Parliament to debate radar payment row

Parliament will now debate the row between the government and BAE Systems of the UK over the payment of 29.5 million pounds (Sh73.8 billion) compensation arising from the controversial sale of a military radar to Tanzania. National Assembly Speaker Anne Makinda said yesterday that MPs would have an opportunity to debate the dispute after a British court directed that the money be paid "to the people of Tanzania".

Ms Makinda made the decision after Mr Zitto Kabwe (Kigoma North-Chadema) asked that the House be allowed to discuss the government statement tabled earlier by Foreign Affairs and International Cooperation minister Bernard Membe.Mr Membe, who recently returned from London with a delegation that lobbied for the money to be paid directly to the government, briefed the House on the mission. Deputy Speaker Job Ndugai led the delegation.

The debate may bring up fresh claims on corruption in the deal in which several high-ranking government officials were implicated. The government could come under attack for the manner in which it handled investigations into allegations brought by Britain's Serious Fraud Office (SFO) against former Cabinet minister and attorney general Andrew Chenge and former Bank of Tanzania governor Idriss Rashidi.

Fugitive Tanzanian businessman Shailesh Vithlani is said to have facilitated alleged kickbacks that were equal to 30 per cent of the sale price. Court orders for his arrest have not been enforced after he fled the country.

BAE has decided to channel the reparations through charities and NGOs working. The SFO established that bribes of up to 30 per cent of the radar price that cost the taxpayer some $40 million were paid to Mr Vithlani, possibly as bribes to grease the palms of top government officials to approve the deal in 1999.

BAE admitted to information keeping irregularities entered a penalty bargain with SFO to avoid corruption indictments, after which a court imposed the reparations.

A special board was last week named by the Corporation to oversee the process to utilize the funds for the interest of Tanzanians at the same time when the government delegation was in London. In his statement to Parliament, Mr Membe said the refusal to refund the money to the government would amount to a "humiliation of the republic". He did not elaborate. He, however, said they were determined to get the payment, hinting they would consider more serious steps, including rejecting the lot if UK insisted on bypassing them.

"Tanzania may be poor country, but Tanzanians should refuse to accept payment from BAE System through charity organisations," said Mr Membe, adding that accepting the conditionality would amount to admitting that the government was involved in the corrupt deal.

BAE CASH NOT A REFUND

The tug-of-war between the government and Britain's BAE Systems is still going on six months after a UK court ordered the firm to pay Tanzania £29.5 million (Sh73.8 billion) reparations for fraudulently selling the country an overpriced air traffic control system a decade ago. BAE has decided to grant the cash directly to charities in Tanzania, but the government insists that the money be paid directly to it. The government may seem to have a point, but its position is undermined by the plea bargain reached last December by Britain's Serious Fraud Office (SFO) and BAE.

What the court ordered BAE to pay is not a refund, as some mistakenly believe, but reparations to "the people of Tanzania." This means that it is BAE which has the final say on how the money should be disbursed.

BAE had three choices. Firstly that the money is handed over to the government of Tanzania, a route thought to have been preferred by the SFO; secondly that BAE grants the money directly to charities in Tanzania; thirdly that an independent party, possibly the World Bank, is used as an intermediary to distribute the money.

The firm settled for the second option, and it is not difficult to see why it chose not to hand over the money to Treasury. The government was party to the shady deal in which a staggering $12.4 million (Sh19.8 billion) in kickbacks was paid to middlemen, and the sensible thing is to hold talks with BAE on how best the reparations can benefit Tanzania.

I am aware the British Foreign Minister in charge of African Affairs, Henry Bellingham, was in Tanzania last month and expressed concern over the BAE-radar controversial settlement at a press conference in Dar Es Salaam. He said that this was a very serious issue and that he would take it to the board when he gets back to London. Membe has said that if BAE pays the money through a charity organization, then that institution would not be allowed to conduct its activities in the country. This is a threat. The money was stolen from the people (not from the government) and should go back to the people (not the government).

I understand that BAE Systems has formed an advisory board on Tanzania chaired by Lord Cairns in line with the settlement agreement with the UK 's Serious Fraud Office (SFO), approved by the UK’s High Court in December 2010. As part of the settlement BAE Systems agreed to pay the sum of £29.5 million for the benefit of the people of Tanzania.

I am aware that a group of Tanzania all party parliamentarians have visited Britain to press for the payment of the settlement of 29.5 million pounds through the Tanzania’s Government rather than Non- Governmental Organizations (NGOs).

As a Tanzanian citizen, I am monitoring this issue very closely and I want to express my strong support to BAE System for its decision to return the money to the Tanzanian people through NGO's instead of the same tainted corrupt Tanzanian Government officials. Please bear in that this all party parliamentarians visit in Britain is costing us already.

I am afraid, this may be an exercise in futility and sheer waste of time and resources. Your attempt is devoid of any justification and no body, worth their names will ever take you seriously. Are you talking about NGOs which are outlets of fleecing? You are jocking! The money ought to go to where it came from i.e. the exchequer. If you want a debate on how it should be spent, then that is arguable. But your proposition falls short of a prudent thinking.

You are free to believe what you want. fortunately, fewer and fewer Tanzanians are still going around with their eyes closed, like you apparently do. the issue here is, BAE was given the money by the Tanzania government, the government stole the people's money. the money has been recovered and the thief wants to take custody of it! the government has no record of financial responsibility, as evidenced by the recurring and serial fraud and embezzlement in the CAG reports, with no steps taken. look at the tax free theft of our minerals proceeds, etc. this is one way of telling the govenment that we are fed up and we can no longer allow our throats to be shoved down with more garbage

Asante kwa sahihisho. nilikuwa najaribu kumjibu Mbopo aliyekuwa anajenga hoja kwamba fedha hiyo - "reparations" - ipelekwe serikalini. interest yangu haikuwa kwenye nature ya hiyo kama ni "recovered money" au "reparations". actually hao jamaa walikuwa wanahisi serikali itakataa kupokea fedha hiyo kwa kuwa ni dharau kama unavyosema, pale walipo-identify possibilities tatu: thru government, direct to the people, au thru UN:

However each solution carries potential problems.
The Tanzanian government could refuse to accept payment from BAE. Taking cash from BAE in connection with the £40m air traffic control deal it brokered could be seen locally as a tacit admission of involvement in what the judge described as "shady activity".
Nick Hildyard of campaigning group Corner House said: "The tragedy is the government of Tanzania may not even accept the money, as to do so could be seen to be admitting its part in the affair."
Giving money to local charities could turn reparation into little more than a PR exercise for BAE Systems. No process has been put in place to facilitate the third avenue."

lakini pia kuna hilo la PR excercise for BAE, ambapo kwa sasa BAE inaonekana ni good samaritan. hata hivyo hoja hiyo tunaweza kuijibu kwamba hapa kuna two evils: BAE na Serikali ya CCM. sisi tunaamua kusaidiana na one lesser evil, BAE, kuishughulikia bigger evil, Serikali ya CCM, ambayo inahusika na kufuja mali zetu ovyo ovyo. BAE yuko huko UK, Serikali ya CCM tunayo hapa na tutaishughulikia kila kona
