me, that’s the weakness of Parliament […]. I believe it is a challenge that will be worked on […]. The Parliament is failing to exercise its responsibilities effectively.” Hon. Ndugai claimed these comments were in contempt of Parliament, and summoned Prof. Assad on those grounds.

Hon. Ndugai’s actions have prompted a heated debate in Tanzania, the focus being the Speaker’s apparent violation of the constitutionally enshrined immunity of the CAG. Hon. Ndugai’s subsequent order that all oversight committees, including PAC, cease working with the National Audit Office has only added to the gravity of the situation. The Speaker’s intervention, moreover, comes just as a highly sensitive report from the National Audit Office is due to be discussed by PAC and tabled in Parliament. The report contains the results of a special investigation of roughly $650m of unaccounted for expenditure by the government in FY 2016/17.

I am particularly concerned about this matter and seek intervention from the CPA not only because Hon. Ndugai’s order constitutes a serious constitutional breach in Tanzania but also because of the dangerous precedent it will set for the Commonwealth as a whole. If Tanzanian CAG is grilled by a parliamentary committee for exercising his freedom to air misgivings regarding the work of parliament on his reports, that is a clear violation of a Supreme Audit Institution’s (SAI) independence.

May I kindly refer you to the Commonwealth Heads of Government meeting (CHOGM), held in Sri Lanka in November 2013, where the Heads of State reaffirmed their commitment to the independence of SAIs, stating in the final communique that:

“Heads recognised the contribution that strong, properly resourced and independent supreme audit institutions play in improving transparency, accountability and value for money to ensure that public funds are appropriately spent.”

For SAIs to exercise their independence, they must be free to publicise the results of their work and then undertake follow-up investigations as required. It is, therefore, worrying that the Speaker of a Commonwealth member country should hold the CAG in contempt for doing his job, namely for communicating to the public the results of his audits and for raising concerns about the failure of partner institutions to consider and address key recommendations from his reports.

At the Commonwealth Auditors General Conference held in Malta in March 2014, the participants took a collective decision to launch a campaign across the Commonwealth to realise the commitments articulated in the above-mentioned CHOGM communique. The recent comments by Tanzania’s CAG regarding our Parliament’s failure to hold the government to account is fully in keeping with the spirit of the Malta decision.

Since the Tanzanian Parliament is a CPA Member, I kindly urge that your office make a diplomatic intervention by communicating with the Speaker of the Tanzanian Parliament, alerting him to the dangers of his decision. I believe that the matter can be amicably resolved and improve the relationship between the two key institutions, Parliament and the National Audit Office, which depend on each other.

Lakini mkuu hapa sioni kwanini wewe unaona dini ya CAG imeshambuliwa, wote tunafahamu ni muislam lakini akifanya kosa sioni kwanini akisemwa useme imesemwa dini. Mbona akifanya mazuri anaposifiwa husemi imesifiwa dini. Hata kwenye cheo chake hakuna uislamu wake anaitwa CAG, hata kwenye taaluma yake anaitwa Prof.Assad hakuna dini, sioni wapi hizo nyumba alizotuhumiwa nazo zinahusika na dini yake. Kwanini unadhani dini yake inashambuliwa Mkuu.
Mimi nina imani ya mungu kidini au kidhehebu pia lakini nikifanya makosa dhehebu langu haliguswi bali mimi.
Tunge acha haya mambo ya hisia tukajadili hoja vizuri mkuu. Unaweza kumtetwa Prof.Assad bila kuhusisha dini yake.

I am a Member of Parliament in Tanzania and active member of our CPA Branch having served in the Executive Committee for the Africa Region for more than 6 years (2009-2015). I have also served as Chairman of the Public Accounts Committee and of the Public Organisations Accounts Committee for a total of 8 years and as Secretary General of the African Public Accounts Committees Organisation (AFROPAC) and that for SADC region (SADCOPAC) as the Vice Chairman.

I kindly bring to your attention a worrying dispute involving our Speaker, Rt. Hon Job Ndugai, and the head of our Supreme Audit Institution (SAI), the Comptroller and Auditor General (CAG), Prof. Mussa Assad. The current tensions surfaced when the Speaker summoned the CAG to appear before the Parliamentary Privileges, Ethics and Powers Committee.

This summons was a response to comments Prof. Assad made in an interview, in which he stated, “If we [The National Audit Office] are producing reports, yet no actions is being taken, to me, that’s the weakness of Parliament […]. The Speaker’s intervention, moreover, comes just as a highly sensitive report from the National Audit Office is due to be discussed by PAC and tabled in Parliament. The report contains the results of a special investigation of roughly $650m of unaccounted for expenditure by the government in FY 2016/17.

If Tanzanian CAG is grilled by a parliamentary committee for exercising his freedom to air misgivings regarding the work of parliament on his reports, that is a clear violation of a Supreme Audit Institution’s (SAI) independence.

May I kindly refer you to the Commonwealth Heads of Government meeting (CHOGM), held in Sri Lanka in November 2013, where the Heads of State reaffirmed their commitment to the independence of SAIs, stating in the final communique that:

“Heads recognised the contribution that strong, properly resourced and independent supreme audit institutions play in improving transparency, accountability and value for money to ensure that public funds are appropriately spent.”

For SAIs to exercise their independence, they must be free to publicise the results of their work and then undertake follow-up investigations as required. The recent comments by Tanzania’s CAG regarding our Parliament’s failure to hold the government to account is fully in keeping with the spirit of the Malta decision.

Since the Tanzanian Parliament is a CPA Member, I kindly urge that your office make a diplomatic intervention by communicating with the Speaker of the Tanzanian Parliament, alerting him to the dangers of his decision. I believe that the matter can be amicably resolved and improve the relationship between the two key institutions, Parliament and the National Audit Office, which depend on each other.

Unafiki wetu unachangia sana kuzima mijadala ambayo siku ikilipuka inaweza kuwa na athari kubwa kwa mustakabali wa Taifa letu. Mijadala kama nafasi ya Uadilifu katika medani ya uongozi. It is this simple: kiongozi asiye mwadilifu kwa mkewe hawezi kuwa mwadilifu kwa taifa. Na kiongozi asiyeheshimu ndoa ya mteuliwa wake, hawezi kuheshimu haki za anaowaongoza. This is neither rocket science nor brain surgery.

Huu ni ukweli mtupu.
Hahaha kwako ndoa ndio kipimo cha uadilifu?! Unataka kusema ambao hawajaoa sio waadilifu?! Na unataka kusema ambao hawaja funga ndo wasipewe uongozi maana hatujui kama ni waadilufu au la, vipi wale ambao hawaoi au kuolewa kabisa kwa utashi binafsi au imani za dini zao kama mapadri, kardinali na papa, unadhani uadilufu wao kwenye nafasi zao ni wamashaka?! Mi nadhani maisha ya mtu ya ndoa yasiwe kipimo. Mwanandoa mmoja anaweza akawa mkorofi hili haliwafanyi wote wakawa wabaya, utiifu kwenye ndoa ni namna ya hizo personality mbili zimeamua kuishi. Machafuko kwenye ndoa hayana uhusiano na uongozi au namna mtu anaongoza. Mbona Mandela anasifiwa dunia nzima kuwa kiongizi mzuri, ndoa yake ilikuwa na matatizo. Hata baba wataifa letu Tanzania anasifiwa naye amewahi kuwa na mifarakano kwenye ndoa. Jokate hajaolewa lakini sijaona kaharibu nini mpaka sasa.
Huo unaita ukweli mtupu nadhani kuna haja uuangalie tena.
