First Lady Thandiwe Banda

Two women from Chinsali and Isoka have sued First Lady Thandiwe Banda over her money-dishing trips to various districts in the country without any Parliamentary budgetary allocation.

Evelyn Kangwa of Kalalantekwe Village in Chinsali district and Marjorie Nakaponda of Chiwanda Village in Isoka district, have sued Thandiwe in the Lusaka High Court over her recent charity trips to some districts of Northern Province.

Attorney General Abyudi Shonga has been sued as the second defendant, pursuant to the provisions of the State Proceedings Act, Cap 17 of the law of Zambia.

In a statement of claim filed in the Lusaka High Court on September 8, 2010, the two women stated that since Thandiwe moved into State House or before that she had not registered any non-governmental organisation (NGO) for whatever purposes.

“As a spouse of the President of the Republic of Zambia the 1st Defendant (Thandiwe) has no official status in the government or legal functions to perform for and/or on behalf of the government, ministries of government or departments,” the two women stated.

“From the year 2009 to date the 1st Defendant has undertaken personal trips without the company of the President of the Republic of Zambia to various districts in the country, visiting traditional rulers and purported clubs of women giving out amounts of money and various items and goods as gifts which moneys, in the absence of any express disclosure of the source by the 1st Defendant, is money from the treasury of the Republic of Zambia.”

The two women stated that these trips by Thandiwe involved the use of government motor vehicles and at times helicopters from the Zambia Air Force.

“In the month of August 2010 alone, the 1st defendant has visited Mpulungu District, Mbala District, Mpika District, Nakonde District, Chiengi District, Isoka District and Chinsali District using two Zambia Air Force helicopters in some districts,” the statement of claim read further.

“During the 1st Defendant’s visit to Chiengi District, she expressed gratitude to the people for voting for His Excellency the President in the 2008 presidential by-election and urged them to vote for him in 2011 presidential elections.”

The duo stated that apart from the President and the Vice-President, no government officer or private person, Thandiwe included, was entitled to the use of government facilities for political campaigns or canvassing for political support.

“In Isoka and Mpulungu, the 1st Defendant was involved in the distribution of the Movement for Multiparty Democracy (MMD) chitenge material which she transported using government transport or motor vehicles,” the two women stated, adding that since the recurrent expenditure falled within the realm of public expenditure, the Attorney General had an obligation to disclose to the public the amount of moneys spent by Thandiwe on her trips referred to in this action.

And the two women are praying for a declaratory judgment that the purported office of the President’s spouse as First Lady is not provided for by law and therefore, superfluous to the Office of the Head of State or any Ministry of government or department.

“A declaratory judgment that the moneys being disbursed and moneys spent on the goods being distributed by the 1st defendant to women clubs and other groups of persons in districts around the country in the absence of disclosure of the source constitutes unauthorized and/or unbudgeted for expenditure by the government of the Republic of Zambia,” they stated.

The women also claim a declaratory judgment that in the absence of moneys appropriated by Parliament in the annual budget for the President’s spouse, any government expenditure incurred by Thandiwe outside that of the President when she is part of his entourage is illegal at law.

“An order to account against the 2nd defendant for all government moneys disbursed to the 1st defendant and her entourage during her visits to the districts in 2009 and 2010 including the costs of transport thereof,” the two women stated. “An order of interim injunction, costs and any other relief the court may deem just.”

Making a ruling in the matter in chambers, Lusaka High Court judge Philip Musonda stated that it was an application for ex-parte injunction.

“I have read the affidavit in support. I think this is a matter for inter-parte and the matter will come up on 24th September 2010 at 09:00 hours. Parties may file skeleton heads of arguments and authorities,” stated judge Musonda.

Hapa bado hatujaenda kwao umakondeni na kuja na data nyingine nyingi tu. Hapa bado hatujagusia vimada waliojazwa kwenye ukuu wa wilaya na sehemu nyingine nyeti serikalini. Hapa bado hatujakuletea aliozaa nao na wanaharamu wake. Hapa bado hatujavinjari kila kona inayojulikana. Na CCM wajue. Tunapata data zake sawa na tulivyopata za EPA-wanaomjua wengi wako tayari kujitolea kuanika uchafu wake.
Hapa hatujagusa biashara zake na mambo mengine machafu kuliko hata hayo.
