Kumekuwa na mjadala juu ya iwapo Rais atakiuka Katiba akiteua Waziri kutoka upinzani.Katiba ya sasa ya mwaka 1977 iliyofanyiwa mabadiliko mara kwa mara inaruhusu uteuzi wa Mawaziri kutoka popote.Lakini,Rais atalazimika kujadiliana,kabla ya uteuzi husika,na Waziri Mkuu.Uteuzi wa Mawaziri unasimamiwa na Ibara ya 55 ya Katiba.Ibara tajwa haimkatazi Rais kuteua Mawaziri kutoka popote kwakuwa haizungumzii suala la chama gani Waziri anapaswa kutoka.Ibara ya 55 inasomeka kwa kimombo kama ifuatavyo:
55.
-(1) All Ministers who are members of Cabinet by virtue of Article 54
shall be appointed by the President after consultation with the Prime Minister andthey shall be responsible for such offices as the President may, from time to time,by writing under his hand and the Public Seal, establish.
(2) In addition to the Ministers referred to in subarticle (1) the Presidentmay, after consultation with the Prime Minister, appoint Deputy Ministers. AllDeputy Ministers shall not be members of Cabinet.(3) The President may appoint any number of Deputy Ministers who shallassist Ministers in the discharge of their duties and functions.(4) All Ministers and Deputy Ministers shall be appointed from amongMembers of Parliament.(5) Notwithstanding the provisions of subarticle (4), in the event that thePresident is obliged to appoint a Minister or a Deputy Minister after dissolution ofParliament then he may appoint any person who was a Member of Parliament
before Parliament was dissolved.
