The Lusaka magistrate court has granted Wife of second Republican President,Frederick Chiluba, Regina a 10 million Kwacha bail with two working sureties and immediately set free from prison. Following her temporary freedom, Mrs Chiluba appeared in high spirits as she left the courtroom, saying she was able to bear her three-day prison ordeal because of the love and support from her husband and family who visited her daily. Should the Lusaka High Court uphold the prison sentence meted out by the magistrate court, Regina will still have the option of appealing to the Supreme Court, the highest court in the land. Presiding Magistrate, Charles Kafunda has also granted former Zambia Army Commander, Jeojago Musengule, bail with similar conditions. Mrs. Chiluba who was on Monday jailed for three and half years after being found guilty of receiving stolen property, applied for bail pending the determination of her appeal. Lieutenant General Musengula was recently convicted and jailed for Four years with hard labour for abuse of office and corrupt practices. Magistrate Kafunda has however ordered Mrs. Chiluba and General Musengule to surrender their passports to the court.

Mimi naomba niongelee kuhusu Tanzania kuhusiana na hili suala la kupewa dhamana huku ukisubiria rufaa yako. Ndiyo, inawezekana mtu kupewa dhamana wakati akisubiria rufaa yake kutoka mahakama kuu.

Kifungu cha 385 Cha Mienendo ya Makosa ya Jinai kimeweka bayana ni namna gani ya kuomba hiyo dhamana. Kesi law nazo zimelezea vizuri ni namna gani unaweza kufikia vigezo vya kupewa hiyo dhamana.

THE CRIMINAL PROCEDURE ACT, 1985
§ 368: The High Court or the subordinate Court which convicted or sentenced such person may, for reasonable cause to be recorded by it in writing-
(a) In the case of a person sentenced to a term of imprisonment, order-
(i) That such person be released on bail with or without sureties pending the hearing of his appeal; or
(ii) That the execution of the sentence appealed against be suspended pending the hearing of his appeal in which case such person shall be treated as a remand prisoner pending the hearing of his appeal; and
(b) in any other case order that the execution of the sentence or order appealed against shall be suspended pending the hearing of his appeal.
(2) If the appeal is ultimately dismissed and the original sentence (being a sentence of imprisonment) is confirmed or some other sentence of imprisonment substituted there for, the time during which the appellant has been released on bail, or during which the sentence has been suspended shall be excluded in computing the term of imprisonment to which he is finally sentenced.
 
Mimi nilidhani ukishafungwa ndo basi appeal yako inaendelea ukiwa ndani. Je kama after hiyo appeal ukaonekana bado una makosa, hukumu itaanzia hapo au tangu ile ya awali?
