Rostam files 28bn/- libel case against Mengi

A prominent businessman, Mr Rostam Aziz, has sued the IPP Chairman, Reginald Mengi, listing several demands, including 28bn/- compensation as general damages for defamation.
In the suit filed by his advocate, Mr Kennedy Fungamtama on June 5, this year, at the High Court in Dar es Salaam, Mr Aziz is demanding the amount as general damages for libel, hashed up falsehoods and malicious misrepresentation of facts uttered and published by the plaintiff to the general public.
Mr Aziz wants an unconditional apology and retraction of defamatory statements made by Mengi at a press conference on April 23, this year, in Dar es Salaam, in which the latter labelled former as a shark of corruption.
On the same day, Mengi is alleged to broadcast or aired on ITV a special programme called Kipindi Maalum in which he uttered defamatory words about Mr Aziz. The special programme was repeated on April 27, this year, according to the charges.
Mr Aziz claims that the libellous statements complained of, apart from injuring his reputation and credit, stir irksome elements in public and incited or perpetuated hatred against him, thereby endangered his life and that of his family members.
The defendant, therefore, prays for an injunction against the plaintiff as well as his agents and associates, restraining them from repeating the libellous/defamatory in any form.
Mr Aziz also seeks an order compelling Mr Mengi to air on ITV and publish, at his expense, the approved apology and retraction in three consecutive issues of all mainstream newspapers, namely: the Daily News, ThisDay, Kulikoni, Nipashe, The Guardian, The Citizen, Mtanzania, The African, Uhuru, HabariLeo, Majira, Tanzania Daima and Business Times.
Mr Aziz, who is also a Member of Parliament for Igunga (CCM), seeks an order against the plaintiff to pay the defendant costs of and incidental to the suit and any other relief the High Court deems just and fit.
Early last month, through Ngalo & Company Advocates, Mengi equally filed a suit at the High Court against Aziz, seeking several demands, including 10bn/- compensation as general damages for libel. In his suit, Mengi claimed that he was defamed by Aziz at a press conference on May 1, this year, in Dar es Salaam, whereby the latter called him a whale of corruption.
