Mahakama ya Rufani waliwahi kuunga mkono uamuzi wa High Court kwenye uamuzi wa Jimmy David Ngonyani (supra) iliamua kutupilia mbali maamuzi ya mwajiri kutokana na kufanyia kazi taarifa ya uchunguzi ambayo mhanga wake hakupewa nafasi ya kuisoma na kuibeza.
Kutofuata sheria na kukiuka kwa makusudi haki za watuhumiwa siyo njia bora ya kuboresha utendaji serikalini.

Case Summary
This is an application for orders of certiorari and mandamus to remove into this Court and quash the decision of the Board of Directors of the National Insurance Corporation, and to compel the Board of Directors of the respondent Corporation to reinstate the applicant and thereby direct it to act with fairness.
Bahati J Held:
(i) Since the audit report was prejudicial to the interests of the applicant and it formed the basis of the decision of the Board, it ought to have been shown to the applicant for his comments and for an opportunity to contradict its contents; failure to do that contravened the right of the applicant to be heard;
(ii) Since the General Manager, who was in the nature of a prosecutor, was present during the deliberations of the Board which dismissed the applicant, the proceedings of the Board were vitiated by bias.
Application granted.
