[h=1]US Lawyer Peter Erlinder: Where to find the right facts on the Rwandan genocide[/h]
Posted on April 4, 2014 | Leave a comment
In the picture it is the lawyer who is wearing the prisoner uniform, but Peter Erlinder, after two weeks in jail in Kigali, would manage to be released following international pressure. Victoire Ingabires turn in prisoners uniform starts on October 14th, 2010. Last December she has been sentenced to 15 years of imprisonment.
Peter Erlinder was imprisoned in Rwanda in 2010 when he went to defend Victoire Ingabire Umuhoza. At the occasion of commemorating the 20th anniversary of the Rwandan genocide, through an interview published by Black Star News, the US lawyer explains a number of facts that many who have been intoxicated by RPF propaganda dont have access to. There have been massive cover-up and deceit, so much so that to unveil the truth will take sometime.
Please find here a short extract of the interview.
Q: As we are getting closer to the 20th anniversary of Rwandan Genocide; what does this mean to you?
A: During the past 20 years, we have learned that a UN Tribunal charged with prosecuting all crimes that were committed in Rwanda during 1994 has prosecuted only crimes charged to the defeated and none have been charged to the victors. This means the four-year war of aggression and invasion of the RPF supported by Uganda [about which there is no dispute] is the first in history in which only the defending side committed crimes, or like Nuremberg and the Tokyo Tribunals, the supposedly neutral UN Tribunal was actually a victors tribunal. As former U.S. Secretary of [Defense] Robert McNamara admitted in the documentary The Fog of War Had the Japanese won the war, those of us who planned the gasoline bombing of Tokyo would have been the war criminals. Until a fair assignment of mutual responsibility is reached, long-lasting peace in Rwanda and central Africa will be difficult to achieve.
Q: How would you like people to look at this eventful day April 6 which many believe to have triggered the 1994 genocide and todays debate and narrative?
A: As early as 1997 UN Prosecutors recommended that Paul Kagame be prosecuted for the assassinations of Presidents Habyarimana and Ntaryamira. The U.S. removed U.N Prosecutor Del Ponte from office when she insisted on doing so on May 15, 2003. Former Chief of Staff to Kagame, Dr. Theogene Rudesingwa has admitted being involved in the cover-up. The detailed testimony in the ICTR Military-1 case resulted in every Trial Chamber, and the Appeal Chamber, agreeing that the former Rwandan military were not engaged in any criminal conspiracy before the assassination of President Habyarimana
. that would include the assassination itself. I would like people to look at the same evidence that convinced ALL of the ICTR judges.
Q: People wonder and would like to understand why very few people accused of being perpetrators of Rwandan Genocide have actually been convicted?
A: Many, if not most, have been convicted of crimes committed after the assassination of President Habyarimana. All national leaders have been acquitted of crimes of conspiracy and planning before the assassination because the Kagame regime and UN Prosecutors have no evidence to support their claim that a long-planned conspiracy to commit genocide against Tutsi, or any other civilians actually existed.

Last year Kagame arrested and imprisoned Erlinder in Rwanda, after he had traveled there to defend Ingabire, and last week the International Criminal Tribunal on Rwanda came close to sanctioning him for refusing to return to Arusha, Tanzania, to defend another client. Erlinder had said that he would not return because Kagames Rwandan Patriotic Front agents might well assassinate, kidnap, or disappear him if he did. The court did not acknowledge Erlinders claim that his life would be in danger in Arusha, but they did excuse him after his doctor reported that he suffers from post traumatic stress syndrome as a consequence of his arrest and imprisonment in Rwanda last year.
KPFAs Ann Garrison spoke to Professor Erlinder by phone from his office at William Mitchell College of Law, in St. Paul, Minneapolis:
TRANSCRIPT
Ann Garrison: Peter Erlinder, this story is still obscure to many KPFA listeners. Could you explain why Paul Kagame, the President of Rwanda, would conceivably want to assassinate, kidnap, or disappear you?
Peter Erlinder: Well, during my work at the UN Tribunal, I had an opportunity to have access to the previously secret
United Nations files that were kept by UN personnel in Rwanda during the time thats known as the genocide. And those documents tell a completely different story than the story the world has heard about what happened in Rwanda during that time. Also I was able to link that to US documents from the State Department, the CIA and the Pentagon and the documents from other countries.
And I used those documents to defend my client and he and other military officers were acquitted of the charge of conspiracy to commit genocide, which means there was no plan on the part of the previous government and military.
Ann Garrison: And do the documents that youve assembled demonstrate that President Kagame and the Rwandan Patriotic Front regime are most responsible for the mass slaughter of 1994 which came to be the principle justification of the Kagame regime?
Peter Erlinder: Yeah, what the documents show is that the RPF were the dominant military power in Rwanda. They were responsible for assassinating the Rwandan and Burundian Presidents, which touched off the mass violence. They were in a position to stop the mass violence and didnt do so because of their desire to win the war. And then once they did seize power continued carrying out violence against civilians.
Ann Garrison: And what do those documents that youve assembled say about the ensuing Congo War?
Peter Erlinder: Well, the documents make clear that the RPF went on to carry out an invasion of the eastern Congo along with Uganda and then essentially to control the eastern Congo, which they do to this day. And that was accomplished because of ongoing support from the Pentagon, and then, unfortunately, it becomes clear that this support was covered up as the ICTR began to develop.
